    In the recent case two local rabbonim said to start the shiva prior to the location of the meis. Thereafter Rav Dovid Feinstein and Rav Yisroel Mantel paskened that cannot be done and they must wait to find the meis first. As such the original plan was shelved.

    The question here is thoroughout Halacha the classical cases of a person being lost at war or lost at sea or lost elsewhere with whereabouts unknown, even though we have eidem the person entered the war zone as a fighter or went to sea and never returned, nevertheless Halacha does not deem said person to be deceased on that basis. Halacha in such terrible circumstances indicates the wife maintains her status as an eishes ish until the meis is positively identified. Presumably these halachos are what prompted Rav Dovid to pasken not to sit Shiva without first locating him.

    The question here is on what basis did the local rabbonim first assume they could consider the person deceased prior to location (before their decision was overturned)?

    The question here is on what basis do you know that this is what the local Rabbonim paskened? You don’t.
