DY: That is Rabbi Yonah Reiss’ argument against women’s Smichah. Rabbi Reiss is a Gaon and it’s an interesting opinion, but most don’t agree with him (they think it’s Assur for other reasons, obviously) and it’s easy to get around. “Heter Hora’ah” does not have to include Reshus to become a Dayan. In most places Yadin Yadin is something entirely separate.
