I was just thinking about this the other day. My father died when I was six. Normally, he would have been allowed to sell me into slavery until I turned 12. So from 6-12, who had that power? Did anyone have that power?
July 17, 2009 3:08 pm at 3:08 pm #650567SJSinNYCMemberFeivel, I have no brothers.
And yes, I realize Jewish slavery was nothing like other slavery. I’m just curious. Was I a free agent at 6?
July 17, 2009 3:11 pm at 3:11 pm #650568cherrybimParticipant“you understand of course that the “slavery” of a young Jewish girl is NOTHING like what we usually think of as slavery.”
NOTHING, except that your master or his son can marry you.

i was thinking of Kiddushin not slavery
July 17, 2009 3:28 pm at 3:28 pm #650570gavra_at_workParticipantI’m almost sure no one can sell a daughter except the father (Ein Adam Morish Zechus’e B’ito Le’bno), but the Mother & Brothers have the right to marry a girl under 12 off. She has the right at the age 12 to “undo” the marriage.

Hmm… how does Jewish custody work? Is it done through Beis Din or just whoever decides to look after a child if both parents are out of commission?
July 17, 2009 4:43 pm at 4:43 pm #650572rabbiofberlinParticipantFor your information, “mide-oraisa’ (biblically speaking) only the father can give his daughter away in marriage (and sell her – but that is aslo a way to marriage-see mishpotim). The chachomim allowed a mother and brothers to marry her of but she has the right- at maturity- to reject these kiddushim. it is called “mi-un”. gavra-at-work is fulyl correct in his posting.

July 17, 2009 5:09 pm at 5:09 pm #650574postsemgirlMemberMy father always used to tell me for a joke that I better behave or he could sell me.

3) Ama Ivriah is not practiced today.
July 17, 2009 6:22 pm at 6:22 pm #650576SJSinNYCMemberGAW, halachically. Nowadays, I don’t know anyone who does custody through a beis din.
July 17, 2009 7:47 pm at 7:47 pm #650577gavra_at_workParticipantThere is no “custody”, the children fend for themselves. BD or the father can appoint someone over the estate (as ICOT points out), but the children are “free” to collect (as per the Mishna in BB 139b) if they have no Yerusha.
July 17, 2009 7:55 pm at 7:55 pm #650578bein_hasdorimParticipantSJSinNYC: I feel for you having to grow up without a father.
May HB”H our father, take care of all of us, especially the yesoimim,
showing them extra love & joy, & may they be united with their loved ones
speedily with the Geulah Shleima!
