Who wrote the Hatarat Nedarim that we say on Erev Rosh Hashanah?
The most controversial thing about it is this line:
???????? ?????? ???????, ???????????? ????????????? ???????? ??????? ?????? ????????, ???? ?????? ??? ????????, ???? ??? ???????? ?????????, ???? ??????? ???. ?????? ????? ????????? ???????? ??? ????? ??????????? ??????? ????????? ?????, ??? ???? ??????? ??? ??????????? ????????? ???????? ???????
So this is supposed to get around the issue of having to specify the neder
See here for a little on it:

Another question that comes up is this:
?????? ????? ????? ??? ???????? ??? ??????? ?????????? ?????? ????? ??????????, ??? ????? ????????? ??? ???????? ???????????? ????????? ????? ?? ?????????, ?? ????????? ?? ???????, ?? ????? ?? ?????, ?? ??????????, ?? ???????? ?????. ??????????? ????? ??? ??? ?????? ?????????? ??????? ???? ????? ??? ?????? ????? ???????????, ??????????? ??????? ?????????, ??????? ?????????? ?????
I don’t think you are allowed to have a half charatah like this. Therefore Rav Ahron Leib Shteinman shlit”a says that this is using a pesach of “Had I known the Yetzer Hara would have overcome me in the future, I would have said bli neder on my minhag tov” (Don’t have the actual source on me)
The truth is this hatarah is controversial so it is best to ask a Rav before relying on it.
Here is more about it:

Should I ask him before, after or while he does hataras nedarim?
Every shul or yeshiva that I’ve ever been in on erev Rosh Hashana has done it.
Do I still need to ask? Also, do I need to ask him every year, or is every other or third year okay? After all, maybe he’ll read the CR and discover that for all these years, klal Yisroel has got it wrong.
June 12, 2015 8:14 pm at 8:14 pm #1144706Sam2ParticipantHopefully no one relies on that Hataras Nedarim. Most assume that it’s symbolic. If they need a real Hatarah, they do it at the right time.
June 12, 2015 8:24 pm at 8:24 pm #1144707Jewish ThinkerParticipantSam2 and DaasYochid-This is a machlokes haposkim. Some do hold it works and some poskim hold it is symbolic, therefore you should ask a Rav. Nobody is saying it is a bad minhag, we’re just questioning if it is a real hatarah or just symbolic.
Please see the Hebrew books link I posted above.
I just have one question. What exactly is the concern of one not specifying their neder? Is it that we are concerned it is a neder that the judge won’t matir? Why would a dayan not be matir a neder?
June 12, 2015 9:42 pm at 9:42 pm #1144708Kita Ches RebbiParticipantAnother question is that it mentions “nezirus Shimshon” and the halacha is that nezirus Shimshon ain loi hatarah.
June 12, 2015 11:15 pm at 11:15 pm #1144709Jewish ThinkerParticipantI made a mistake. Rav Shteiman may not be the one who said the above. I need to look into it, bli neder.
June 14, 2015 2:27 am at 2:27 am #1144710Jewish ThinkerParticipantHere are my questions:
1)Poskim advise to say it in a language you understand, bdieved if you say it in Hebrew and don’t understand it, is it a valid hatarah?
2)Since you are being matir many nedarim at once, with the pesach being the same for many of them, do you counter in every single neder how it affects the other one?
To give an example, someone has 2 minhag tovas, one to wear a tie by every davening, and one to come early to every davening to learn early in the morning. He wants to do a hatarah for both. Let’s say the minhag tova of coming early came first. Let’s say he never knew the halacha that a minhag tova becomes a neder. Now, if by the minhag of coming early to learn, the pesach would be had he knew the halacha, and that had he known he would not be able to keep it forever, he would have said “bli neder”.
Fine, but now since he had said “bli neder” by this minhag tov (of coming early) he would not have said “bli neder” by wearing a tie. (for whatever reason).
But if we look at every neder individually, then the pesach of “he never knew the halacha and had he known he couldn’t keep it forever”, would work by the tie neder also.
Basically, if we consider the pesach as like it really happened retoracively , then later on it would affect his other nederim and he may not have said “bli neder” But if we factor every neder individually, he would have said “bli neder”.
So how do we look at it, anybody know?
June 14, 2015 4:58 am at 4:58 am #1144711Sam2ParticipantKCR: There are two Nuschaos of Hataras Nedarim. One says Afilu, one says Chutz. Depending on which year your Artscroll Siddur is, it could have either one.
June 14, 2015 7:38 pm at 7:38 pm #1144712Jewish ThinkerParticipantCan anyone please answer my questions?
June 15, 2015 12:43 am at 12:43 am #1144713Kita Ches RebbiParticipantSam2: Thank you. I never came across “chutz”, all the machzorim I ever used had “afilu”.
April 1, 2016 7:46 pm at 7:46 pm #1144715Jewish ThinkerParticipantJust to clarify:
I was interested in starting a discussion and discussing these halachos. Some may assume that I thought it is advisable to pasken from the CR which I believe is unwise.
