As usual Obama is preferring to ignore the consititution and do things his own way. The correct legal device would be a general amnesty by statute. It seems he is setting up a system so that those with private lawyers (who tended to be the least sympathetic ones convicted, e.g. the big sellers and rich users) get priority.
