Court blow for French Holocaust Jews

A court has struck down a ruling that French railways must compensate the family of a Jewish man transported to an internment camp in Nazi-occupied France, dealing a blow to hundreds more claims.Judges in an administrative appeals court in south-western Bordeaux said administrative courts were not competent to rule on the legal liability of state rail operator SNCF.

The ruling means plaintiffs will have to bring their cases before civil or criminal courts, where lawyers say they have far less chance of success.

“It’s a way for the administrative justice system to kick the issue into touch,” Gerard Boulanger, a lawyer representing some of those bringing cases against SNCF, told reporters.

SNCF did not immediately comment on the ruling.

Tuesday’s decision overturned a landmark verdict last June in which a court ordered SNCF and the French government to pay $113,000 to the family of Georges Lipietz, a Polish-born Jew arrested by French police and taken by train to a transit camp near Paris in 1944.

Lipietz died after launching the action in 2001, but family members including his son Alain, a member of the European parliament, have continued the case.

Some 76,000 Jews were arrested in France during World War Two and transported in appalling conditions in railway boxcars to concentration camps such as Auschwitz, where most died.

The SNCF, which has received 1,800 requests for compensation since the ruling, said it had been forced to obey the orders of the government of the time and the German occupiers.

  1. How long is this shakedown of the rich Holocaust lawyers going to go on? How long is it going to take war survivors descendants to get their money from Bank Leumi? Imagine if it were a European bank! The Holocaust Industry would be raising hell all the way from gehennom! This shakedown industry has to stop.   2. Yosher, I am referring to the fact that the entire litigation industry, which makes huge amounts of money for parasite lawyers, and is a terrible chilul hashem, has got to come to an end. Furthermore, it is perfectly appropriate for the Palestinians to sue the living daylights out of the Zionist regime in Eretz Yisroel for every single event of their suffering over the past 60 years starting with the ethnic cleansing of 1947-1949. Do you still not get it?

  4. I appreciate your first point but every dollar we get will never compensate our loss but will help us rebuild. That decision I will leave to people with breiter plaitzes, our gedolei yisroel.

    About the events of 1947-1949, it was not only on the arabs but also on other Jews and the Jews also got attacked and murdered by the Arabs. As a child of a Chassidic Polish immigrant to Palestine of the 1930s, I disagree with assertion.

  6. Sheryl, you should definitely cry since a careful examination of that photo shows that it is a collage photo, for which the Soviets were famous, especially the heretical Jewish communists. You can see that the entire group of women (no men?) is bunched together in once central focus, with a single man in a striped uniform next to a train. None of the women are facing the train, and there is not a single trace of a gun held by a soldier of any kind. The train is patently a merchandise transport, not the so-called human transports, which were supposedly cattle trains (aren’t cows supposed to have enough openings to breathe?). Look at many of these photos very closely and you can see the way several photos were merged. Look for shadows, incorrect symmetry of persons, different shading, etc.

    Any person who talks like that even in jest should be punished by having to visit Concentration Camp vitims and having to hear what they went through.
    Will even a million dollars per guy compensate these people for lost lives,childhoods?What about losing family members?
    I personally would rather be poor and in Europe the way we were and in America and be “rich” because we got this money.
    Another point that Yeshivah News didn’t bring up is the firing of Israel Singer who was a champion of these issues and the role he had in getting these monies. Would have he helped the issue?(see swiss bank case and other such cases that he was involved in)

First of all, the concept of enemy of Jews refers to anyone, Jew or non-Jew, who seeks to destroy the ability of the Jewish People to follow the Torah. So if there is anyone who is an enemy of the Jewish People, it is Zionism and the traif Medinah. Period. The photo definitely looks like a collage. It is one of many like that.

    i do work professionally with digital editing and creation, including the production of photomontages. this is clearly not one. every nuance of shadowing, perspective, lighting, brightness, contrast and fading is completely consistent throughout.
    post photographic processing was primitive then compared to today’s technology (i.e photoshop, image design, and the like) but even using the latest technology available in 2007 a fake this good would be quite unusual, even by well trained artists.
    in addition even a bit of basic saichal would make this claim just plain laughable. there were hundreds of thousands of such photographs taken, making their laborious creation in the darkroom absurd.

    it’s a very low and coarse thing to publicly call someone’s emotional response to a photograph: “pathetic”. very disturbing and sad.

    I’m afraid you’ve misunderstood this site. This is a Jewish site; thus, photos of Jewish persecution pains us. This applies to standard pictures, and those comprised of a number of photos in collage form.

    I understand your confusion, as the internet is a “big place”, and it’s easy to land on the wrong site. Please respect our sensitivities to Jewish suffering, and thanks for stopping by.

For example, take a look at the postings about the Gaza Tsunami. And others as well. No person can take responsibility for how certain people feel about certain issues although the politically correct feel-good crowd doesn’t understand this.     There are many of us who have lost relatives in the Holocaust. We are greatly shaken by your cavalier attitude toward the Shoah, and your empathy for the German nation.

    Your disdain for Jewish suffering cannot be whitewashed under the guise of anti-Zionism. Many of us (perhaps the majority?) don’t subscribe to Zionistic ideology, although that is unrelated to the tragic transport in Nazi-occupied France. Please re-read your words- perhaps you wrote hastily, and did not adequately articulate your intended message.

I will go back to once again skipping his posts in the future. He continues to make no sense whatsoever.

    Sheryl – I’m with you, this and other photos like it make me cry also. I show these photos to my older children and explain to them what was happening when these photos were taken… I show them pictures of the victims of Terror in E’Y such as the photo of the mother and girls that were shot point blank – I cry with this picture also.

    this is EXACTLY the type of car that was used to transport holy Yidden.

    However if you are one who is immersed in television and movies, you would expect to see a car with large openings that show the faces of the captives. makes for a more dramatic picture to portray the emotion of the situation and induce the effect desired by the media producers.

    this very same media immersion, unfortunately has other undesirable effects on one’s character, among which can be identification with the other nations of the world and the adoption of their values and manner of thinking. including an empathy for the palestinians and germans.

    Before the war, Germany had a very large Jewish population.
