Avi, 1) A plaintiff has the right to a jury trial even if the defendant wants a non-jury trial. 2) A non-jury trial isn’t any better halachicly than a jury trial. 3) The plaintiff can utilize the courts even if the defendant would rather an ADR. 4) Even if both litigants agreed to use the secular courts, it is still generally assur to do so and they must use a beis din.
