Jews, Arabs Clash In Tzefas

Police forces in the northern city of Safed launched an investigation Saturday into a confrontation between ultra-Orthodox and Arab college students. No injuries were reported, but property was damaged.

On Friday night a group of orthodox Jews threw stones at Arab students who rent apartments in Safed. The event took place after the city’s chief rabbi, Shmuel Eliyahu, called earlier this week for owners to avoid renting apartments to Arabs.

“The place looked like after a pogrom,” a Safed resident said. “The police arrived, and since then there have been police cars in the area.”

The resident, who did not want to be named, said the violent incident began with an argument between Arab students from Safed College, who rent apartments in the city, and Chabad yeshiva students of American origin.

“They yelled, ‘Death to Arabs,’ and the others yelled, ‘Death to Jews.’ Then the fight broke out,” he said.

The incident happened close to midnight on Friday, at a pedestrian mall. Superintendent Gadi Ron of the Safed Police Department told Ynet that after the verbal exchange the two sides began throwing stones at each other. The police soon stopped them and took testimonies from eye witnesses, but did not make any arrests.

The police denied any connection between the fight and a proclamation signed earlier this week by Safed rabbis, which called on home-owners to avoid renting or selling apartments to Arab students, and to shun those who do.

“From our point of view, the background for the incident is thuggery,” Ron said. “We will continue to investigate until we get to the bottom of it.”

The police claimed that there is no escalating tension, but additional officers have been deployed in the city.

Representatives of Safed College responded in a statement saying that the events are unfortunate, and were “caused by extremists from both sides.”

“We are working with the authorities to preserve the tolerance and cooperation that have characterized this city and college throughout the years,” the statement said.

Drill At Lincoln Tunnel Will Simulate Explosion Sunday Morning

An emergency drill at the Lincoln Tunnel Sunday morning will simulate an explosion near the New Jersey Toll Plaza, complete with loud noises and emergency crews working, according to Jersey City’s transportation website.

The drill will begin at 8 and end at 10 a.m. The tunnel will be open to normal traffic in the center and north tubes. The south tube will close from 1 a.m. to 11 a.m. for the exercise, according to the Port Authority.

Detour signs will indicate lane closures along JFK Boulevard and near the plaza. Motorists should expect minor delays.

NYPD: To Serve & Protect, Perched on 3 Wheels

You may have seen them zipping along underground, seeming quite determined and purposeful on their way from this point to that. Or perhaps you spotted them standing alone by a subway exit, like kids who want you to see but not play with their awesome new toy.

If you haven’t seen them at all, you may soon. Police officers have begun patrolling select subway stations on electric scooters, and visibility is their main selling point.

The vehicles, made by the California company T3 Motion, are used across the country in stadiums, airports, convention centers, department store parking lots, college campuses and other settings that require security personnel to cover a large area. For the New York Police Department — which has 12 total in use, in the subway, public-housing projects, Yankee Stadium and Citi Field — they are a new tool for community policing that consumes far less energy than a car and far fewer oats than a horse.

The scooters — the company calls them “zero gas emissions all-electric vehicles” — can go at a leisurely 1 mile per hour or book it at 20. Each can turn on its own axis. With an extra battery (so that one can recharge while the other runs) they can go 24/7. They emit no nasty fumes and, after the initial cost of $8,900 (retail), cost about 10 cents a day to use.

Unlike horses, which make officers tower above the crowd, or motorcycles and bicycles, which position them below pedestrians, the scooters place riders nine inches above the ground — high enough to see over people without intimidating them. “I always thought the No. 1 goal for police was serve and protect,” said Ki Nam, the company’s founder and president, “but it’s really community relations. They want to be close to the community. They want to be a command presence, yet approachable.”

In the four subway stations where these flashy Robocop gizmos are in use — Times Square, the Port Authority, Grand Central and Coney Island — people do, indeed, approach the officers. Some ask directions or seek assistance. Others just gawk at the flashy Robocop gizmos.

Diabetes To Double Or Triple In U.S. By 2050

Up to a third of U.S. adults could have diabetes by 2050 if Americans continue to gain weight and avoid exercise, the Centers for Disease Control and Prevention projected on Friday.

The numbers are certain to go up as the population gets older, but they will accelerate even more unless Americans change their behavior, the CDC said.

“We project that, over the next 40 years, the prevalence of total diabetes (diagnosed and undiagnosed) in the United States will increase from its current level of about one in 10 adults to between one in five and one in three adults in 2050,” the CDC’s James Boyle and colleagues wrote in their report.

“These are alarming numbers that show how critical it is to change the course of type-2 diabetes,” CDC diabetes expert Ann Albright said in a statement.

“Successful programs to improve lifestyle choices on healthy eating and physical activity must be made more widely available because the stakes are too high and the personal toll too devastating to fail.”

The CDC says about 24 million U.S. adults have diabetes now, most of them type-2 diabetes linked strongly with poor diet and lack of exercise.

Boyle’s team took census numbers and data on current diabetes cases to make models projecting a trend. No matter what, diabetes will become more common, they said.

“These projected increases are largely attributable to the aging of the U.S. population, increasing numbers of members of higher-risk minority groups in the population, and people with diabetes living longer,” they wrote.

Diabetes was the seventh-leading cause of death in the United States in 2007, and is the leading cause of new cases of blindness among adults under age 75, as well as kidney failure, and leg and foot amputations not caused by injury.

“Diabetes, costing the United States more than $174 billion per year in 2007, is expected to take an increasingly large financial toll in subsequent years,” Boyle’s team wrote.

New Poll Shows Paladino Closing on Cuomo

The latest poll on the race for New York State Governor shows Republican underdog Carl Paladino trailing Democrat Andrew Cuomo by only 14 points.

A Siena Research Institute poll released earlier this week showed Paladino down by more than 30 points.

A Rasmussen research poll  of likely voters released Friday shows Cuomo leading Paladino 51-37, with 5 percent supporting another candidate and 6 percent undecided.

The report shows only 39 percent of voters in the state have a favorable opinion of Paladino. In contrast, Cuomo is viewed favorably by 57 percent of voters.

Paladino campaign manager Michael Caputo released the following statement regarding the latest poll:

“Today’s Rasmussen Reports survey of likely voters in the New York State shows Buffalo builder Carl Paladino down by 14 points against career politician Andrew Cuomo, 51 to 37 percent. This is wildly different from the recent Siena and New York Times surveys, both which showed a dubious difference. Public polls are unreliable in this volatile election season, but Rasmussen appears to have a better handle on their research in this environment. Paladino supporters are excited this race is tightening again as our statewide media buy kicks in.”

H-P Releases Its $800 Slate, The Latest iPad Rival

Hewlett-Packard Co. released Friday a touchscreen tablet computer that runs Windows, becoming the latest computer maker to jump into the fray following Apple Inc.’s debut of the iPad earlier this year.

H-P’s Slate 500 tablet can be bought on the company’s website for $799—above the price of most iPads, which range in price from $499 to $829, depending on storage space and wireless connectivity.

The Slate 500, which has an 8.9-inch screen, will run Microsoft Corp.’s Windows 7 operating system, and is targeted at business customers. IPads have a 9.7-inch screen.

Microsoft Chief Executive Steve Ballmer showed off a prototype of an H-P tablet running Windows 7 at a technology conference in January, but the device is reaching consumers nine months later, and six months after the iPad went on sale.

On its website, H-P calls the Slate 500 “the ideal PC for professionals who don’t usually work at a traditional desk, yet need to stay productive in a secure, familiar Windows environment.”

The Slate features front and rear cameras—features that aren’t available on iPads—and will have up to 64 gigabytes of storage space. It has a touch-sensitive screen as well as a digital stylus pen.

It comes equipped with Wi-Fi access but no built-in capability to connect to high-speed cellular networks, as rivals including the iPad, Samsung Electronics Co.’s Galaxy Tab and Dell Inc.’s smaller Streak have.

Shipments are expected to start taking place by mid-November. H-P is also expected to make similar devices that run WebOS, an operating system made by Palm Inc., which H-P acquired for $1.2 billion this year.

Many device makers, such as Samsung and BlackBerry maker Research In Motion Ltd. , have recently announced tablets to rival Apple’s wildly popular device. Apple said Monday it sold 4.2 million iPads during its latest quarter.

When Hashem was preparing to annihilate Sedom, He makes a decision to inform Avraham of his plans. He tells Avraham that they are an appalling and corrupt place and the only way to put a stop to this is to obliterate the entire city. Avraham acts as a defender for Sedom and asks Hashe, if he will spare the city’s destruction, if he could find 50 righteous people.  Hashem answers he would, and as we see in the pasukim 50 righteous individuals were not found. He then proceeds to ask Hashem how about 45 people and 40 and 30 and 20 and 10, etc…
 
There seems to be a discrepancy in the loshon that is used in the pasuk. When Avraham asked Hashem to save Sedom should He find either 40 or 30 tzadikim, the pasuk uses a loshon of ‘lo e’eseh’, I will not do anything.  Why? Because the zechusim of 50 tzadikim was significant enough to hold back the wrath of Hashem. But when Avraham asks Hashem if He can find either 20 or 10 people the pasuk says ‘lo ashchis’, I will not destroy. This implies that there will be some type of calamity but that Hashem will not completely wipe out the city. This was due to the fact that there was not a significant amount of tzadikim there to hold back Hashems wrath. However, by forty five people the pasuk uses the same loshon of ‘lo e’eseh, I will not destroy, that was used by 20 or 30 people. Given the amount of tzadikim there, shouldn’t the pasuk have used the loshon of ‘lo e’eseh’, I will not do anything, just as it used it by 40 and 30?
The Meshech Chochma answers with a yesod for us all to learn from.
 
In Pirkei Avos it says ‘know who will you stand before and before whom you will give a DIN and CHESHBON’. What are these two things? Din, we know, is judgment. What is cheshbon? The GR”A writes that cheshbon is,  that you get punished not only for the misdeed you committed but also for the mitzvah you could’ve done and did not carry out. These are the two elements in every judgment. One is that you did the actual misdeed and the second is that you did not do a mitzvah.
 
Now make the following computation. Avraham says ‘maybe there are forty five tzadikim in Sedom…’ forty five divided by five, for the five cities within Sedom, comes out that there are nine righteous people for each of the five cities.  Says the Meschech Chochma, if that scenario is true that there were only nine tzadikim in their city, then they are only one short. Every person, besides those nine, could have been the tenth man had they applied themselves. Becoming the tenth tzaddik, could have saved an entire city. Yet, nobody moved and no one changed! At forty five people the punishment was more severe, because the Ribono Shel Olam took into consideration that each person had the responsibility to be the tenth tzaddik. From the fact of reality that they didn’t, their penalty was much greater. If there were forty people and each city only had eight tzadikim then people can say even if I’m the ninth, how do I know there will be a tenth? But by nine tzadikim, no one felt the urge and desire to improve themselves and to save the city. Therefore, their punishment was greater.
 
Every person has to understand, that what he does can affect more people than he thinks. If someone has the opportunity to participate in the enhancement of kovod shem shomayim and its attainable, yet he decides to pass on it, that creates destruction. They had nine people in the city! There should have been one person there who felt a responsibility to be the tenth to be mekadesh shem shomayim!
 
May we all be zoche to not only realize when opportunities are knocking at our door but to also grab and act on them; and IY”H by doing so we can prevent future misfortune in the world.

Effective immediately, River Ranch Fresh Foods, LLC is no longer under Star-K Certification. The company has been purchased by Taylor Farms, CA. This should not be confused with Taylor Farms, MD, which is under Star-K Certification. The following brands are affected by this change: Fresh1/Fresh ‘n Easy, The Farmers Market, Dewy Fresh, Promark, Popeye, River Ranch, Shaw’s Market Fresh, Compliments, Sysco Natural, Archer Farms, Cross Valley Farms, Winn Dixie.

Please be advised that the following products made by David Roberts Food Corp were labeled with an unauthorized COR 564: Two for the Road Ju Jubes, 80 g packet and Two for the Road Red Berries, 70 g packet. These products are not kosher even when bearing the COR 564.

Uchida Authentic Rice Malt (Mitoku Macrobiotic) may bear Hebrew stickers (in Israel) stating that the product is certified by OK. Although many Mitoku products are certified by OK Kosher Certification, the Uchida Rice Malt is not certified.  
All certified Mitoku products have the OK kosher symbol printed on the label.

Please be advised that the RCC has discontinued its certification of the following establishments: Bonjour Cafè in North Hollywood and Maohr Catering in North Hollywood.

Some Honeyfields Chocolates and Cones products (e.g., Granadilla Sauce, Go-Go Bars, etc.) bear an unauthorized Johannesburg Beth Din logo. These products are not under the supervision of the Beth Din. Appropriate action is being taken against the manufacturer.

The dairy designation was inadvertently omitted from several packages of Fannie May Chocolates. All Fannie May chocolates bearing the cRc logo are dairy, Cholov Stam. Corrective measures are being taken.

All products from Nikola’s Biscotti & European Specialties Co., Minneapolis, MN 55420 are Blue Ribbon Kosher certified and are Dairy Stam, as listed on the ingredient panels. These products contain dairy ingredients as shown on individual retail packaging and ingredient panels, however, the dairy stam designation has been inadvertently omitted from all shipping cases, both bulk and commercial products (packed without inside labeling) as well as for retail products (with labeling). Future packaging will be revised.

Apple Rush Organic Sparkling 100% Juice, in all flavors, is no longer under Blue Ribbon Kosher Supervision. Apple Rush Organic Sparkling 100% Juice, in all flavors, is no longer certified by Blue Ribbon Kosher. The company had been certified kosher but all certified product has long exceeded its expiration date. There should not be any of the certified products remaining. Anyone spotting product with a Blue Ribbon Kosher claim is urged to contact Blue Ribbon Kosher

Kosherquest.org reports that Kosher To Go restaurant located next to Continental Bakery on Burbank Blvd. in Valley Village, CA is a non kosher restaurant. The “Hechscher” letter on the store says only that they have applied to a kashrus agency and hope someday to be kosher certified.

Maplegrove Gluten Free boxed pasta products that contain white or yellow cheese packets bearing the COR 272 Dairy label may contain white or yellow cheese

packets that are not kosher. Cheese packets that do not have a Circle-K (OK) Dairy symbol on them should be discarded. Cheese packets that do have the Circle-K (OK) symbol may be consumed.

A Kashrut.com reader reported finding krill, a small crustacean similar in appearance to a small shrimp in some cans of Brunswick Sardines in Olive Oil. Sardines are a small herring and are a natural seafood product. The main components of the herring diet are krill and other zooplankton present in the ocean in which it lives. Due to the feeding habits of the fish, krill may occasionally be present in a tin of sardines. Krill in the stomachs can bust out and appear in the can. This is a very rare occurrence. Bumble Bee reported that consumers reported approximately 20 incidences in over 20 million cans.  
Kashrut.com advises that if you see this, do not eat the sardines and report the problem to the manufacturer, including all production and date codes. 

New Ravens Pizza, located at 116 Chartley Drive, Reisterstown, MD 21136, recently distributed flyers bearing a Star-K logo. New Ravens Pizza is not Star-K certified and is not Kosher. Corrective action has been taken.

Please be advised that Nature’s Blend Premium Bagels Whole Grain Whole Wheat being sold at Safeway stores was labeled with an unauthorized COR 153. This product is not under COR certification.

It has recently been discovered that Red Cabbage can be infested with insects. As a result, the Star-K has upgraded its Red Cabbage inspection procedures from a simple thorough wash to the same procedure used for other leafy vegetables. Packaged Red Cabbage that is kosher certified as insect-free remains acceptable.

The Chicago Rabbinical Council has started “tweeting” on Twitter (www.twitter.com/crckosher) some of their common daily questions. Below are some of the most recent “tweets” that will be helpful for the kosher consumer:

  1. Lecithin granules require a reliable hashgacha.
  2. All unflavored tea leaves and tea bags do not require hashgacha.
  3. Parchment paper sheets and bags normally require a reliable Hashgacha.
  4. Bean sprouts, other than a cursory inspection for obvious infestation, do not need to be checked for bugs.
  5. Cooking for Yom Tov? Aluminum pans and aluminum foil sheets and bags do not require hashgacha.
  6. Metal or glass salt and pepper shakers must be toiveled in a mikva prior to use.
  7. Dried dates with no added flavors or ingredients do not need a hechsher. Non-pitted or foreign would need to be checked for bugs
  8. Blanched almonds require a reliable hashgacha.
  9. Brown Basmati Rice from India does not need a hechsher, as well as all unprocessed raw rice which isn’t flavored, seasoned or colored.
  10. Canned vegetable soup, even “Vegetarian Vegetable Soup” requires a reliable hashgacha.

Kashrus Updates from Israel: 

The Eida Chareidit announces it has removed its hechsher from the Kilufei Katif factory, and as such, assumes no responsibility for the product. This includes bags circulating in the marketplace bearing an Eida logo.Anyone who has purchased the product is instructed to set aside trumos and ma’asros (without a bracha) since there is a doubt, as well as to inspect the greens for possible insect infestation.

SHATNEZ ALERTS

Shatnez finding in Delhaye Men’s Suit points out the need for vigilance as the garment label states “100% wool” but in actuality, the garment in question is polyester, and yet, it contained shatnez. 

The Flatbush Shatnez lab discovered a lady’s DKNY wool coat containing linen in an unusual place, the piping of the garment.

WikiLeaks Plans Major Annoncement; Prompts U.S. Alert To Iraqis

A Pentagon team has been reviewing copies of Iraq war documents the website WikiLeaks may release in coming days and plans to notify Iraqis named in the documents in an effort to minimize potential damage from the security breach, defense officials said.

The Pentagon set up a 120-person Information Review Task Force originally to look at Afghanistan war documents released by WikiLeaks, and to identify people who were named in the intelligence reports.

Pentagon officials fear the leaked documents could be used by the Taliban to hunt down those identified as working with the U.S.-led war effort.

In recent weeks, the task force has been looking at Iraq war documents the Pentagon believes were given to the controversial website by PFC Bradley Manning, who has been charged with giving sensitive material to WikiLeaks. PFC Manning hasn’t commented since his arrest.

A defense official said the task force was identifying Iraqis who are named in the documents, and who might need protection or assistance if their names are released.

“We are prepared to take steps to notify people named in the documents,” said the official.

The Iraq war documents are expected to be released by WikiLeaks in the coming days.

The Pentagon believes WikiLeaks has more than 400,000 documents from the Iraq war, mostly raw, low-level intelligence reports.

The defense official said the department had chosen not to notify people named in the documents because it doesn’t know if WikiLeaks will redact the names.

“There are a lot of names [in the documents,]” said the defense official. “We can’t chase every single person. And we have to see what happens. Maybe no one’s name will be released.”

Cash-Only Drivers May Get Higher Toll Hike

E-ZPass users may get a break when the Metropolitan Transportation Authority Board votes next week on toll hikes.

But those who use cash-only lanes should prepare to dig deeper into their pockets.

According to the Daily News, drivers who pay with E-ZPass will be hit with a five-percent increase, just half of what was originally proposed.

The paper says drivers who pay cash will be hit with an 18-percent hike.

Board members tell the News they want to encourage more drivers to use E-ZPass, which they say will reduce MTA labor costs, traffic congestion, and pollution.

The agency had originally proposed a 25-cent to 50-cent increase per trip on its bridges and tunnels.

If approved, the hikes will go into effect in January to help close the agency’s budget gap.

New Bill: Yeshiva Students To Get Millions

The Ministerial Committee on Legislative Affairs on Monday is expected to discuss a bill which will see yeshiva students get hundreds of millions of dollars from the State. The proposal, which is aimed at bypassing a High Court ruling, was initiated by Knesset Member Moshe Gafni (United Torah Judaism).

The new bill proposes “establishing the right of yeshiva students whose Torah is their profession to receive a grant.” It was signed by MKs from the United Torah Judaism, Shas and National Union factions, who explained that their goal was to reach a unique settlement which would grant funds to yeshiva students with at least three children.

The High Court of Justice ruled in 2000 that granting yeshiva students assurance of income harms equality, as it does not apply to people who do not study in non-religious institutions. Ten years later, the Supreme Court ruled that the budgetary clause violates the duty to equally distribute the State’s support, and therefore cannot be included in the budget laws as of 2011.

MK Gafni decided to submit the bill in a bid to bypass the court decision. Following the Supreme Court ruling, the Knesset’s Finance Committee examined the subsidization of tuition in higher education institutions and the aid funds and scholarships available to students.

The figures reveal that the total budget allotted by the State in the 2010 budget to support students stands at NIS 450 million (about $125 million), while the budgetary clause referring to assurance of income for yeshiva students totals NIS 121 million (about $33 million).

The bill’s initiators wrote that “the State encourages Torah studies and should therefore allow a modest living grant for yeshiva students who have chosen to follow this path.”

Knesset Member Nachman Shai (Kadima) said he planned to submit a similar bill in which he would add the word “students” to any mention of haredim. “Any other law would be discriminative and offensive,” he stated.

NYers Happy To Call Big Apple Home, Poll Finds

Despite complaints about the high cost of living, a new poll shows most New Yorkers enjoy where they live.

The Marist Institute conducted a poll on New York living for the Municipal Art Society. However, results did show that the level of happiness was higher in certain boroughs

Of the New Yorkers surveyed, 84 percent said they were satisfied or very satisfied living in the city; 82 percent were satisfied with their own neighborhood.

While nine out of 10 Manhattanites were satisfied, only three out of 10 Bronx residents were satisfied.

Bill Clinton’s Nuclear Launch Card Was Missing ‘For Months’

A former chairman of the Joint Chiefs of Staff says in a new book that while Bill Clinton was in the White House, a key component of the president’s nuclear launch protocol went missing.

“The codes were actually missing for months. This is a big deal,” says Gen. Hugh Shelton. “We dodged a silver bullet.”

In his book “Without Hesitation,” the retired Army general writes, “Even though movies may show the President wearing these codes around his neck, it’s pretty standard that they are safeguarded by one of his aides, but that aide sticks with him like glue.” He adds that President Clinton “assumed, I’m sure, that the aide had them like he was supposed to.”

What apparently was missing was a card with code numbers on it that allows the president to access a briefcase — called the “football” and kept by an aide always near the president — containing instructions for launching a nuclear attack.

Once a month, Defense Department officials conduct an in-person verification to make sure the president has the right codes. At least twice in a row, Shelton writes, a White House aide told the Pentagon checker that the president was in a meeting but gave a verbal assurance that the codes were with him.

Then one month around the year 2000, according to Shelton, when the time came to replace the codes with a new set, “the president’s aide said neither he nor the president had the codes — they had completely disappeared.”

Shelton writes that all this happened very likely without Clinton’s knowledge.

NYPD Expands Ticket-Fixing Probe To Queens & Manhattan Too

An internal probe of alleged ticket-fixing by Bronx cops has expanded to Queens and Manhattan, police sources said Thursday.

Records were pulled this week from the 106th and 107th Precincts in Ozone Park and Fresh Meadows, along with a highway unit in Queens. The Internal Affairs Bureau also seized records from the 26th Precinct stationhouse in Morningside Heights and the 32nd Precinct stationhouse in Harlem.

It wasn’t immediately clear if IAB investigators are focusing on particular officers or if the inquiry is broader in scope.

The Daily News reported Tuesday that Deputy Inspector John D’Adamo, commanding officer of the Bronx’s 52nd Precinct in Bedford Park-Norwood, has been accused of fixing tickets for his friends and relatives.

“He is mortified that his good name and excellent reputation has been associated with these allegations,” said Roy Richter, head of the Captains Endowment Association, the union representing D’Adamo.

Sources said D’Adamo’s name surfaced in a probe that started nearly a year ago and was connected to allegations that an officer in the 40th Precinct in Mott Haven was involved with a local drug dealer. That officer has since been placed on modified duty but has not been arrested or slapped with departmental charges.

Investigators are also looking into allegations that at least one Patrolmen’s Benevolent Association delegate from the Bronx has been involved in fixing tickets.

Last month, the IAB started an audit of ticket activity in all 12 Bronx precincts. That included parking tickets, moving violations and summonses for quality of life issues. More records were pulled yesterday from Bronx borough headquarters.

Japan Trial Update 10/21/10

It’s been a very eventful week for Yoel Zev ben Mirel Risa Chava. On Monday, the final phase of his trial began. Rav Moshe Chaim Levy, Mashgiach of Satmar Yeshiva in Bnei Brak, took the stand and testified about Yoel Zev’s  excellent character. Yoel Zev was brought to the witness stand shortly afterwards. He seemed quite confident and self assured. As was reported on this website, he was questioned about his knowledge of the secular world, and it was obvious from his responses that he was totally unfamiliar with it.

On Tuesday, Yoel Zev was questioned about his trip to Japan. He said he had asked the flight attendant to assist him in filling out the landing form, being that he had no previous experience with international travel.  The defense brought up another important element in the story, the language barrier.  Since Yoel Zev didn’t understand a word of either Japanese or English, many of the original statements which he made while being questioned by airport security were misconstrued by  government interpreters.

It was also noted that a new judge had been assigned to his case just two weeks ago, and askanim are hopeful that he will be more attuned to the details and the facts of this case than the preceding judge.  They are planning to request permission to submit new evidence or perhaps to bring another witness (polygraph Professional )to the stand to testify in defense of Yoel Zev.

On Wednesday, Rabbi Moshe Dovid Niederman of United Jewish Org. of Williamsburg, testified for almost five hours.  He described in detail the history of Satmar, beginning with the Satmar Rebbe’s coming to America from Europe and opening Satmar mosdos.  The Rebbe’s primary mission was to keep his Chassidim separated from the negative influences of the outside world.  Youngsters, especially, are sheltered from the environment and have virtually no contact with any secular media whatsoever.

At this point the prosecutor interjected, pointing out that several years ago there actually was an incident reported in the press of  Chassidic Jews smuggling and trafficking drugs.  Rabbi Niederman explained that he is personally familiar with that case, and assured the court that the circumstances were entirely different.  Those individuals were not Yeshiva students and were involved with the secular world.

It seemed to the askanim that the judge took tremendous interest in the defense testimony, especially in the description of the Chassidic lifestyle.  Closing arguments in Yoel Zev’s trial will begin on November 2nd.

According to R’Naftali Steiner, one of the askanim involved in the case, “We understand that the olam is very concerned about the fate of these boys, and we are committed to doing our utmost in keeping everyone informed on forums such as this one.”  He assures us that the greatest efforts are being made to bring this to a favorable conclusion.  “Our most prominent and capable askanim,” he said, “are working around the clock and have been occupied with this case for two and a half years.  They are being cautiously optimistic.  Dayan Weiss who heads the rescue mission, spared no expense in hiring Japan’s most skilled and qualified lawyers to work on our behalf.”

As far as the rest of us are concerned, he asks that we continue to daven for a yeshua for Yoel Zev ben Mirel Risa Chava and Yaakov Yosef ben Raizel.  The olam is urged to contribute whatever they can to help pay the astronomical expenses that have accrued in these heroic efforts to achieve pidyon shvuyim.

Our Sedra relates the episode of the Sacrifice of Isaac, the Akeida. By way of introduction to this momentous event, the Torah tells us וה’ ניסה את אברהם – that Hashem tested Avrohom. There are traditionally two main schools of thought as to the meaning of Nisyonos – “tests from Hashem”. The first says simply that they are meant to prove one’s level of Avodas Hashem. The second school of thought maintains that these ‘tests’ are meant to force the subject of the test to rise to a higher level – the level required in order to pass the test. In either case, the objective is not so much to see whether the person being tested will pass or fail – Hashem knows the innermost self of everyone and has no need to ‘test’ – but to provide the subject of the test with the opportunity to actualize potential into reality. Regardless of how we view Nisyonos, however, once someone has “passed” a Nisayon it is rather clear that indeed a certain level of Avodas Hashem has been achieved. Although Chazal tell us that Avrohom Avinu was tested ten times by Hashem this is the only time that Hashem prefaces a test by saying that it’s a test. Chazal also tell us that this was the final “test” that Hashem gave Avrohom.

                The above points clearly to this final trial as being a far greater test than any of the others Hashem gave to Avrohom Avinu – both because it’s prefaced as being a test and because it is the last. The last test must presumably be the greatest test whether it’s to prove a new higher level or whether it’s to advance Avrohom to a higher level (see HaEmek Davar).

                What was it about this Nisayon that made it the greatest – why does this Nisayon complete Avrohom Avinu’s Avodos Hashem?

                From a historical perspective Avrohom Avinu, completely surrounded by a world of idolatry, came to the realization on his own that there was certainly A Creator to the world, and that this Creator could not be only a Prime Mover, but had to be an Omnipotent, Omnipresent G-d.  This realization came to Avrohom Avinu using his own intellect and power of deduction.

                Avrohom Avinu’s first Nisyonos were all based on his intellect. Avrohom Avinu was willing to throw himself into a fiery furnace rather than bow to an idol as it was obvious to him that Avoda Zara was wrong. Avrohom was willing to set out to a new land in order to be able to have a fresh start in Avodas Hashem. Avrohom Avinu was able to abandon the land of Eretz Yisroel because of famine and to travel to Egypt. In all these situations, Avrohom used common sense and his own intellectual powers to understand how he was to best serve Hashem.

                Avrohom Avinu used logic and reason to preach Retzon Hashem. Chazal tell us that Avrohom preached against the practice of human sacrifice, calling it immoral, unethical, and contrary to reason. He said such acts were an abomination to Hashem.

                Hashem had told Avrohom Avinu – in this week’s Sedra – that it would be through Yitzchok that his descendents would come.  

                Yet Hashem now comes and challenges all the logic that Avrohom used to come to an understanding of Hashem, and even seemingly to contradict what He had said to him. Avrohom had already publically in the name of Hashem lashed out against the very practice he was now being asked to perform. Hashem had promised Avrohom Avinu that Yitzchok would be his heir. He now appeared to be negating and contradicting that promise.

                This test was in a class of its own. Whereas all previous Nisyonos required Avrohom Avinu to use his own intuitive intellect to decipher what it was that was Retzon Hashem, here Avrohom Avinu had to defy all logic and reason purely for the sake of his absolute recognition of Hashem and his firm belief in Him.

                This is a powerful lesson for us as well. While for the most part in life we must seek out Hashem intellectually, emotionally, and logically we must realize that ultimately it is the Divine Word, not our own instincts or logic, that defines what right reason is.

Lawyer For Billionaire’s Widow Urges Rejection Of Chabad’s $18 Million Claim

Westwood, CA – Philanthropist Roland Arnall may have talked about making a pledge to Chabad of California Inc. about donating money for an educational center, but never committed himself to it, an attorney for the late billionaire told a judge today.

John S. Gordon, who represents Arnall’s widow, said she and her husband’s estate should not be held liable for the nearty $18 million Chabad is seeking.

Chabad of California’s founder and president, Rabbi Boruch Shlomo Cunin, maintains Arnall made the pledge to him twice before he died of cancer in March 2008 at age 68.

“There was not one word ever written by Roland Arnall mentioning the project,’ Gordon told Los Angeles Superior Court Judge Mary Ann Murphy. “The only person who claims to have heard the promise … is Rabbi Cunin.’

Today was the second day of final arguments in the non-jury trial. On Wednesday, Chabad attorney Marshall B. Grossman told Murphy that Chabad spent more than $800,000 in planning costs for the project in reliance upon Roland Arnall’s pledge.

He also said the organization’s leaders would have sold the property on which the center was to be built if they knew the money was not forthcoming.

The real estate market since went sour, the attorney said.

According to Dawn Arnall, her husband never mentioned making such a pledge among the many they made as a couple to both Jewish and non-Jewish organizations. She said their largest single contribution was $10 million to the Simon Wiesenthal Center, which her husband co-founded, toward construction of a museum of tolerance in Jerusalem.

Gordon told Murphy that the Arnalls always talked with each other about their charitable donations.

“Roland had no reason to hide from Dawn any pledge he promised to Chabad,’ Gordon said. “He always discussed them with her beforehand.’

Grossman maintains that Dawn Arnall’s testimony was contradicted by e-mails she exchanged in 2006 with a personal assistant to her husband that demonstrated she was aware of the $18 million promise.

But Gordon said Dawn Arnall does not remember reading about the project in any e-mails. He also repeatedly criticized what he said were insinuations by Chabad lawyers that his client lied in her testimony, saying he had refrained from casting Cunin’s statements in the same light.

Chabad provides educational and social services under Jewish auspices.

Cunin testified Roland Arnall made verbal promises to him in 2004 and 2008 to donate at least $18 million to Chabad to build what was to be called the Arnall Family Center.

Roland Arnall made his fortune by helping to create Orange County-based Ameriquest Mortgage in 1979 and later became embroiled in problems associated with the subprime market meltdown. Grossman said the Arnalls paid $325 million to settle actions brought against the company in 49 states.

Roland Arnall was ambassador to the Netherlands under President George W. Bush from March 2006 to March 2008, leaving the post to be closer to his cancer-stricken adult son from his previous marriage, Daniel Arnall, his widow said.

Westwood-based Chabad is seeking $17.5 million, which the organization claims is the balance due on the $18 million pledge after three payments of $180,000 were previously made by Roland Arnall.

Strong Earthquake Hits Mexico

A 6.9-magnitude earthquake struck Mexico’s Gulf of California on Thursday, the U.S. Geological Survey reported.

The quake, which registered at a depth of 6.2 miles (10 kilometers), was centered between southern Baja California and the Mexican state of Sinaloa, about 65 miles from the city of Los Mochis in Sinaloa, the USGS said.

There were no immediate reports of major damage, though residents in the area were shaken up.

The fire department had not received any calls for emergencies in the immediate aftermath of the quake.

Poll: Majority Of Americans Sick Of Obama; Don’t Think He Deserves Another Term

A majority of Americans don’t think President Obama deserves to keep his job, a poll released today shows.

With less than two weeks to go before the midterm elections, a survey conducted by Gallup shows that only 39 percent of Americans think Obama deserves to be re-elected in 2012.

A staggering 54 percent think he should be a one-term president, the poll found.

Earlier this year, between 46 and 48 percent of Americans said Obama should be re-elected.

The survey also shows that Obama has averaged a job approval rating of 44.7 percent during the first seven quarters of his presidency.

Obama’s average approval rating has declined each quarter since he took office nearly two years ago — falling by more than two percentage points in the most recent quarter to establish a new low.
