The freedom here is the ability to go to a public school without hearing someone talk about their religion. The ACLU realizes that if Tanach is allowed some Evangelical Catholic fresh off of hearing Levin speak to them will decide they should open class with a chapter from the New Testament. They realize it is an all or nothing proposition and nothing trumps all given the options.
