NY State Tea Party Organizer Sues FBI, IRS


zherThe owner of a weekly Westchester County newspaper has filed a lawsuit claiming he was targeted by the IRS for his Tea Party activities.

Sam Zherka is suing the IRS and the FBI for $20 million. He says he’s under scrutiny in a tax investigation only because of his political activities from 2009-2010.

He tells the New York Post that back then he “was the loudest voice in the state of New York for the Tea Party movement.”

Zherka owns the free weekly Westchester Guardian. He says he promoted the Tea Party in his newspaper and organized numerous rallies and petition-writing campaigns in his efforts to form an upstate-based Tea Party group.

He has sued political opponents and a dozen Westchester communities in the past.

  1. Does he have damages? What legal theory is he arguing (constitutional tort based on breach of first amendment, malicious prosecution, etc.)? Why isn’t he asking for an injunction? OR is he trying to get to pre-trial discovery so he can go on a fishing expedition in what probably are very waters filled with very interesting fish.

    Sounds to me that this guy is a gold digger trouble maker! Stay away!
