NY Court Won’t Hear From Stop-Frisk Judge


stfA federal appeals court has refused to reconsider its order removing a judge from court cases challenging the New York Police Department’s stop-and-frisk policy.

Attorney Burt Neuborne had made the request last week on behalf of U.S. District Judge Shira Scheindlin. He asked the 2nd U.S. Circuit Court of Appeals in Manhattan to reconsider an order removing Scheindlin from the cases for allegedly running afoul of the code of conduct for judges.

On Wednesday, the three-judge panel denied the request, saying it lacked a procedural basis.

Scheindlin had ruled in August that police officers sometimes carried out stop-and-frisk unconstitutionally.
