Supreme Court Rules Against a Request to Evict Families from the Homes of Mrs. Miriam Peretz


chnThe Supreme Court on Wednesday, 24 Menachem Av ruled Mrs. Miriam Peretz will not be compelled to evacuate homes in the Yovel neighborhood of Yishuv Eli and near Talmon, both in Shomron.

Court President Asher Grunis, Justice Edna Arbel and Justice Miriam Naor heard the appeal filed by Peace Now, which opposes the presence of the communities mentioned above. The petition was filed together with officials from Arab villages who demand the homes must be evacuated by the Jews. The court ruled the two homes will not be evacuated or destroyed, but other homes built nearby did not merit the same ruling as the court feels the land on which they were built cannot be retroactively certified.

Lt. Oriel Peretz HY”D was killed in Lebanon in 1998 and Major Eliraz Peretz HY”D was killed in an encounter with terrorists in Gaza in 2010. Seeking to exhibit a measure of compassion, Peace Now told the court in its petition that in light of the tragedy, a mother losing two sons; it is not seeking demolition of the homes of her sons, only the forced eviction of their families.

However, the court cleared the way for the demolition of two other homes in the Yovel neighborhood in Yishuv Eli for the land they are built on is a matter of dispute with Arabs and the land cannot be retroactively designated as state owned land.

  1. Peace Now, like B’tzelm, is an Arab front group that uses self hating Jews to make it appear as a liberal human rights group while in reality are pro-Arab and very very much anti-Israel.
