Honenu Scores a Short-Lived Victory in the High Court Regarding a Detainee in Duma Arson Investigation


dumaHonenu attorneys on Sunday, 8 Teves, scored a victory in a petition filed on behalf of one of the Duma arson detainees, a minor. Honenu during a press conference last week cited serious violations by interrogators, who are depriving the detainees of their most basic rights.

Regarding the minor, the court ruled the ISA (Israel Security Agency – Shin Bet) may not extend his administrative detention, which means if evidence cannot be presented to arrest him and charge him with a crime, he must be released. The child has been held a number of days in violation of the laws governing the arrest and detention of juveniles.

The law governing the arrest and incarceration of minors states that a child cannot be held for more than 20 days without the permission of the Attorney General’s Office. The youth in question has been detained under administrative detention orders for 25 days, leading to the court’s decision.

The ISA turned to Attorney General Yehuda Weinstein requesting his okay to hold the youth, and this would prevent his release. The security agency was immediately given the ok, as AG Weinstein approved the 25-day incarceration of the youth retroactively. This occurred as the High Court was still in session during the early afternoon hours. Hence, the youth will remain in ISA detention, barred from seeing an attorney and subject to harsh tactics by interrogators. Attorney Chaim Haber, who represents two of the suspects. told Kol Berama Radio on Sunday afternoon that anyone would admit to any crime if subjected to the harsh interrogation and torture the suspects are being subjected too.

PA (Palestinian Authority) media agencies are reporting “significant progress in the investigation” which is not confirmed by official Israeli sources. The gag order prohibiting reporting details of the ongoing investigation is still in place.

  1. It would appear that the use of these pictures is calculated to take away from what’s been done to the detainees. As if we should be reminded of what they are guilty of and therefore possibly deserving of their treatment.

    It was a bad decision on your part. The Jews are innocent. Do you really think these hilltop youth are such expert criminals that they wouldn’t leave a shred of evidence behind?

    Today it’s the hilltop youth. Tomorrow, it’s the chareidi community. They hate Jews who cling to Torah.
