The President is the Chief Executive Officer in the Federal government and has the power to forgive and commute their sentence of anyone who has committed federal crimes. He does not have to get permission from anyone.
The only exception is an impeachable offence, That is the president can’t stop impeachment but once the individual is impeached and removed from office, the President can reappoint him assuming the Senate’s approves it.
