    The kinyan (exchanging a pen or gartel or whatever) is just a way of making it clearer. There is no inherent reason why one can’t make a contract over the internet (or through the mail), either by halacha or the goyim’s law. The only issue if proof of identity (ask for a moment if in the past you had to show your passport or drivers license or ID card when selling hametz).

    You’re not selling the chametz when you exchange the pen, gartel, or anything else. You are appointing the Rav to be your Shaliach to sell the chametz on your behalf.

    Yes, chometz can be sold without a physical presence. For at least the past ten years, I think even longer, there have been several web sites allowing people to sell their chometz online. Just search for “sell your chometz” and you will find it.

    Milhouse: Just because some have been doing it doesn’t indicate all agree it is acceptable.

    In fact now that I think about it I’m pretty sure I saw a service over 30 years ago, before there was even a world wide web, that let you sell your chometz by email.

    There’s no problem going to someone’s house during these difficult times. As such there’s no problem going to your Rov’s house and selling it in person just like you do every other year. There needn’t be 10+ people in the house with the Rov. Everyone can come at a different time; even by appointment.

    The Piskei Teshuvas 448 says in the name of Rav Eliyoshov ztz’l and others that we can designate the Rav to sell the Chametz through the telephone as revealing your intentions is enough in selling chametz. Therefore virtual selling should also be good.

    Theres a lot of confusion on this thread.

    No, a sale requires a kinyan, mot kinyanim require both parties (He might be able to do a chazaka on karka aquiring chometz with kinyan agav alone)

    now, most of us don’t sell our chometz. We appoint the Rav to sell for us. That appointing of a Rav, pashtus DOES NOT require a kinyan, sure in most yeas we can be “mehader” to appoint the rav wit a kinyan, but as most poskim do’t require that , the Rav can be appointed virtually.
