1. The pro-MAGA opinion that the 14th amendment was only intended to reverse “Dred Scott” (which help Blacks to be subhuman and therefore not eligible for citizenship) is not entirely wrong, however the Congress knew how to limit laws to the former slaves and their descendants, and knowingly left it applicable to all groups, including those that public opinion wished would go away, such as Jews, Irish and Chinese.
2. In the mid-1860s, anyone showing up looking for work was welcome as an immigrant. For all purposes there were no “illegal” aliens. There were also no foreign tourists (in the 1860s, getting from England to America took as long as it now takes to get from the Earth to the Moon) and no non-immigrant foreign students. If Trump had limited his campaign to tourists (from rich countries such as China who come here to give birth, foreign students, and tourists who unexpectedly give birth in America) he might have more success, but he wants to exclude the largely Hispanic migrants coming here to work and join in the proverbial American dream of getting rich through honest labor.
3. Congress makes laws, not the President. This is a concept Trump might have understood if he had worked for a publicly traded corporation whose officers have are subordinate to the Board of Directors and the shareholders.

If the Court respected the primary motive of the 14th amendment (and limited its applicability to those African Americans whose ancestors were enslaved in the United States), it would destroy the long series of cases protecting other minorities (e.g. Jews) and corporations (e.g. shuls, Jewish owned businesses, communal organizations), and end the application of constitutional rights to the states (e.g. states could again establish state religion, ban synagogues, and deny Jewish full civil rights-which the law in the antebellum period). At this point, most Americans (and Jews in particular) favor the broad reading on the 14th amendment that holds that it was intended to extend the full range of civil rights to all persons, and not to merely grant citizenship to, and protect some rights of African Americans.

Breaking into the country illegally, and cutting the line ahead of all the applicants who followed the rules to immigrate, is NOT honest labor.
There’s no reason illegal aliens should be rewarded for their crime, by granting citizenship to their children.
Africans who were imported to the USA mostly against their will have basic rights like any other US citizen, as they were part of building America for what it is today, I really doubt anyone debates that (let me know if yes…)
It is the absurdly socialist lefty world order view that everyone should be everywhere and everyone should mix and become one big nation (like sancherev style) that is what is being debated in the USA, and the same goes for the peaceful revolution going on over the pond, here in the UK and Europe.
Every land has its laws and policies, and basically, if you either disregard and disrespect those laws, if you are a citizen than you will be dealt with by the law, and if you have arrived illegaly, than you shouldn’t be there in the first place, so yu need removing, and preventing from ever trying again to come back (the same goes for the rest of those types…)
First, as Jews, we should be careful actively advocating positions on who should be an American on either side of the issue: we should remember we are guests and let the baalei habais decide what to do. And if we do participate, we will inevitably blamed both by the nativists and by invaders for being for the other side. Same way as communists blamed Jews for introducing “exploitation” to the world and then post-communists blaming Jews for communism.
But to the topic – it seem to be reasonable to deny birthright citizenship to those who are here illegally and, kal vehomer, came to explicitly gain from it. World is not like 1870s. Millions of Chinese women can buy plane tickets and give birth in US and, in 22 years, have millions more voters educated in Chinese government schools.
I wish the country could come to a political consensus how many permanent residents and temporary workers it wants, and then issue corresponding number of visas. Some of them can be supported by private charities who are willing to provide them with support. When Soviet Jews were coming to this country, they were welcome by the government, butt Jewish community took some responsibility for helping them – that undoubtfully reduced resistance.
