G, really she should not be in Criminal Court at all. She has no prior experience in criminal law and was elected to the Civil Court. However, in NYC a judge can be transferred between Civil and Criminal courts and even from one borough to another depending on personnel needs. However, being that she is now in Criminal Court there is no reason why she should not be the trial judge. However, now that it has been designated a hate crime it will probably be tried in the Supreme Court.
