A case where objectively there is bona fide abuse that remains uncorrected would seem to me to constitute halachicly just cause to be able to demand in beis din and be granted a mandatory divorce. Regarding your asking about no objective determination, if abuse is claimed by his spouse and he denies it, I seem to recall that SA specifically says that B”D places a witness in their residence to determine the truth.
