Jury Rejects Musk Lawsuit Against OpenAI, Sam Altman, and Microsoft

A jury tossed Elon Musk’s lawsuit against OpenAI CEO Sam Altman, ruling Musk waited too long to bring the case.

Jurors found Altman, OpenAI co-founder Greg Brockman, and OpenAI not liable on all claims after a three-week trial. The jury also rejected Musk’s claim that Microsoft aided and abetted Altman and Brockman in allegedly breaching duties tied to OpenAI.

Musk sued in 2024, arguing OpenAI’s shift toward a for-profit model violated its original mission. During testimony, Musk said he finally reached his breaking point after Microsoft invested $10 billion into OpenAI’s for-profit arm.
