If they decide not to hear Rubashkin's case, his legal avenues are pretty much closed, חס ושלום--unless something totally new comes up, as I understand. </p> <p>SCOTUSblog, which is the reasonably respected blogosphere expert on the supreme court, has the case on its list of "cases to watch", which they think have a reasonable chance of being taken. </p> <p>Let's have him in mind as we say slichos and daven tonight and tomorrow. </p> <p>וישועת ה' כהרף עין. It is a middah of Hashem that he davka saves us when it looks the worst. As it says in Midrash Tehilim:</p> <p>אמרו ישראל לפני הקב"ה רבונו של עולם אימתי אתה גואלנו, אמר להם כשתרדו לירידה התחתונה [אותה שעה אני גואל אתכם, שנאמר ונקבצו בני יהודה ובני ישראל יחדו וגו' ועלו מן הארץ (הושע ב ב), אמרו בני קרח בירידה התחתונה אנו], כמה דאת אמר כי שחה לעפר נפשנו </p>
