Police Ordered to Compensate Ben-Givir, Federman & Marzel Again

Once again right-wing activists Itamar Ben-Givir, Noam Federman and Baruch Marzel emerged from court with a victory in hand. This latest case addresses an arrest involving them along with three other activists in 2008.

After the murderous attack in Jerusalem’s Merkaz HaRav Yeshiva, Marzel and his colleagues learned from the media that the family of the terrorist responsible lives in Jabil Mukhaber in the capital and that a Hamas flag was hanging outside the home. They activists traveled to the area to take down the terrorist flag from the family mourning tent. Police were on hand, waiting for them at the Armon HaNatziv promenade, detaining them for questioning and then jailing them overnight in the Russian Compound Detention Center.

They were unconditionally released the following morning. They decided to file suit against police for wrongful arrest, violating their basic rights and unacceptable conditions in the detention cell. The court awarded them 62,500 NIS and ordered police to make the payment.

It marks the 13th victory for attorney Ben-Givir in 14th suits he filed against police. Justice Irit Cohen of the Jerusalem court ruled in favor of the plaintiffs, expressing harsh words against police for their inappropriate actions and placing detainees in an unacceptable detention cell.

Marzel said that he hopes one day police will learn that not only the left-wing has a right to protest in Israel, but the right-wing shares that same right.

On Thursday evening March 6, 2008, a terrorist entered Yeshivat Merkaz HaRav in the Kiryat Moshe neighborhood of the capital, opening fire indiscriminately. He murdered eight talmidim.

  1. Has an apology been given? When Israeli and/or Jewish pride is slighted by a cartoon, they are quick to condemn and act.

Shameful what happened here, repeatedly to these true Jewish Zionists.

  2. While everyone is responsible for their actions and the excuse of “just following orders” has long be ruled as no excuse for illegal actions, the Police in Israel do what the Government tells them to do. The brutality and persecution by the Police of nationalist is not a Police decision but a decision of the Prime Minister, the Betrayer of Hevron. It is a premeditated and planned assault against Jewish patriots in order to benefit our Arab enemies.
