There maybe some legal issues depending on State law. Are we talking about a simcha where there is a bartender serving drinks or the “mashkeh” is on the table? If it is on the table and the person decides to drink it is his/her responsibility to arrange a designated driver. If there is a person serving the alcoholic beverages then, depending on the state, there may be rules as to how much you can serve to a person.;
