Suspects Arrested For Assaulting Rav Havlin Tell The Court: We Don’t Recognize Your Authority Or The Zionist State


1The three suspects arrested for taking part in the illegal intrusion and destruction that followed in the home of Kiryat Gat Chief Rabbi Moshe Havlin Shlita were arraigned in an Ashkelon court. The three have refused to cooperate with police and have not identified themselves. They told the court they do not recognize its authority. The court extended their remand for four days.

The three were a part of a group of about 25 Sikrikim who broke into the rav and began trashing the home in protest of Rabbanei Chabad reaching agreement with the IDF by which Chabad talmidim will serve in the military. As a result of the incident the rebitzen was hospitalized, apparently the result of the psychological trauma of seeing the thugs in their home and the damage they caused.

One of the three actually turned around and showed the court his back to highlight his contempt for the secular court and to highlight his unwillingness to cooperate, telling the court he also does not recognize the state.

Due to their position, the court released the public defender from representing them. At present, they face charges of trespassing.

The court signaled it was contemplating their release with restrictions but in light of their adamant refusal to cooperate, the decision was made to comply with the police request to extend their remand. It is added that authorities have already learned one of the suspects allegedly took part in an assault against a chareidi IDF soldier in the past.

There is a “de facto” legal principle in Jewish law, that has applied throughout history (whether one is dealing with Centurions or Cossacks or Gestapo or Commisars), that is somone has a gun (or sword, this goes way back) pointed at your head, you deal with them. It isn’t recognition of his authority, but of his ability to injure you. In this respect, the zionists are no different than any of the aforementioned. They got the guns, and we don’t.

    If the aggrieved party were to complain to the hareidi Beis Din, that would constitute recognition of the legitimacy of the Torah world, which no zionist would do (can you imagine Hitler’s or Stalin’s minions going to Beis Din?).

  2. First they should be held until they identify themselves. Then they should be prosecuted for their crimes. In the US they would charge them with a whole slew of crimes. Breaking and entering, tresspassing, harrassment, unlawful imprisonment, property damage, threatening and more. In Israel the court is contemplating their release!

    Although they should not have broken into the home of Havlin, I commend them for their bravery and steadfastness not to recognize those guys who made themselves into judges and running the state behind the scene.

  6. #9 – The best analogy in the United States is when American Indians refuse to recognize the government’s authority (everyone else, no matter how much they hate the government, accepts its legitimacy). In those situations, American courts and prosecutors tend to proceed somewhat gingerly. The “king” doesn’t want to give added publicity and credibility to those who deny his right to the throne. It would make more sense for those who were injured to seek civil damages, first by summoning to a zionist Beis Din, and they suing them in a state court if they don’t answer the summons.

    As any high schooler knows, your “analogy” is off the wall.
    The Native American situation is a unique one because first and foremost, treaties were signed and broken by the US government and them , over and over again. There were other considerations as well for the SOMETIMES gingerly approach.

  9. I personally spoke with someone that was there. He said that the whole crime they did was that a group (one van load) of about twenty people came to his house and demanded to speak with him. When he refused to speak to them one of them stuck his foot in the door and did not let him close the door while the rest of the group was “socher nefashos” and other insults and said Tehillim in front of his house. They were getting into the van when the police arrived and arrested three of them. The accusations of damaging things in his house are not true. They probably would have been out long ago if they would have cooperated My proof is the only thing they are charging them for is trespassing. To make the story short YWN GET YOUR FACTS STRAIGHT!!!
