rob: Give up on this. Yes, there are cases when we Pasken L’kulo. Yes, when all else is equal and both Shittos have completely equal validity, we say Koach D’heteira Adif. So while you may have proven your point in a perfect theoretical case, you are 100% inaccurate in your attempted application of it to today’s Halachic issues.
