Report: Rav Ovadia Shlita Permits a Woman to Recite Kaddish

Maran HaRav HaGaon Rav Ovadia Yosef Shlita reported has given a p’sak halacha that a woman may recite kaddish for parents if there is a minyan of ten men of course. This report is based on a p’sak appearing on the Halacha Yomit website operated by a grandson of the Gadol HaDor Shlita.

The question posed to the Rav was very specific and one must take care to realize the situation presented, a far cry from a general situation in which a woman recites Kaddish. The case in point addresses a woman who does not have brothers to recite Kaddish over a deceased parent. The Rav points out that the same does not hold true in a quorum of ten women, since one may not recite Kaddish without a minyan and 10 women do not constitute a minyan.

The Rav reportedly added the woman may not recite Kaddish in shul, but at home, with a minyan, after learning or davening.

The publication of the p’sak is expected to begin appearing out of context, perhaps with organizations like Women of the Wall, who are spearheading a battle to permit women to daven at the Kosel with tallis and tefillin and to read from a Sefer Torah.

Nevertheless, it would appear the Gadol HaDor is a step ahead and the Rav Shlita cited the specific conditions, not a quorum of women and not in a shul, but in the modesty and privacy of a home.

  1. “What’s wrong with saying it in shul quietly . . . ”
Since it is a davar she’bikedushah, it must be said in the presence of, and heard by, ten men. Saying it quietly is like saying in without a minyan which cannot be done.

  2. Just as they are permitted to say Birchas HaGomel from the Ezras Nashim, so too they are permitted to say Kaddish. This was the minhag in many communities in Europe. This is how Rav Kreiswierth Zatzal paskened and this was an accepted minhag in Munkatch and in BRISK!! Check your facts before opening your mouth in Halacha (or anything else) against a Talmid Chacham and Gadol of Rav Ovadia shlita’s stature.

  3. Okay, what what’s wrong with saying it in shul non-quietly?

Once shiva is over, who is saying kaddish for the deceased? Chabad?

  4. maran harav yosef shlita once again proves that daas baal habatim is neged daas torah.

while everyone else seems so concerned with being frummer than the next guy, thinking up silly chumros that have no basis whatsoever, and ‘assering’ everything under the sun in the name of ‘frumkeit’, Rav Yosef is guided only by halacha.

just because something does not fit in to today’s ever-narrowing definition of yeshivishe’ ‘frumkeit’ doesn’t mean that it is assur.

  5. no disrespect intended, but doesn’t the gemara say (I don’t remember where) “kol be-isha erva” on which Rashi says this includes “dibbur”?

  6. #8 are you a fluke or something! what does naval birshus hatorah have to do with this, if there are no sons or others to say kaddish for a deceased it is the right thing for a child yes a daughter to say kaddish as rav yosef has prescribed under specific terms. if there are those that dont want to take this option of a child saying kaddish but rather pay a stranger to do so, so is their choice, but what in the world does naval birshus have to do with it, you are implying that its something not correct, thats total ameratzus!

  7. Rav Ovadia said ONLY at home. Rav Ovadia prohibits the women from saying kaddish in shul.

He was very clear in his psak about this point.

#11 Apparently the Rav is NOT saying ONLY at home, he is saying NOT in the main “ulam” of the shul. Seemingly, a side room where a minyan of men learn or Tehillim are recited would be OK.

  9. This is not a new psak, for families with daughters only this has been asked and answered by Reb Moshe zt”l in the past. There are shuls where the women can say kaddish from behind the mechitza, if it is not the main shul room.

  10. Its so sad that YWN has so many Reform readers!!!!!!Read the Psak properly, only under certain special circumstances may a women say Kaddish. Stop turning a Godals Psak into a Reform or Mizrochnik Psak!!!!

  11. To #12 I do not know the Hebrew, and it is possible someone mistranslated the English part.

    It seems to me that if the english is correct the Rav had paskened that it was not allowed in the shule, here is the appropriate excerpt from the English translation of the article;

——The Rav reportedly added the woman may not recite Kaddish in shul, but at home, with a minyan, after learning or davening.————

Now unless it is mistranslated (and I admit, that is possible) it seems to me to be very clear and precise, that the Rav did not permit it in shule at all.

  12. to #7 zalmy, yirbu k’mioscha b’yisrael . it obvious from your words that you have a very healthy attitude . its my prayer that it spreads to many other yiden

  13. In the year 1955/6 the Rov in Australia HaRav Betzalel Stern (SH”T Bezal Hachochma)allowed an only daughter to say Kaddish IN Shul for her parents who died in a plane crash.

  14. Big deal.

Rav Shlomo Ganzfried paskened so almost 200 years ago in the Kitzur Shulchan Aruch (26:20)

“A daughter may not say Kaddish in shul, though some say that if they
want to make a Minyan in her home so she can recite it, they are
    allowed to. Others forbid it.”

  15. the sefer mentioned in this letter [tshuva meahava] was around before the kitzur to #9 the rishonim in berochos 24a says the rule of kol bieesha is only when singing[see rashba on the spot]see hamakneh kiddushin 80a who brings the bais shmuel even ezer a more appropriate critique might be that its not kavod hatzibbur see megilla23 or 24a towhy women dont read the megilla for the public

  16. #20, the Tshuva Meahava is against women being present in shul at all, not just against them saying kaddish there. If you don’t hold like him in that, what grounds do you have to support him on kaddish?
