    If you need to start a war pre-emptively in total surprise, how can congress first be notified?

    The president has at least 30 days after the start of hostilities to notify Congress (e.g. BTW, I started conquering Iran last month, hope you like it). It would be wise for a president to secure Congressional support (of at least the principal leaders of both parties) before starting a war, since (as is the current situation) the president will need massive amount of money to pay for the war (self-guiding rockets with lots of explosives and a close to intelligent computer system are very expensive, and the US is running out of them and needs to buy more). and only the Congress can authorize new spending and taxes.

    Clinton didn’t get authorization or give notification for his illegal war against Yugoslavia in Kosovo as well his war in Bosnia. And he ignored the 60-day deadline of the War Powers Resolution of 1973. As did Obama in regards to Libya. And Bush I in Panama and Reagan in Granada and Libya.

    Nothing new here.

    The constitution gives Congress the exclusive power to DECLARE war. Not to wage it or to initiate it, just to make a formal declaration that a state of war exists. But in the first war the USA ever fought, the war against France from 1798 to 1800, neither side bothered to declare it, and yet the US courts held that it didn’t matter; the din follows the metzius. Since the facts clearly showed that a war was being fought, there was a legal state of war, and the declaration is not me’akev.

    In practice, in USA, a declaration of war means the whole country is behind the war, including a moral commitment to finance it. It also means allies can rely on American efforts to win the war. The alternative method means the war is not a durable policy, something like tariffs or the East Wing of the White House, here today, gone tomorrow. If Trump loses control of the Congress next January, there will be no further funding of the war. If the Republicans lose control of the government entirely after the 2028 election, the new government might even change sides (e.g. demand regime change in Israel, ban nukes, and demand a return to the 197 border). The willingness of recent (last 80 years or so) presidents to fight wars with declaring them, or to negotiate agreements rather than treaties, means the US can never act as a nation, and never be more than the expression of the whims of whomever is in charge any given day.

    The USA has not officially declared war since 1942 CE — that was 84 years ago.

    Square root, that is not true. Congress declared war on Iraq in 1991 and again in 2003, and on the entire Islamist terrorist network in 2001. An AUMF *is* a declaration of war. It’s extremely silly to claim that a declaration of war must contain some magic formula such as “we declare war”.
