Appeals Court Reinstates Trucker Lawsuit Over NY Road Tolls


ezpas.jpgA federal appeals court in New York has reinstated a lawsuit by truckers claiming the New York State Thruway Authority charges excessive tolls.

The 2nd U.S. Circuit Court of Appeals in Manhattan ruled Tuesday.

Three commercial trucking companies and their national trade association claimed the Thruway Authority violates the U.S. Constitution by charging excessive tolls.

They say it’s wrong that some toll revenues are used to fund maintenance and improvements for the New York Canal System.

A lower court judge had dismissed the lawsuit, which claims high tolls reduce trucker revenue and raise consumer prices.

The tolls are charged along a 570-mile section of New York roads included in the National Interstate Highway System.

A spokeswoman for the state attorney general did not immediately return a message seeking comment.
