DM Barak Expresses Skepticism on IAEA-Iran Agreement

Defense Minister Ehud Barak on Tuesday, expressed skepticism regarding the value of the apparent agreement between the UN International Atomic Energy Agency (IAEA) and The Islamic Republic of Iran. He spoke earlier in the day during a meeting at the Defense Ministry stating:

“It appears that the Iranians are trying to reach a ‘technical agreement’ which will create the impression of progress in the talks, in order to remove some of the pressure before the [P5+1] talks tomorrow in Baghdad; as well as to put off the intensification of sanctions. Israel believes that Iran should be sent a clear bar; so that there is no ‘window or crack’ which the Iranians can [creep] through to advance their military nuclear program.

Iran must stop enriching uranium, both to 20% and to 3.5%. In addition, all enriched uranium should be removed from Iran, under the tight protocol, called IAEA protocol 3.1.

Even if the Iranians are allowed to hold a symbolic amount – a few hundred kilograms of 3.5% enriched uranium – it needs to be under tight supervision. This will guarantee that at any given moment, the Iranians will not have enough uranium to enable the development of a military nuclear [program]. It is forbidden to make concessions to Iran. The requirements of the world powers must be clear and unequivocal.”

Ohr Yarok: Why Didn’t the Guardrail Hold Up?

The Ohr Yarok NGO, which addresses road safety issues in Eretz Yisrael, is questioning why the guardrail on the roadway in Tiveria did not hold the minivan, instead giving way and permitting the van to plummet down the ravine, flipping and bursting into flames.

Ohr Yarok officials told Israel Radio on Tuesday morning, that the fatal accident that claimed eight lives all members of one family, may be the result of numerous failures, both the vehicle and the guardrails. Ohr Yarok explains guardrails are set in place to prevent this exact scenario and the failure of the equipment to operate as it should compel an inspection of guardrails around the country to ascertain if they are defective as well.

According to preliminary information released by police investigators, the mother phoned police shouting “Hashem save us”, explaining the vehicles brakes failed and her husband was seeking phone instructions how to act. Her efforts were too late, as the police dispatcher heard the crash and the subsequent screams from the occupants as it flipped down the ravine and burst into flames. Israel Radio reported that the vehicle passed annual inspection three months ago, leading investigators to check the inspection station to determine if a proper safety inspection was performed.

Transportation Minister Yisrael Katz has ordered an investigation as to what garage inspected and certified the vehicle and when, stating if there was any foul play, the responsible parties will be held accountable.

Firefighters arrived quickly as the station is situated very close to the site of the fatal accident but there was nothing to be done regarding life-saving measures – it was simply too late R”L.

Residents of the family’s community, Moshav Bar Yochai near Kever Rashbi are broken and explain they are trying to console one another but find it difficult to find the words to adequately address the scope of the tragedy that has befallen them.

PM’s Remarks at First Session of the Plesner Committee

The first session of the Plesner Committee, responsible for introducing a new Tal Law convened on Sunday, 29 Iyar 5772. Following is a statement released by Prime Minister Binyamin Netanyahu at the session.

“Two weeks ago, we were in this room, Shaul Mofaz and I, to announce the formation of the broad national unity government. The first article in the unity agreement was to put forward an alternative to the Tal Law.  Even before that, in January of this year, even before the High Court of Justice ruling, I told the Knesset that we would put forward a better and more just alternative to the Tal Law.

Today, I am honored to open the first meeting of the committee to advance equality in sharing the burden.  Today, we will begin the discussions at the end of which we will pass a new law, a law on equality in sharing the burden.  I believe that we must be guided by four main principles.  First of all, an equal allocation of the burden.  Second, gradual implementation.  Third, it must include Jews and Arabs alike.  Fourth, we must do all of this without setting public against public.

The committee to advance equality in sharing the burden will listen to many voices and there are many voices among the people.  The committee is composed of both coalition faction representatives and outside representatives.

I would like to take this opportunity to invite representatives of all coalition factions to take part in the discussions.  In the coming weeks, committee members will meet very often in order to formulate a more just solution for Israeli society.  On behalf of us all, on behalf of the citizens of Israel, I wish you and us great success.  Time is very short and the work is great.  We must listen, discuss, propose and decide to legislate, all within a few weeks.  We are ready for the mission.”

Mitt Romney Wins Kentucky Primary

Mitt Romney won the Kentucky primary on Tuesday, accumulating more delegates toward the already presumed goal of becoming the GOP presidential nominee.

The Associated Press projected Romney’s win shortly after the polls closed at 7 p.m. ET.

Kentucky awards 45 delegates that the candidate can add to his current tally. Romney headed into the primaries on Tuesday with 992 delegates, according to the Associated Press count. He needs 1,144 delegates to lock down the GOP nomination at the convention in August. Romney is expected to cross that line next week when Texas holds its primary and awards 152 delegates.
Since Rep. Ron Paul (R-Texas) announced last week that he would no longer compete in the primaries, Romney did not face opposition in Kentucky, which Ron Paul’s son, Rand, represents in the Senate.

Romney, who has been in general election mode for more than a month, campaigned very little in the state since it was expected to be an easy victory. In 2008, Kentucky went to the Republican candidate, Sen. John McCain (Ariz.), by a 16-point margin.

The IDF Homefront Command will hold a training event at Soroka Medical Center in Beersheva on Wednesday morning. At 10:15am emergency sirens will be sounded for 20 seconds. The sirens may be heard in neighboring communities.

19:25: Dozens of residents of Tekoa in eastern Gush Etzion blocked the road to the nearby Arab community of Tuqwa in response to a recent sharp increase of rock-throwing attacks against Jewish motorists from the village.

19:44: A firebomb was hurled at an IDF position in the el-Hader area in the Gush Etzion district. No injuries reported.

** Kiryat Malachi Councilman Rav Chaim Steiner, a Chabadnik, was appointed acting mayor as the city’s mayor was compelled to step down in light of criminal charges against him for violent assaults.

Litzman Appears Determined to Oust Chief Pathologist Yehuda Hiss

In response to the recent increase in complaints and reports surrounding allegations of malfeasance against Israel’s Chief Pathologist Prof. Yehuda Hiss and the Abu Kabir Forensic Institute, Deputy Health Minister Yaakov Litzman has instructed his staff to launch an investigation into the operation, signaling in all likelihood this will mark the end of Hiss’ career.

Following the discovery of over 8,000 body parts and organs in the forensic institute, the pressure to oust Hiss has been on the rise.

Hiss has been the target of many investigations in the past, yet he has managed to survive in his senior position despite court rulings against him.

Israeli Watching Egyptian Elections with Concern

Officials in Israel are monitoring the upcoming Egyptian elections with concern as it appears the days of the moderate government of President Hosni Mubarak are gone forever. The elections are set to take place on Wednesday. The Islamic Brotherhood is expected to earn a significant place in the new government, news that is most unwelcome from Israel’s perspective.

There have been mixed messages released from Cairo, but officials are signaling that regardless of the makeup of the new government, the peace agreements signed between the countries will be honored, a welcome statement but the Foreign Ministry is nonetheless unconvinced at this point due to the instability in that country today.

Veteran cabinet ministers and senior IDF commanders are warning that Israel must be extremely vigilant regarding unfolding events in Sinai, with the latter steadily becoming a launching pad for anti-Israel terror.

Obama Raises $1 Billion

President Obama is the billion dollar man.

Obama has become the first politician to top that lofty mark of donations collected during his career.

His lifetime total hit $1,017,892,305 in April, nine years after he began his 2004 race for Senate, according to an analysis by the Center for Responsive Politics.

And Obama is hardly done: most observers expect him to raise at least another $300 million by Election Day.

The President has raised more than $217 million so far for this campaign, while his November opponent Mitt Romney has hauled in just under $100 million, the Center found.

However, the playing field becomes far more level when independent political action committees are included – conservative groups are expected to far outraise left-leaning organizations.

Both candidates’ parties have also poured cash into the race, which is expected to be – by far – the most expensive in history.

To help fund his re-election bid, Obama has turned to a series of big-names to join him at fundraising events – and the latest is Bill Clinton.

The Obama campaign announced Tuesday that the current and former President will co-host an event in New York next month.

“When Bill Clinton ran for president in 1992, I had just started a job registering voters in Chicago,” Obama wrote in an email to supporters.

“I remember watching his campaign and thinking, ‘Wow, I’ve never seen a candidate like him,’” Obama continued. “I ran for President because we lost our way as a country after President Clinton left the White House.”

Details of the event, scheduled for June 4, were not immediately released.

CRC Kashrus Alerts (Shavuos 5772 / 2012)

Please be advised that TRADER JOE’S CHOCOLATE CHIPS are no longer certified Pareve. They are certified dairy (non-cholov Yisroel) when bearing the OK-D on the label.

The Chicago Rabbinical Council is pleased to announce that Kotel Kosher, located in the French Market, 131 North Clinton, Chicago, Illinois, is now under the certification of the cRc. All sealed foods and beverages sold are approved by the cRc.

Coke is introducing a low calorie version of Fanta and Sprite as “Fanta Select” and “Sprite Select”. Both are kosher pareve. The cRc website has been updated http://www.crcweb.org/beverage_list.php

During the last several months there have been several new ice cream and frozen yogurt stores opening around Chicago and the country. Some are stand alone stores while others are located in malls. Many of these locations profess to sell kosher products under the certification of the cRc or other reliable agencies, and even have signs posted to indicate such. Unfortunately, while they may sell certain products that are kosher certified in their original factory sealed containers, most of the actual stores are not certified kosher. These letters only apply to the un-opened ice cream and yogurt that is listed on the letter of certification, and not necessarily to the store itself. Merely asking the store attendant if an item is kosher is not sufficient, as they may not be aware of specific requirements that may affect the kosher status of an item. One should see the actual product in its original container and be able to ascertain that the product in the container or soft serve machine is the same that you see in the original factory box and not a “token kosher box”.

In some cases, the scoop must be first washed clean. Any other products purchased, such as cones, toppings, or any other additives must also be inspected to determine if they are kosher. Items such as cakes and novelty items may be coming in from another outside source, so special care must be taken when purchasing any of these items. Since one may not assume that there were no changes made since the last visit, this all must be done each time you go into the store to make a purchase!

As the average person may also not always be aware of all of the kosher regulations, it is always preferable and recommended to only frequent shops under a reliable kosher supervision. Check with the cRc in the Chicago area, or your local Orthodox Vaad in other areas for the stores under kosher certification.

Effective 5/15/12 Rosa’s Pizza at 350 Fifth Ave, New York, NY 10011 is no longer certified OU kosher.

OU certified Fred’s Taco Seasoning Mix, Fred’s Inc., Memphis TN is missing “D” Dairy designation.

OU certified Sweet Perry Orchards Cashew Medley Fruit and Nuts Mix, Go Picnic, Chicago IL is missing the “D” Dairy designation.

Please be advised that some packages of Hot Cajun Mix, Oriental Nut Mix, Antioxidant Mix sold by Gourmet Nut, Brooklyn, NY, were mistakenly labeled with the OK (pareve) symbol, instead of OK-D.

Joy Cone brand Ice Cream Cones Fun Pack, sold in Costco Stores, containing 5 individual varieties of cones, among which is a chocolate coated dairy cone, is bearing only the Star-K pareve symbol on the outside box. The Star-D Dairy symbol pertaining to the chocolate coated cones was inadvertently left off the box.  The individual inside box is labeled correctly.

Uncle Ben’s Whole Grain and Wild Rice: Mushroom Recipe bears an unauthorized OU and is not certified as kosher by the Orthodox Union.

Please be advised that all Saratoga Chips For Goodness Shakes Seasonings distributed by Saratoga Specialties Company (Saratoga Springs, NY) bears an unauthorized OK symbol on the label.

Due to supply chain issues some Tree Ripe Orange Juice, Johanna Foods have been produced in a non-certified facility. The containers do not bear the OU symbol. As always, consumers should check the containers for the OU symbol before purchasing.

At the present time, most varieties of Oreo Cookies contain dairy ingredients, with two notable exceptions. Original Oreo Sandwich Cookie and Oreo Double Stuf Sandwich Cookie do not contain dairy ingredients, though they are manufactured on dairy equipment. The equipment is not necessarily cleaned before the production of the Oreo Original and Double Stuff Sandwich Cookies, and there may be a small amount of dairy residue present in these cookies. Nonetheless, the dairy component would be minimal, and from a Halachic perspective, the dairy residue is nullified (botel bishishim) and of no consequence. Therefore, Oreo Original and Double Stuf Sandwich Cookies may be consumed after meat and poultry, but not simultaneously. Please bear in mind that the manufacturer may choose in the future to reformulate these products and add dairy ingredients. Since these products already bear OUD symbols, formulation changes would not be reflected in the OUD logo. As such, consumers should check regularly with the OU to confirm the status of these items.

My Choice Frozen Yogurt and Juice Store, located at 845 7th Avenue, New York, NY, printed brochures that display the OU symbol. This store is not certified by the Orthodox Union.

OU certified Christie Triscuit Low Sodium Roasted Garlic, Christie Brown, a Division of Kraft Canada, is missing the Dairy designation.

Coupons for the Cold Rush Frozen Yogurt store in the Richfield Shopping Center in Clifton N.J. bear an unauthorized OU symbol. These coupons were distributed in the Passaic-Clifton area. The Orthodox Union does not certify Cold Rush and has no information about the kosher status of that store.

Please be aware that Shmitta wines from 2008 are being sold in the US. These wines have kedushas shviis and must be treated accordingly; none of the wine can be discarded. Consumers are urged to carefully check the label. If you have purchased these wines, ask your Rav how to handle these products.

Please be advised that Milk Chocolate Fondue, 200 grams sold by Loblaw Brands Limited, Ontario, Canada bears an unauthorized OK (pareve) symbol. These products are NOT certified by OK Kosher Certification.

Endomune Advanced Probiotic Capsules, Medical Care Innovations - San Antonio, TX, bears an unauthorized OU symbol. This product is not certified by the Orthodox Union.

Mon Cuisine frozen meals, Alle Processing: When warming Mon Cuisine frozen meals in a microwave, consumers should double wrap the carton. Mon Cuisine is changing its packaging to alleviate this issue by overwrapping the carton.

OU certified Blue Bird Perfect Guacamole Seasoning Mix is missing the “D” dairy designation. The ingredient panel clearly states that it contains dairy. Some packaging only has the plain OU without the “D”.

Please be advised that products distributed by G & S Bakery (may be under the name G&S or G&D) bear an unauthorized VHQ (Vaad of Queens). Corrective measures are being taken.

Please be advised that some packages of First Street 94% Fat Free Microwave Popcorn and First Street Extra Butter Microwave Popcorn were mistakenly labeled with the OK (pareve) symbol, instead of OK-D.

Ben-David Winery, based in Moshav Sdei Eliezer, was found to be using the “OK” symbol on bottles of Merlot 2008 (a dry red wine) without authorization. The label states “OK-P” (Kosher for Passover), but, in actuality, the wine has a regular non-mehadrin supervision and is the product of heter mechira grapes.

Some 2 oz. of Dirty Potato Chips Sour Cream and Onion Potato Chips were mistakenly labeled with a plain OU mark, without the D-Dairy designation. Corrective measures are being implemented.

CHUNKS O FRUTI brand Strawberry Dipped in Chocolate fruit bars with a French/English label bears an unauthorized Star-K. The coating is made on dairy equipment and should bear the Star-D Dairy symbol.

Please be aware that a number of chocolate products sold in Mexico under the brand D’Meals bear an unauthorized cRc logo. These products are not certified kosher by the cRc and are being withdrawn.

Any Double Bubble gum that is made by Concord Confectionery in Canada is certified by the OU even without the OU on the label.

Please be aware that the following flavors of Scara’s Creamy Ices (Sherbet) cups bear a cRc label which have omitted the “dairy D” designation. The products do indeed contain dairy ingredients (Cholov Stam): Coconut and Pina Colada.The following flavors of Scara’s Italian Ices cups are made on dairy equipment but the “DE” designation was omitted: Blueberry, Cherry, Lemon, and Sour Apple. No other varieties of Scara’s Ice cups, bulk products or liquid bases are certified by the cRc at this time. The cRc does not certify any of the Scara’s carts, stands or stores.

Please be advised that the OK has revoked certification of Rimon Winery (Keren Ben-Zimra, Israel) manufacturer of Pomegranate Wine due to kashrus violations.

Please be aware that the following brands of fresh salads such as Potato Salad, Cole Slaw and Macaroni Salad are no longer under the certification of the cRc: Orval Kent, Sysco, US Foodservice, Walmart, Sam’s Club. As always, buyers should be diligent when making any food purchases and should look at each label for a kosher certification. Any remaining products still bearing the cRc logo are kosher certified.

Some 10oz bags of Pink Snack BBQ Potato Chips were labeled with a plain OU rather than an OU-D. It contains lactose (a dairy ingredient) but the “D” was inadvertently left off.

Tabatchnick Soup Singles New York Style Chicken Broth With Noodles and Vegetables was inadvertently labeled as pareve but the product is in fact certified as KOF-K MEAT. Labeling is being corrected.

The Smirnoff Triple Distilled Vodka 100 Proof with the blue label on it, 200ml and 375ml bottles has been mislabeled as KSA Dairy. This product is in fact KSA Pareve.

Tierra Fresco Queen Olives (from Spain), Small World Foods, Shelton CT bear an unauthorized OU. This product was sold in a ‘closeout’ store in the Midwest. Corrective measures are being implemented.

Jason bread crumbs are now Pas Yisroel which is listed on the label. If the old label says distributed by “The Manischewitz Co.” or if they say “RAB Foodgroup” they were also Pas Yisroel. However, if the label says “Distributed by R.F.D. Newark NJ” they were not Pas Yisroel.

AGRO SUN brand dried fruits and nuts products, sold in the New York/New Jersey area, bear an unauthorized Star-K. These products are not certified by Star-K. Corrective measures are being taken.

STARBUCKS HOT COCOA MIX – TOASTED MARSHMALLOW is Kof-K – D certified, as indicated on the label, and contains Kosher gelatin.

New MULTI GRAIN CHEERIOS PEANUT BUTTER CEREAL mistakenly does not bear a Kosher symbol, but is nonetheless certified OU-D (dairy equipment).

Wei Chuan Sesame Chili Oil, Bell Gardens, CA bears an unauthorized OU symbol. The Orthodox Union does not certify this product. Corrective measures are being implemented.

Some packages of Maui Onion Potato Chips, Dirty Potato Chips, Gramercy, LA were mistakenly labeled with a plain OU mark, without the D-Dairy designation. This product contains dairy and should be OU-D.

Updated Star-K Brochos For Breakfast Cereal List: Check out the Star-K Winter 2012 Edition of Kashrus Kurrents, which contains an expanded cereal list. Note the following updates on brochos and/or Pareve/Dairy status that differ from previous lists: 1) Thebrocho on the following General Mills products is Shehakol: Corn Chex, Honey Nut Chex, and Post Honeycomb. 2) The brocho on the following Kellogg’s product is Mezonos/Borai Nefashos & Dairy: Special-K (original). 3) The following products are Dairy:Kellogg’s Bran Buds and Cinnabon Crunchy Cinnamon Cereal. 4)The following products are Pareve: Post Alpha Bits, Golden Crisp, Honeycomb, and Kellogg’s Corn Flakes. 5) The following products are made on Dairy Equipment: Quaker Crunchy Corn Bran and Oatmeal Squares.

Shatnez Updates

Linen threads are used on occasion in the seams of sweaters. The linen threads are sometimes easily removed and the sweater is then non shatnez.A 100% Lambs Wool Polo by Ralph Lauren lady’s sweater (Hong Kong) was found to contain a red linen thread in its seam.

A Zara Kids (China) vest was tested at the Lakewood Shatnez laboratory. The content label listed: Outer shell: 63% Polyester, 30% Wool, 5% Rayon, 2% Acrylic, Lining: 100% Cotton.

This women’s jacket, Linda Allard for Ellen Tracy, was examined by the Houston Shatnez laboratory. The law does not compel labeling to list all threads in the garment.

Shatnez in the actual fabric of scarves in uncommon. However, when a scarf is made of more complex woven fabric, it could have shatnez. The Boro Park Shatnez Laboratory examined a plaid scarf. It had no labels attached to it. The fabric was composed of heavily recycled yarns. R’ Sasson Gelb found both wool and linen in the fabric.

Shatnez was found in a Baggio men’s suit – the collar stiffener was linen.

Escada Dress is a wool dress that was found to be full of shatnez.

Banana Republic skirt with shatnez in the fabric was recently found at the Lakewood Shatnez Laboratory.

The skirt was made in Thailand and the contents label listed 96% Wool, 3% Spandex and 1% Other Fiber.

Most suit manufacturer produce a line of suits and sell them under various brand names. A particular suit manufacturer is selling suits under a number of names, including Eventi, Luciano Bardelli, Joseph Bach and Mattarozi Uomo. A number of suit stores claim that they are the sole importer or manufacturer of these suits and have guaranteed that their suits contain no shatnez. Most suits of these brands were free of shatnez. However, the Flatbush Shatnez Laboratory reported that shatnez was found in an Eventi suit. The Lakewood Shatnez Laboratory also reported that shatnez was found in a Luciano Bardelli suit.

Linen sweaters can have wool threads in their joints or may be sewn with a wool yarn.

The Kico Kids 100% linen sweater had shatnez. A wool-blend yarn was used to sew all of its seams. It was made in China and its contents label listed – Shell: 100% Linen, Ribbon: 100% Cotton. The sweater was sold in two colors: green and tan.

Israel Updates

Cans of the Dr. Pepper soft drink from England are being represented as kosher under the supervision of KLBD. KLBD reports this is not so. The kashrus claim is bogus. The soda was also not approved by the Chief Rabbinate and a recall has been issued.

Mounds, manufactured by Hershey, Pennsylvania, USA, barcode 03403108 is being represented as kosher parve with a hechsher from the OU and Chief Rabbinate approval. This refers to bars distributed by Premium Amos Shivuk. The product contains milk, and is therefore dairy and chalav akum.

The Israeli Chief Rabbinate is enforcing their policy of not allowing cholov stam products to be sold as kosher on Haagen-Dazs ice cream. Some of the Haagen-Dazs Ice Cream is made from liquid cholov stam and certified as kosher by the OU.

The Badatz Eida Chareidis has found some saccharin manufactured abroad that are marked pareve but the ingredients lists “lactose” which makes it dairy. The product (tablets, liquid and powder forms) contains components that are not cooked. Therefore one should you aklei shlishis when using the sweetener on Shabbos. The Badatz has made a special run and the saccharin under our hashgacha is totally cooked and therefore one does not have this problem on Shabbos. On containers included in this special run it will state the ingredients are all cooked alongside the Badatz logo. It says עבר בישול מלא.

Regarding coated nuts known as “kabukim” – the bracha is barei minai mezonot. However, the nut is not included in the measure towards a ‘shiur’ and regarding the after bracha, it depends if one ate a shiur of the coating in the time period known as ‘b’chdei acilas pras’, for if not, the after bracha is borei nefashot.

Chupah Doesn’t Prevent Outpost Eviction

When border police arrived in Ramat HaMigron on Monday evening, they were simply concerned with following orders and the fact that a chupah was about to take place did nothing to deter them from their mission, not even to postpone it for a limited time period to permit the wedding to take place.

Several tens of guests were on hand for a chupah but as soon as security forces arrived they declared the outpost a ‘closed military zone’, compelling all of them to leave. The guests were ordered to leave and the chupah was dismantled. Five people were arrested and a number of others detained.

This particular outpost has been the scene of a cat and mouse game, and after it is evacuated, the determined residents simply return and continue building, determined to create a permanent presence at the site.

The following report was released to the media from Honenu:

Today an indictment was filed against two youths from the Ramat Migron outpost charged with assaulting a policeman. The two were arrested just before Shabbat last week after, according to the policemen; they refuse to leave the outpost despite a closed military zone order effective on the site. According to the police they violently resisted their removal from the site.

Just before Shabbat last week large forces of border police raided Ramat Migron, only hours after they had destroyed the home of one of the residents due to get married today (Monday). The policemen demanded that the youths leave the site due to the closed military zone order even though Shabbat had almost begun and they would not be able to reach their parents’ homes before Shabbat.

The youths also claimed that according to the two recent rulings by the Jerusalem Magistrate Court and the Jerusalem District Court stating that Jews are permitted to be residents of the outpost the policemen do not have authorization to remove them from the site being as they are permanent residents of the outpost.

The three arrested youths were taken by force to the detention center at the Russian Compound on Shabbat, despite their opposition to violating Shabbat. The parents of one of the arrestees, a minor 15 years of age, said that only after Shabbat did they learn of their son’s arrest, when the father noticed that on Friday night at 20:03, after Shabbat had begun, he had received a voice message from the police informing him of the arrest. The arrestees were brought to the Jerusalem Magistrate Court on Saturday night after Shabbat at the demand of the police to extend the remand of two of them following the statement of prosecution on filing an indictment against them on charges of assaulting a policeman. The police are demanding that the third arrestee, a minor, be released on condition of a restraining order banning him from the site for half a year and placing a bond.

Despite the refusal of the arrestees to be interrogated on Shabbat, in order to prevent Shabbat violation, the police announced that they would file an indictment against them, even though no interrogation had been carried out. Despite Honenu attorney Adi Kedar’s plea that it is illogical that the police will formally announce their intention to issue an indictment without interrogating the suspects first, Judge Mac-Kalmanovitch extended the remand of the first two youths. The third youth, the minor, was released on condition of a restraining order banning him from Ramat Migron and placing a bond.

Honenu attorney Adi Kedar said in response that, “I regard with severity the fact that the police conducted an investigation for appearance’s sake only, even though they knew that the arrestees would not cooperate during interrogation, and on that basis filed an indictment. I am even more surprised that when the court was offered a viewing of a short video that would refute the claim by the police and due to the lateness of the hour (1:30 AM) refused. I am sure that later on this piece of evidence will be a significant and determining factor in the case.”

As stated above, today an indictment was filed against two of the arrestees on the charge of assaulting a policeman. In accordance with the police the two were released to house arrest until Wednesday, when a deliberation will take place concerning the evidence that the police has on the case. In today’s deliberation Honenu attorney David HaLevi will represent the arrestees.

Honenu responds that, “After the court greatly diminished the ability of the police to use closed military zone orders, the police found illegitimate means to circumvent the court’s decisions.”

Minister Atias Promises an Additional 400 Housing Units in Betar Illit

Housing Minister (Shas) Ariel Atias was on hand to inaugurate a new street in Betar Illit, Rav Shach Street, accompanied by senior officials in his office. The visit, which took place on Monday, was to assess the situation regarding the street and the area topography, and to determine if a ramp is needed between the new street and Kedushas Levi Street above.

The experts are opposed to the ramp, simply because it is too costly, 2 million NIS and that it is an area designated for public development, a park and schools. Whatever the case will be, the minister himself must make such a decision, thereby compelling the visit to permit Atias to get a firsthand look at the area and consult with his team of experts on location.

During the visit Atias delivered a pleasant surprise, telling Mayor Meir Rubinstein that an additional 400 housing units are planned in addition to 300 units that have already been approved.

Cuomo Gives OK To September 13 Primary

Governor Andrew Cuomo has signed off on legislation moving the primaries for state and local elections to avoid having them fall on the anniversary of the September 11th attacks. The primaries had been scheduled for Tuesday, September 11 but the legislature pushed the elections back two days to September 13.

Lawmakers say the move allows for a day of reflection and unity and honors those who died during the attacks.

A similar measure was passed back in 2007, ahead of the sixth anniversary.

Facebook Shares Plunge Again at Open

The selloff in Facebook shares deepened on Tuesday, as investors continued to question the stock’s valuation after Reuters reported that underwriters cut their revenue forecasts for the company before the IPO.

Facebook’s shares hit a low of $30.98 on Tuesday, 8.9 percent below Monday’s close, and a loss of 18 percent from their $38 IPO price.

At the low, the stock had lost 30 percent from an intraday high of $45 hit shortly after trading started on Friday.

More than 28 million shares had traded in early action on Tuesday, making it one of the most actively traded in U.S. markets. Facebook’s revenue growth has been slowing in recent quarters, raising flags among some who believe the company should show consistently strong revenue growth at this stage in its life.

The company surprised investors after disclosing, just days before the initial public offering, that its revenue may be hit by more users transitioning to mobile platforms, where advertising is less proven.

New Rav Appointed for Air Force Shachar Program

Rav Shimshon Klein has been appointed as the new rav of the air force’s Shachar program, replacing Rav Moshe Ravaad who stepped down shortly before completing his term in office.  The rav will be raised to the rank of major. Rabbi Klein is a son-in-law to Chief Rabbi Yonah Metzger.

Chareidi rabbonim commenting on the appointment question why a graduate of a hesder program is appointed as the mora d’asra of a program that is tailor made for chareidim, explaining while the rav is known as a person of integrity and potential, it simply does not make sense to appoint a dati leumi rav to oversee the needs and daily lives of a chareidi tzibur.

IDF officials are critical because the announcement speaks of the ‘haktara’ of the rav in a ceremony, explaining “in the IDF we do not have a ‘haktara’ but we have ‘appointments’.

US Airways Flight 787 Diverted Over ‘Suspicious’ Behavior

A US Airways flight from Paris’ Charles de Gaulle airport to Charlotte Douglas International was diverted today over a passenger’s “suspicious” behavior.

The flight was diverted to Bangor, Maine, according to an airline spokesman, and was met by authorities upon landing. “The TSA is aware of reports that a passenger exhibited suspicious behavior” on the flight, the spokesman said. The flight landed without incident and appears to still be in Bangor.

Airline spokesman Andrew Christie told the Associated Press that the Boeing 767 has 179 passengers and nine crew members on board and was diverted around noon to Bangor.

Leading Figure in Yemenite Jewish Community R”L Killed In Stabbing Attack

A leading figure in the Yemenite Jewish community, Rabbi Aaron Yosef Zandani HY”D, 50, was fatally stabbed in a Sana’a shuk by a Muslim man who accused the rav of witchcraft.

The rav’s son, Yechi reports his father was stabbed in his neck and abdomen. He was rushed to a local hospital but was R”L Niftar from his massive injuries.

The attacker was apparently taken into custody.

Colin Powell Pauses On Endorsing Obama

Former Secretary of State Colin Powell said Tuesday that he’s not ready to endorse President Barack Obama’s reelection, as he’s also considering Mitt Romney, a “good man” he’s known for years.

“I don’t want to throw my weight behind somebody,” Powell, who endorsed Obama in 2008, said on NBC’s “Today Show.” “I feel as I private citizen I ought to listen to what the president says and what the president’s been doing. But I also have to listen to what the other fellow says. I’ve known Mitt Romney for many years, good man.”

Powell said he “owe[s]” the Republican Party some consideration.

The former Bush administration official said that Obama had some substantial accomplishments, but that he wished the president had closed Guantanamo as promised.

“I think he has been [transformational]. Not completely. There are some things that he has done I wish he had not done, for example, leave Guantanamo open. I would have closed that rapidly. He tried, he was stopped by Congress,” said Powell. “He stabilized the financial system he brought about stability in the economy. He fixed the auto industry.”

Despite these achievements, however, the former chairman of the Joint Chiefs of Staff still declined to endorse the president.

“It’s not just a matter of whether you support Obama or Romney, it’s who they have coming in with them,” Powell said.

As for Afghanistan, Powell said upon reflection that “it was worth the sacrifice to give the Afghan people a chance at free government” but that “we have to draw the line at some point,” pointing towards the full withdrawal of American and NATO forces in 2014.

The retired four-star general was on NBC promoting his new book, “It Worked For Me: In Life and Leadership.”

Rav Yitzchak Dovid Grossman: The Accident Victims Were A Kapora for Am Yisrael

When Rav Yitzchak Dovid Grossman speaks, Yidden generally listen, for this tzaddik has a powerful ability to convey a message that emanates from the depth of his holy being.

Today, Tuesday, 1 Sivan 5772, shortly after the censor permitted announcing the names of the Atias family Z”L killed in the tragic accident, Rav Grossman took to the airwaves and told the story behind the tragedy.

It appears that the father of Rabbi Rafael Atias, Rabbi Shimon Atias, is a longtime resident of Migdal HaEmek and prominent mechanech, in the very same city where Rav Grossman is mora d’asra. The rav and Rav Shimon have been very close over the years and Rav Grossman explains that in his free time, “every spare moment”, Rav Shimon would work on writing his Sefer Torah towards fulfilling his dream of opening a shul. He actually completed the project, as well as his fundraising and saving all the money he could over the years towards actualizing this dream, and on Monday, 29 Iyar 5772 this dream was actualized with the opening of the new Mishkan Shimon Shul in Migdal HaEmek.

Rav Grossman took part in the “outstanding simcha” along with the family, Rav Rafael Atias, his rebitzen, and all the children z”l, but that is not all. Rav Grossman explains he saw them there early in the morning, working, cleaning, moving seforim to the designated spot and so forth. They put the final touch on the beis knesses.

“They were simply busy for hours, working a labor of love. They did not stop for a moment” explained Rav Grossman. Then came the dedication, the music and the guests, and Rav Grossman explained the event was truly a simcha for the entire community.

After the Atias family left they traveled to the tziyun of the She’lah HaKadosh, and the rest of the story made the news R”L.

Rabbi Grossman added “I am not a navi and dare not attempt to understand HKBH’s cheshbonos, but I know that this family was a kapora for Am Yisrael and we mustn’t say ‘oh another tragic accident, another tragedy’ but we must contemplate the magnitude of the event, the loss, the pain, and each of us must find ways to enhance our avodas Hashem and our actions”.

The rav detailed the acts of chessed of the niftar, Rav Rafael, who was a pillar of his community, Moshav Bar-Yochai, and deeply involved in assisting area tzedaka efforts. He was also the principal of a yeshiva in Tzfat “for children that are not easy to handle” Rav Grossman explained.

Rachel spent a good part of her day with her father, unwilling to distance herself from him during the shul dedication. When she began returning to herself earlier Wednesday morning in the hospital, Rachel told people around her “Ima and we were saying Tehillim in the car before it turned over”. Little Rachel was not wearing her seatbelt, and this apparently saved her life as she was thrown clear of the inferno.

The levayas of the Atias family will take place at 19:00 in Tzfat.

Man Survives Plunge Over Niagra Falls

A man plunged at least 180 feet over Niagara Falls and survived — only the third person known to have gone over without a safety device and live.

Niagara Parks Police say witnesses reported seeing the man climb over a railing at 10:20 a.m. Monday and “deliberately jump” into the Niagara River 20 to 30 feet above the Horseshoe Falls. He surfaced in the lower Niagara River basin near the Journey Behind the Falls observation platform.

Horseshoe Falls, on the Canadian side of the river, is the tallest of the three main falls, higher than the American Falls and Bridal Veil Falls.

The man, believed to be in his early 40s, was rescued about two hours after he collapsed in waist-deep water near the rocky shore. A waiting helicopter flew him to a hospital for treatment of what police said were life-threatening injuries. Police did not identify him.

Since 1901, when Annie Edison Taylor was the first person known to go over the falls and live, 17 others have replicated the feat, most by using safety devices like Taylor’s oak barrel or the foamed-lined pickle barrel and inner tube contraption Steve Trotter used to go over in 1985.

The last person to go over the Falls unaided and survive was a 30-year-old Canadian man in March 2009.

In October 2003, Kirk Jones, an out-of-work auto parts salesman from Michigan survived his plunge over the falls and, in 1960, 7-year-old Roger Woodward was swept over the falls wearing a life jacket and survived.
