A number of Jews were arrested by police on erev Pesach as they tried to visit Har Habayis to shecht a Korban Pesach. Among the participants in the group were Noam Federman and attorney Baruch Ben-Yosef, both long-time Har Habayis activists who continue struggling for Jewish rights in line with Halacha on Har Habayis.

Police were present in large numbers to prevent any “acts of provocation” as police officials put it, and they quickly arrested the handful of Jews and brought the incident to an end.

The detainees were released before yomtov began.

It must be noted that according to the Poskei Hador one is absolutely forbidden to visit the Har Habayis, and there is an Issur Kares for one that goes there.

Five years ago on Sukkos, President Shimon Peres paid a visit to the Sukka of Maran HaGaon Rav Elyashiv ZATZAL, where Rav Elyashiv called on the President to prevent Jews from visiting Har Habayis, stating it is an act that that is viewed as extremely provocative by the goyim. Maran stated everything possible must be done to avoid a religious war, and the provocateurs are playing with fire.

Maran is quoted as explaining to the president that Halacha forbids going onto Har Habayis but today, it is more than this, it is an act that may lead to a religious war and bloodshed.

  1. It should be noted that based on a tshuvas chasam sofer in response to his father in law rabbi akiva eiger, that one could bring a korban pesach in har habayis. The only issues being tumah, kohanim meyuchasim and not knowing the proper stones to the choshen. The chasam sofer answers all those issues.

  2. Even though the bottom line is mutar – BUT since there are ramifications to this act you need to ask your local rabbi how and when and if it is permissible. BUT on the basic halacha level it is OK

  3. While attempting to bring a Korban Pesach makes no sense, it also makes no sense for Israel to continue to allow Muslims to control Har Habayis (major mistake by Dayan, btw). Assume one day they decided they don’t want Jews at the Kosel either (which is not far from a possibility). Should we give them free reign in order to prevent provocation??

  4. There will be a time when we might want to assert greater control over the har habayis but with all the other treasts now facing EY, now is not that time. I’m sure Yanky55 and all the other hawks want to have their sons and daughters on the front lines of the security forces when the rioting and bloodshed starts.

  5. #6. Why don’t you investigate the issues yourself? I would post links but I don’t think it would be allowed to be posted. Perhaps a moderator can comment and say if yes or no.
Don’t you see the historical realities that we were exiled and FORCED to not go up and many times not even to go to Jerusalem at all.
