HaGaon HaRav Yaakov Ariel Speaks Out Against The High Court


HaGaon HaRav Yaakov Ariel, has come out against the High Court of Justice’s decision compelling Israel to return bodies of slain terrorists to the PA (Palestine Authority) for burial. The court has rejected the government’s plan of holding onto the bodies towards using them as negotiating chips with Hamas to reach a deal for the return of Israelis held in Gaza and return of the bodies of IDF soldiers Lt. Hadar Goldin HY”D and Sgt. Oron Shaul HY”D.

In the rav’s article in volume one of ‘Techumin’, published by the Zomet Institute, he explains it is halachically acceptable to hold onto the bodies in the ongoing war with Hamas. The rabbi feels the High Court oversteps its bounds by interfering with the executive branch of government. Rabbi Ariel explains the executive branch must be permitted to make decisions and act as it sees fit and being that today there is a state of war with Hamas, the rules of what is permitted are changed.

  1. The State of Israel was hijacked by the lefty bias high court long time ago. The need leaders and law makers with guts to regain control and put this pro Arab supreme court in its proportional place

  2. very poor reporting, first “speaks out” is not acceptable english; it is yinglish. second the halakhic issue is permissibility. no one claimed it was not permissible. if it is wise policy and who decides that IS NOT A HALAKHIC ISSUE.

  3. “Speaks out” in this context is actually correct English. According to the Cambridge English Dictionary, to speak out means:
    “to give your opinion about something in public, especially on a subject that you have strong feelings about:
    If no one has the courage to speak out against the system, things will never improve.

    2) If it is mutar to keep the bodies, then the gov’t should be allowed to decide on the best policy, as opposed to having the court tell them what to do. The job of deciding best policy is the gov’ts, the courts job is to decide legal permissibility, so as you say this is a question of policy so should be left to the gov’t. Thats his point.

  5. tiawd, i am not an expert in English, but you certainly are not. to speak out -SINGULAR – is proper in some contexts. Speaks out – PLURAL – is yinglish. FARSHTEIST!!! an extra ess.
