Pre-Pesach Update On Bochrim Imprisoned In Japan

While we are all deep into our Pesach preparations, it should be noted that this will be the  fourth Pesach that Yaakov Yosef ben Raizel and Yoel Zev ben Mirel Risa Chava will be spending in prison, alone without family or even one friendly face. The askonim, Dayan Weiss, R’ Aron Nezri and R’ Meilich Bindinger, who have been coordinating and overseeing the defense effort have already shipped an ample amount of matza to Japan for the two boys, as matza has been allowed into the prison in the past and will be delivered to them this year as well. However, the askonim are leaving no stone unturned in their effort to have authorities allow grape juice and packaged of dry food items such as nuts, chocolate, Pesach cookies, and the like into the prison. Thus far permission has not been granted, but Askonim hope that ultimately the efforts of the askonim will bear fruit. The boys have also been sent new clothing for Yom Tov, as well as machzorim, haggados, and other seforim. The boys will also be visited this week by someone who will spend several days in Japan. This will be a source of tremendous chizuk to them, as the opportunities for visits during Pesach itself will be limited due to the Shabbos directly before it and another Shabbos being in the middle of Chol Hamoed. Also the Japanese National Holiday comes two days after Isru Chag and goes on through May 6th, during which everything, including the prisons, are closed and no visitors will be allowed. While all possible forms of hishtadlus are being done by the selfless askonim both in the legal aspect and in physically and emotionally supporting the boys, please continue to keep Yaakov Yosef and Yoel Zev in your tefillos. TONIGHT – Lakewood Asifa For Bochrim In Japan

The trials of the boys jailed in Japan, Yaakov Yosef ben Raizel and Yoel Zev ben Mirel Risa Chava, are coming to a close. On March 28, closing arguments for Yaakov Yosef will be presented, and on April 5, Yoel Zev’s lawyers will present their final arguments. The verdict will be announced 5-7 weeks later.    Tefila and support are urgently needed at this critical time. The Lakewood Roshei Yeshiva and Rabonim urge all to attend the atzeres tefilla this Motzoei Taanis Esther, at Bais Faiga Hall at 9:45 p.m. The event will feature the participation of Lakewood rabbonim and roshei yeshiva, Divrei chizuk will be delivered by Rav Aryeh Malkiel Kotler, Rosh Yeshiva of Bais Medrash Govoah. Rabbi Aba Dunner, Executive Director of the Conference of European Rabbis, will provide a firsthand report regarding the current situation in Japan. Rabbi Dunner has personally visited the boys in jail and plays an active role in seeking the funding needed for the boys’ defense. A unique guest speaker at the event will be Mr. Michael Levine, a forty-year veteran of the US Drug Enforcement Agency, including undercover law enforcement positions at JFK and Miami International Airports. Mr. Levine traveled to Japan earlier this year to testify on behalf of the boys in Japan. Judging from his years of experience, Mr. Levine unequivocally stated that the behavior of the boys was typical of “blind mules”, innocent drug couriers that have no idea of the illegal contents in their possession. Bochrim In Japan Not Affected By Horrific Quake & Tsunami

These days, when we hear about an earthquake in Japan- all of Klal Yisroel are wondering – has this affected the two Yeshiva Bochrim in prison over there at all? R’ Aron Nezri, and R’ Meilech Bindinger, the main keyplayers in the case, have been in constant contact to make sure everything is ok. R’ Aron reports to us: “We have been, and continue to be in constant contact with those in Japan. The Chiba detention centre has not been affected at all. Even if water does come off of the shores of Chiba it will not hit the district as it is high up on a hill. I have had someone go a number of times already to the prison to make sure the boys are ok and he will continue to go over the next few days to check on the boys as well.” Rabbi Binyomin Edery, the local Chabad shaliach who often visits the boys said “Today we had a major earthquake, thank G-d we are all fine. All the houses and buildings literally swung, trains are not operating, highways have been closed and phone lines down. There hasn’t been such a strong earthquake in the Tokyo area for at least 70 years. This is a very strong Tsunami.”   and added “One of the signs of the Redemption is that the earth will shake and get worn out like a garment. Bochrim In Japan Trial Update 02/28/11

The hearing held today, Monday, February 28 in the Tokyo High Court in the appeals case of Yaakov Yosef ben Raizel has been concluded at 4:55 PM Tokyo time. At this hearing, Ms. Reiko Suzuki, the woman who had administered the polygraph test to the three bochurim arrested in Japan for carrying drugs in their suitcases, took the witness stand in her quest to defend her position that passing the polygraph test does not preclude the possession of “vague knowledge” in the subjects being tested. Ms. Suzuki’s hour and a half long examination by the prosecutor proceeded in an atypical and seemingly ridiculous fashion, with 90% of the questions apparently having been prepared in advance to only require one word answers from Ms. Suzuki such as yes, no, of course, etc. in her attempt to avoid ensnaring herself in her effort to challenge Professor Ben-Shachar’s scientifically based testimony of January 26th which clearly proved that CIT testing is accurate even in the case of vague knowledge. After a twenty minute break, Mr. Takano, the leading lawyer on the defense team, cross examined Ms. Suzuki for another hour and a half, with Ms. Suzuki being extremely evasive in her answers. The defense team detected at least two outright lies and several contradictions in her testimony, which will be clearly highlighted at the closing arguments which are scheduled to take place on March the 28th. Present at the hearing were Yaakov Yosef’s father, Rabbi Aron Nezri, Rabbi Meilich Bindinger, and Professor Ben-Shachar, among others. After the hearing was over, the Professor stated that he was surprised at Ms. Suzuki’s “cheap fakery”. The defense team now has one month to prepare its closing arguments. The end is drawing near…. Bochrim In Japan Trial Update 02/23/11

On the coming Monday, February the 28th, the final hearing in the appeals case for Yaakov Yosef ben Raizel will take place at the Tokyo High Court, at which the prosecution will attempt to challenge the expert testimony previously given by Professor Gershon Ben-Shachar.  Professor Ben-Shachar, the world’s foremost expert on polygraph testing, had flown to Japan to testify on behalf of the defense team against the claim of Ms. Reiko Suzuki, who had administered the polygraph test to the three boys arrested in Japan, that whilst the boys passed the test that showed that they had no knowledge of the contents of their suitcases, the examination however did not rule out the presence of “vague knowledge” in the subject being tested.  The Professor provided the court with strong scientific evidence that in CIT (Concealed Information Test) testing, vague knowledge equals knowledge and that a definite differential response would have been achieved. Now Ms. Suzuki is to have her day in court.  Proceedings are scheduled to begin at 1:30 PM local time with a 60 – 90 minute session during which the prosecutor will question Ms. Suzuki.  A short break of 15 to 20 minutes will follow, after which Mr. Takashi Takano, chief lawyer for the defense, will be given 90 minutes to cross examine the witness.  The hearing will conclude at around 4:30 – 5:00 PM after the judges have had their turn to question Ms. Suzuki and to finalize any points they may want clarification on. Although Professor Ben-Shachar was  not originally scheduled to attend the upcoming hearing, the defense team felt that it would be extremely beneficial to the case were he to be present, and he agreed to make the long trip from Tel Aviv to Tokyo despite his advanced age.  Unlike the previous hearing, which was much lengthened by the need for interpreters to translate the proceedings from Japanese to English and vice versa, Monday’s hearing will be conducted exclusively in Japanese.  As such, the askonim have arranged, after much effort, to have a translator present who is fluent in both languages who will type what is being said into her laptop in English.  Her laptop will be linked to Professor Ben-Shachar’s laptop and he will thus be able to follow events as they occur.  This will give him the distinct advantage of being able to link facial expression and body language to what is being said so that he can determine the prosecution’s weak or vulnerable points.  Then, during the break before Mr. Takano’s cross-examination, he can best guide the team in their efforts according to his observations.  In addition, Ms. Suzuki will definitely want to exercise constrain in the Professor’s presence, as she will not wish to discredit herself in his eyes. It should be realized that without this interpreter present, Professor Ben-Shachar, along with the askonim and anyone else not knowledgeable in the Japanese language, would need to wait between 7 and 10 days for the court records to be released, after which they would need to be translated and reviewed by counsel.  Now, the defense team will be able to sit down with Ben-Shachar the same evening to discuss how best to proceed. YWN Exclusive: A First-Hand Report From Tokyo [Bochrim In Japan]

The fate of three bochurim from Eretz Yisroel detained in Japan nearly three years ago, after drugs were found concealed in their suitcases, has been in the minds and tefillos of Jews all over the world ever since. Mr Mendy Bude, a prominent figure in Northwest London, spent a few days in Tokyo the week of January 26, to see the situation for himself and to be present during a hearing in the appeal of one of the bochurim at the Japanese High Court in Tokyo. “Why are you going?”, “What will you achieve?”, “Is this not a waste of your valuable time?” These were the typical comments made by many of my friends and colleagues when hearing that I proposed to visit the two incarcerated bochurim in Japan. The events leading to this visit start on 3rd April 2008 when three young bochurim (aged 17,19 and 22) were arrested on entry to Japan at the Narita International Airport, Tokyo, allegedly trying to bring into Japan a massive quantity of illegal drugs hidden in secret compartments of their suitcases. I must admit that when I first heard what had occurred while feeling some compassion I felt that they deserved what was coming to them; and perhaps this was not a justifiable case of Pidyon Shevuyim. Over the forthcoming weeks and months the true story emerged. These are innocent boys; naive in the extreme; duped by an evil man. As I will demonstrate they had no idea they were doing anything illegal. They thought they were assisting a legitimate businessman delivering antiques for him in return for a modest payment which would help their impoverished families with Pesach expenses. As my report is intended to be a record of my visit to Japan, I will not dwell on legal analysis; however I do feel it right that I should highlight some bullet points:  (1) These boys came from very sheltered families with no access to radio, television, the internet, or any other modern forms of technological communication. They had no exposure whatsoever to Western culture and did not receive a secular education. They are only able to speak Yiddish and Biblical Hebrew.  (2) It has been proven in the Japanese courts that they had no idea what “drugs” are. When asked at one of the hearings to define “drugs” one of the boys naively replied, “Of course these are medicines you take when you are not feeling well”!  (3) As they had no command of Japanese or English, when given immigration and customs forms to complete, they had no idea how to deal with these. They asked the airline stewards and government officials at Narita to fill in the forms for them! Detention Centre Visit Early on Wednesday morning we (i.e. Mr and Mrs Yaki Halpern of Manchester who accompanied me on the trip to Japan and myself) were driven to the Chiba Detention Centre where the Bochurim are being held pending a final verdict. UPDATE: Rabbonim & Askonim Visit Bochrim In Japan Prison

As was reported here on YWN, Professor Gershon Ben-Shachar testified at the Tokyo High Court this past Wednesday, January the 26th, in the appeals trial on behalf of Yaakov Yosef ben Raizel. Askonim – including Rav Yitzchak Dovid Grossman of Migdal Ha’emek, Rav Aron Nezri and others  – took advantage of their trip to Japan to visit with both boys still being held at the Chiba Detention Center, Yaakov Yosef and Yoel Zev. Although the visit did much to lift the boys’ spirits, the visitors themselves were extremely impressed with their deep faith and positive outlook, despite their almost three-year incarceration. Whilst klal yisroel received in jubilation the good news of the early release of Yosef ben Itah Rifkah, the youngest and the only juvenile of the three bochurim, who was serving a 5 year sentence in Israel; yidden around the world continue to plead mercy for the older two bochurim who since they were older than 18 years upon their arrival to Japan, are threatened with facing a much harsher and lengthier sentence. In response to a letter which Yaakov Yosef received describing the tremendous Achdus of Klal Yisroel’s tefillos, he said that he felt that this Achdus helped to create a certain unity within the Japanese legal system, in that the judge presiding over Yoel Zev’s trial was willing to adjourn the proceedings so as to be able to incorporate Professor Ben-Shachar’s testimony at Yaakov Yosef’s appeal as evidence in Yoel Zev’s trial, an unusual move on Judge Hodoku’s part. Just a small idea of what these two bochurim are going through: One of the boys read a story of a man who had survived the concentration camps during World War II but had lost his wife and children. In trying to portray his loneliness to one who had not gone through this gehennom, he described how on Friday night he realized that he no longer had anyone left to say “Good Shabbos” to. The bochur remarked that he, too, has no-one to say “Good Shabbos” to in the Japanese prison. One Of The Bochrim In Japan Story Is Released From Israeli Prison

8:10PM EST: YWN has learned that one of the Bochrim who was arrested in Japan has been released from an Israeli prison – where he was serving his prison sentence. According to Israeli reports, Yosef Ben Ita Rivka was released this evening from prison, and is currently at his home in Bnei Brak. The reports state that he received a pardon from Israeli President Shimon Peres two weeks ago. Yosef Banda had been transferred to Israeli Custody in March 2010 to serve the remainder of his sentence in Nitzan Prison. Yosef was entitled to weekly family visits, on erev, and was even released for Shavuos last year. The Japanese court had sentenced Yosef to 5 years imprisonment and a $40,000 fine, and after calculating time served, he was scheduled for release after this coming Pesach. Benzion Miller (Of Jerusalem) Sentenced For Involvement In Sending Bochrim To Japan With Drug-Laden Suitcases

The Tel Aviv District Court has sentenced Benzion Miller to three years behind bars, for his involvement in the drug smuggling story which landed three Bnei Brak Yeshiva Bochrim to Jail in Japan. The decision was made after the families of the three Bochrim testified against him. In an interview with Kikar Shabbat, family members said that the punishment imposed on him is not enough. Miller was arrested in February 2008, and was believed to have been the mastermind in the case, sending innocent bochrim on a mission, planting drugs in their bags without their knowledge. As a result, they were incarcerated in Japan, under extremely harsh conditions. In regards to the sentence of the Bochrim: The Japanese court sentenced Yosef Banda to 5 years imprisonment and a $40,000. He was transferred to Israel to complete his sentence in March of 2010. After calculating time served, he still has a bit over 14 months that will be completed in the Nitzan Prison in Israel. (Yosef Bondo testified in the case against Miller, and placed the blame solely on his shoulders.) Yakov Yosef ben Reizel was sentenced to 6 years with no drug charges, only for being negligent. His appeal tril is scheduled for November 1. Yoel Zev ben Mirel Reesa Chava is in middle of trial, and will resume on October 20th. Worldwide Tefillos for Bochrim Imprisoned in Japan

Worldwide tefillos are expected on Sunday and Sunday night as the trial of one of the bochrim imprisoned in Japan gets underway. A number of months ago, one of the three was sentenced and next week, the trial of yet another defendant is scheduled to begin. The trial begins on Monday in Japan, Sunday night in Eretz Yisrael and Sunday evening in the United States. The trial is expected to continue for three consecutive days. The justices will hear the case against suspect Yosef ben Reizal. The Eida Chareidis on Wednesday night called for an increased adherence to acts between man and fellow man and to increase tefillos as the trial take place. Tefilla gatherings are reportedly going to take place in New York and London as well. Court Says Enough Delays in Miller Trial (Bochrim In Japan)

Tel Aviv District Court Justice Haled Kabuv announced on Thursday that four delays in the start of the trial of Bentzion Miller are enough, setting a final date for the trial to begin in a month. At that time, the state will begin presenting its case against Miller, who is alleged to have sent the bochrim imprisoned in Japan on their mission, one that cost them dearly. Attorney Avraham Lindstein told the court once again, that other than purchasing plane tickets for the boys; his client has no connection with any of their actions and denies any link to alleged drug dealings. The defense added that it has yet to receive all the evidence in the case, explaining the prosecution promised to hand over photos but to date, all that was received was “blank pages”. Prosecuting attorney Oren Paz expressed sorrow over the drawn out process, citing that on this fourth meeting in court, no progress is being made in the case. The state added that the defense attorney has yet to give his approval to the witness list as is customary, adding the state is willing to drop some of its 100 witnesses in the case in the interest of moving forward. Miller was arrested seven months ago and is believed to have been the mastermind in the case, sending innocent bochrim on a mission, planting drugs in their bags without their knowledge. Update On The Bochrim Imprisoned in Japan (Interview With Rabbi Yaakov Bleich)

YWN earlier in the week published an article (HERE) quoting a Kol Chai Radio interview with Avraham Schwartz, who resides in Japan. He detailed the condition of the bochrim, Yosef ben Ita Rivka, Yoel Zev ben Mirel Reesa Chava and Yaakov Yosef ben Raizel, as well as other facts surrounding the case. Since then, YWN has been inundated with hundreds of letters, emails and phone calls, Baruch Hashem attesting to Klal Yisrael’s concern for the bochrim and their plight. After making some inquiries and probing the matter further, YWN Israel correspondent Yechiel Spira conducted a telephone interview with Rabbi Yaakov D. Bleich, the Chief Rabbi of Kiev, who is quite involved in the case. For one thing, YWN has learned that the statements made by Mr. Schwartz contributed to added grief among the parents of the prisoners, with the interview aired in many areas of Eretz Yisrael on the radio. I was happy to learn that Baruch Hashem, Mr. Schwartz’s statements regarding the youths facing a death sentence were inaccurate, and while their predicament is difficult by all accounts, a death sentence is not among their fears. Yosef [ben Ita Rivka] Bondo was sentenced, as was reported, and he must inform the court by May 15th if he plans an appeal. One might expect that this is a given but Rav Bleich explained it is not as simple as it appears. For one thing, if Yosef’s attorney announces an appeal is requested, the process usually will take about a year and can sometimes take two years. During that time period, nothing can be done on his behalf to have him transferred to Eretz Yisrael. Even though it would be advantageous for the older two boys if Yosef’s verdict would be revoked, it might be to Yosef’s own advantage to forgo the appeal and concentrate on being transferred to Eretz Yisrael, a process that will generally take 8-10 months Rav Bleich stated, backed by the knowledge that in the past two years, a number of Israeli prisoners have been transferred back home, a process that is “delicate” and requires diplomatic white gloves, but not without precedent. If he does not appeal, he immediately begins serving his sentence and will be transferred to a hard labor facility. Rabbi Bleich stressed all three defendants have their own independent cases and judges. Without compromising the case of any of the bochrim, I will say that the rav explained that the other defendants went a different route, with Rabbi Bleich and others delving into the records of no less than 200 lawyers before deciding to interview 30, thereby selecting four who are backed up by two consultants, an impressive legal team. Assisting in the selection process was a prominent US attorney, whose “brilliant analytical mind” was crucial in formulating the impressive legal team that will defend the other two, Rabbi Bleich explained. Rav Schwartz Tells of Horrific Conditions for Bochrim in Japan

Rabbi Avraham Schwartz, a resident of Japan, on Monday night spoke at length with Kol Chai Radio, telling of the horrors that have become the lives of the three bochrim sitting in prison, Yosef ben Ita Rivka, Yoel Zev ben Mirel Reesa Chava and Yaakov Yosef ben Raizel. Yosef was sentenced on Friday. Rabi Schwartz explains he has become the person who is closest to the bochrim, visiting them daily and seeing to their needs as much as prison officials will permit. His descriptive tone was filled with pain, agonized over their plight – explaining the youths are being held in abhorrent conditions that should not be tolerated, separated from one another, living “in a box lacking space and below any acceptable Western standard” even for the harshest of criminals. He stressed that he is convinced beyond the shadow of a doubt that the boys were innocent as far as the true knowledge of the contents of what they were carrying, literally unsuspecting couriers. He explained that as far as they were told, they may have been violating customs laws by transporting gold and antiques, and were told if they were apprehended by customs officials, they would have to make payment, nothing more. He posed some rhetorical questions, which he explained he cannot address in depth at present since the trials of two of the youths are still ongoing. For one thing he said, the doubled-walled suitcase was “hermetically sealed” and the fact that authorities decided to literally smash apart the suitcase to search for a secret panel poses many questions. Regarding their condition, it is known they have lost a great deal of weight since kosher food is unattainable. When asked “do they cry?” he responded by explaining that undoubtedly they do, but not in front of him – compelled to add that each day when he leaves, he cries, pained at the sight of these innocent victims enduring the harshest of conditions. They spend a great deal of time learning, using the seforim brought to them. They seem to find strength in their attachment to Hashem, davening daily for a miracle as the days are long and extremely harsh. Their time outdoors is extremely limited and he labeled their conditions “cruel and inhumane”. Rabbi Schwartz was asked if he has an idea how long the sentences will be of the two older defendants, to which he explained that under Japanese law, they face a death sentence or even life in prison, but stated this will not be the case, evading the obvious, how does he know this. He stated with absolute certainty that they will not face the two harshest possibilities. The rabbi did add however “I hope I will be proven wrong but their sentences will be in double digits”. Rabbi Schwartz had words of criticism for the legal defense provided the boys, and pointed out “when I do speak after the trial, there will be an earthquake as a result”. Israel has indicated it will file a formal diplomatic request to permit the boys to serve their prison terms in Israel, to which Rabbi Schwartz stated such a process will take at least two years. Nightmare For The Bochrim In Japan…

Much has been written on YWN about the three Bochrim sitting in a Japan jail facing harsh sentences R”L. The following article appears in this weeks Jewish Press, and was reprinted with their permission: The loneliness is overwhelming. Yoel G., Yaakov Yosef G., and Yossi B. have spent ten months in solitary confinement, sitting on a hard concrete floor, their mobility severely restricted. They have no contact with anyone they know, except for their lawyers. No visitors are permitted, with the exception of parents, whom they may only see briefly and infrequently. Even these visits are held through a glass partition, and monitored by guards and interpreters. And the fear. How long will they have to remain in these forbidding jail cells, thousands of miles away from their homes and yeshivos? Will they be sentenced to a decade of forced labor by a judge who cannot comprehend the naiveté of innocent yeshiva bachurim cruelly exploited by ostensibly pious Jews? Will they ever again lead a normal, Jewish life after being “reformed” by the highly efficient Japanese corrections system? Yossi was only 17 at the time of his arrest; Yaakov Yosef was 19. Lack of kosher food has caused one of the boys to lose 100 pounds, and another to lose 60. It started out as an innocent favor for a friend. Yoel, Yaakov Yosef and Yossi were kindhearted yeshiva bachurim who spent their spare time doing chesed for sick people in Bnei Brak, and when someone they knew and trusted approached them with an assignment of a different nature, they had no reason to think anything was amiss. “I have a friend who is an antique dealer,” the person told them, “and he needs to deliver some antiques to Japan for the Tokyo 2008 Art Fair that will be taking place in a few weeks. He is unable to go himself, due to family obligations, so he asked me to find three bachurim to each take one parcel containing valuable antiques. He is willing to pay $1,000 to each of you on your return for the effort.” The boys recognized the name of the antique dealer, a prominent and respected member of the religious community in Eretz Yisrael. Nothing about the assignment sounded suspicious, and the promise of some bein hazmanim pocket money was inviting. The boys were told their assignment was 100% legal and that the antiques they would be delivering did not have to be declared at Japanese customs. Instead of receiving a parcel, they were each given an empty suitcase and instructed to put their personal belongings inside. The antiques, they were told, had been placed in a sealed compartment inside the suitcases as a precaution against theft, damage or accidental loss. They did not dream the sealed compartments of the three suitcases contained narcotics worth $3.6 million. They did not dream the favor they were being asked to do was a mask for a crime punishable by ten years of imprisonment and forced labor. Bnei Brak Character Witnesses Testify For Bochrim Imprisoned in Japan

A delegation of character witnesses left Bnei Brak, heading to Japan, to bear witness on behalf of the yeshiva bochrim who remain incarcerated for their naiveté. Among the members of the delegation are HaGaon Rav Mendel Shafran Shlita and Bnei Brak Mayor Rav Yaakov Asher. They plan to return to Eretz Yisrael by Shabbos. Some of the youths imprisoned in Japan are known personally to them and they plan to make an effort to impress upon the court the exemplary character of the prisoners during their trial this week. False Rumors About Bochrim Jailed in Japan

Numerous text messages and emails are being forwarded across the globe regarding the three Yeshiva Bochrim currently jailed in Japan. In the past hour, YWN received hundreds of emails from concerned readers. The text messages state that 2 of the boys have been sentenced to death by hanging. This is not true. YWN has confirmed with Askonim heavily involved with the case that there has been no such court ruling. In fact just two days ago YWN posted a request (HERE) for people to say Tehillim – since the court cases are starting this Friday. There is a possiblilty that these false rumors are based on a story reported (HERE) by YWN two months ago in which two 37-year-old Israeli’s were R”L sentenced to death in Thailand for drug trafficking. Former Imprisoned Bochur in Japan is Married

Yaakov Yosef Gruenwald was one of the three bochrim imprisoned in Japan after they were found to be smuggling. Gruenwald was the last of the three to be released, arriving in Israel in Elul 5772 to complete serving his prison term in an Israeli prison. Former Imprisoned Japan Bachur Gets a Break for Chanukah

For Yaakov Yosef Greenwald, this is not just another Chanukah but one back home in Eretz Yisrael, one that is accompanied with a brief taste of freedom. As one of the three bochrim imprisoned in Japan for years, now completing his sentence in Nitzan Prison in Israel, Yaakov Yosef was permitted to enjoy a leave of a number of hours on Sunday, 25 Kislev 5773, to celebrate Chanukah with family and friends. It marked the first time he was permitted to meet with members of his family outside of confinement since taken into custody by Japanese authorities. He was more than pleased to have merited toiveling in a mikve for the first time in five years. Through the efforts of many, including HaGaon HaTzaddik Rav Dovid Grossman Shlita, Yaakov Yosef was permitted to return home to Eretz Yisrael about two months ago, where he is completing his prison sentence, albeit under significantly improved conditions than he knew during his years of imprisonment in Japan. The parole board has agreed to wipe one-third from his sentence, in line with the norm for model prisoners, and he is set for release on 19 Teves 5773. During the time period that remains of his sentence the parole board decided he must serve in yeshiva studying Torah, agreeing to wave the standard supervised work program due to his pristine behavior during the difficult process. Reports Of Japan’s DA Appealing Yoel’s Acquittal UNFOUNDED

YWN has received information directly from askanim involved in the case of the bochrim who were incarcerated in Japan, and has learned moments ago that reports coming out of Eretz Yisrael are simply untrue. The Kikar Shabbat website reports that the state prosecutor in Japan has appealed the acquittal of Yoel Ze’ev Goldstein, who returned home to Eretz Yisrael about a week ago. Askanim directly involved in the day-to-day events in the case insist this is not true; pointing out the time limit for filing such an appeal has passed. Yoel Zev Heading Home From Japan

Baruch Hashem, less than a week after being found not guilty by a local court, Yoel Zev Goldstein received his passport and is making final preparations to head home, to Eretz Yisrael. One of the problems that remain is just what flight to book to get him home since there are no direct flights to Israel. Officials working on Yoel’s behalf feel if they make a stopover in a European country he may be placed under arrest since he is wanted in Holland, where he boarded the flight with a suitcase containing the drugs leading to his arrest. Therefore, a European country is not a suitable option. It appears that he will make his way home via Korea or the United States. Family members were relieved to learn that the prosecutor is not planning to appeal the verdict, clearing the way for his departure from Japan. Nevertheless, askanim explain that while the prosecution is not planning an appeal, the state may actually decide to appeal to the Supreme Court, and therefore, the tzibur is called upon to continue davening on Yoel’s behalf – that this should not be the case chas v’sholom. Firsthand Report From Japan Courtroom: Update On Acquittal Of Yoel Zev, Japan

Firsthand Report from R’ Aron Nezri and R’ Meilech Bindinger: Dear Yidden around the world; חסדי ד’: Bechasdei Shomayim, we and the defence attorneys are glad to report that the Chiba District Court ruled in favour of the defense, and handed down a full acquittal ב”ה for Yoel Zev נ”י. Immediately upon hearing this good news, we exited the court room for a few moments, to convey the besuro tovah to the multitudes of Acheinu Bnei Yisroel who were waiting in suspense for the outcome. Upon hearing the judges verdict we were choked with emotion and couldn’t elaborate. We can now, after closing of the court session, provide more details of what transpired today, try and reflect on the chasodim geluim, and pray for further siyatta dishmaye. Justice Prevails: We congratulate the Japanese Judiciary for diligently seeking the truth, and carefully analysing the many diverse element of defense, – many of which are new concepts to the Japanese – and thereby succeeded in delivering the long awaited innocent verdict.   Prior to Court Session: Ten minutes before the court session commenced, the leading defence attorney accompanied us to visit Yoel Zev at a meeting room under the court house. Through a glass pane we could communicate with Yoel Zev. It was difficult moments. We didn’t know what words can be said. Looming ahead was G-d forbid a possible guilty verdict of a 15 years prison sentence in addition to a penalty of ¥5,000,000.00 (equating to $65,000.00). After having experienced the disappointment of the verdicts handed to the two other bochurim, Yossy and Yakov Yosef, it was challenging to find the right words of encouragement.   (Yossy, the only juvenile of the three, received a sentence of 5 years, which was what the prosecution had requested from the Judges. Yossy has since been transferred to Israel, where his sentence was commuted under conditions and supervision of the Israeli prison authority. Yakov Yosef, the younger of the two adult bochurim, received a 6 year prison sentence from the 13 years demanded by the prosecution. He is pending transfer to Israel. The transfer procedure is well underway.)   What can one say to Yoel Zev moments before his verdict, after having faced the fact that his two friends were handed a guilty verdict? We tried our best to prepare him for every eventuality, carefully using only positive quotes of Emunah and Bitachon, and hoping and praying for the best. We were most relieved by Yoel Zevs attitude. Yoel Zev said in his innocent manner: “I don’t know what the material judge will tell us today, but the celestial Judge, shofet kol ho’oretz, will certainly rule innocent”.   Court Session: Upon the judges’ entry to the court room, and the customary Japanese bows, the Judge summoned Yoel Zev, using his first name ‘Yoel’ – uncommon in Japanese courts formalities – and asked him to stand at the pulpit directly in front of the judges. The judge immediately announced – in Japanese – the verdict: “You are innocent”. Our personal translator, sitting alongside us, quickly told us in jubilation the courts verdict. The court appointed translator then translated to Yoel Zev “Atah Zakai”. Upon hearing these words, Yoel Zev’s father, ourselves, and other yidden with us, shed tears of jubilation. Japan Court: Yoel Zev Found Not Guilty

A Japanese court has acquitted Yoel Ze’ev Goldstein of Bnei Brak, who together with friends was imprisoned for smuggling thousands of ecstasy pills in his luggage. Goldstein was arrested after a search of his baggage revealed 90,000 pills inside a false double wall. The bochrim have always maintained they thought they were transporting antiquities given to them by a chareidi man, and as a result, have since paid a heavy price. Since their imprisonment, askanim and rabbonim worldwide have been actively engaged in efforts to obtain their release, raising funds to hire the best legal team possible in Japan. One suspect remains in a Japanese prison, and the third, who was transferred to Israel to complete his sentence has since been released. It should be pointed out that the state has 14 days in which to appeal the court’s decision to release Goldstein. Somewhat complicating matters is the fact that immigration officials have taken him into custody on charges he overstated his 90-day visa in 2008. Attorneys are hopeful this matter will be rectified in an expeditious fashion and that he will be able to leave the country. According to a Kikar Shabbat report, Rabbi Elimelech Bindiger and Rabbi Aaron Nizri were present during the hearing, which they stated took two hours. At the end of the session, the court asked forgiveness from Goldstein, that he was compelled to remain in prison for four years. Tonight, 1:30AM EST: Yoel Zev’s Verdict In Japan

Tireless askanim are working behind the scenes to ensure that everything is being done on behalf of Yaakov Yosef ben Raizel and Yoel Zev ben Mirel Risa Chava. Yoel Zev ben Mirel Risa Chava is still imprisoned, awaiting his final verdict, which is scheduled for tomorrow, Monday, Erev Rosh Chodesh Elul, August 29, 1:30 p.m. Japan  time, 1:30 a.m. EST. With Yoel Zev’s verdict just hours away, all are asked to daven and learn for Yoel Zev ben Mirel Risa Chava. Over three months have passed since May 16, the fateful day when the Tokyo High Court denied the appeal of Yaakov Yosef ben Raizel and upheld the guilty verdict handed down by the Chiba District Court. As reported at the time of the verdict, there is a prisoner transfer agreement in place between Japan and Israel, and thus, according to Japanese law, a prisoner legally need not be held even one day in Japan, but can be transferred to his own country. The reality, however, is far different. Transfers usually take a long time, as was the case with Yossi, the youngest of the three boys who were arrested at Narita International Airport over three years ago. With Yaakov Yosef, who is not a minor, time was of the essence, as he was in very real danger of being sent to a harsh prison labor camp, where, aside from the great physical suffering he would have to endure, he would be unable to perform even basic mitzvos, such as keeping Shabbos and wearing tefillin. Askanim had no time to waste and immediately got to work setting the transfer process in motion, accomplishing in four weeks what usually takes several months to put into place. The initial step was for Yaakov Yosef to sign a waiver for any further appeal. Since Yaakov Yosef knew that once he signed this document he would officially be considered a prisoner of the state and would no longer be allowed visitors on a daily basis, he waited until his father left a week after the trial to sign the document so that he would be able to see him as often as possible until his departure. Complications also arose due to the fact that the appeal had taken place in the Tokyo district, but the detainee was being held in the Chiba district.  Thus, important documents needed to close the case were sent back and forth between the Tokyo High Court, the Tokyo High Prosecutors Office, the Chiba District Prosecutor’s Office, and the detention center. The lawyers and askanim were kept busy applying pressure to any and all parties involved, and they greatly succeeded in accelerating the process at an unprecedented pace in any such cases. The argument was that due to the detainee being held in the Chiba Prefecture, the case falls under the Chiba’s Prosecution Office’s jurisdiction. The Chiba Prosecutor’s Office claimed that the case was dealt with by the Tokyo High Court and was taken over by the Tokyo Prosecutor’s Office and, therefore, they are responsible for the case. This case was very unusual, as all detainees on trial in Tokyo are transferred to the Tokyo Detention Center. OUTRAGEOUS: Benzion Miller Who Sent Boys To Japan Being Released From Jail After Serving Only 8 Months

Benzion Miller, the man who sent the three boys on their trip to Japan, is scheduled to be released from jail tomorrow, after serving only eight months in the Matisyahu prison. The Tel Aviv District Court had sentenced Miller to three years behind bars, for his involvement in the drug smuggling story which landed three Bnei Brak Yeshiva Bochrim to jail in Japan. The families of the three Bochrim had testified against him in his trial. Miller was arrested in February 2008, and was believed to have been the mastermind in the case, sending innocent bochrim on a mission, planting drugs in their bags without their knowledge. As a result, they were incarcerated in Japan, under extremely harsh conditions. According to a report on Bichadrei, the parole board approved the early-release decision based on his good behavior in jail, and his previous time served while under house arrest prior to his sentencing. When asked what Miller plans on doing after his releases, his attorney said “my client will go to another city, and start a new life”. Meanwhile, the families are the two boys still languishing in Japan, are furious and outraged, and vowing that this travesty will not go unnoticed and quietly. Verdict From Japan: Yakov Yosef Ben Reizel

6:20AM EST: The following was written by Reb Meilech Bindinger, from the Tokyo High Court, Chamber 410: Dear Yidden around the world; We and the defence attorneys are upset to have to report that the Tokyo High Court failed to overturn the ruling of the district court. However, the presiding appellate judge did show leniency when calculating the credit for time served off the initial sentence. In total the judge deducted 814 days from the 6 year sentence, even though these days were spent al Hatorah ve’al havodah at the detention centre, and not in forced labour. The prosecution initially demanded a 13 year sentence. You may remember that an extraordinary sentence of 6 years was handed down in the district court, in addition to a monetary fine of 4 million ¥, this equating $50,000. The verdict of 6 years was based on the fact that the judges found reason to accuse that Yakov Yosef should have suspected something was amiss, and although he had no clear knowledge of any contraband, there was negligence on his part for not being more cautious. The judge claimed that the polygraph examination, whilst out ruling clear knowledge, does not prove lack of suspicion. The defence attorneys were dismayed at the callous nature of the judge’s dismissal of the defence arguments. Mr. Masaki, one of the lawyers, commented that the judge failed to glance even once at the lawyers during the verdict due to his lack of confidence with his verdict, and knowing that his verdict contains many illogical assumptions. For a number of reasons an appeal was filed, among them: 1) Yakov Yosef’s not accepting his verdict directly assisted Yoel Zev’s trial which is taking longer than expected due to court technicalities and changes of judges.  In Japan, not accepting the verdict is a powerful indication of the defendants and co-defendants claim to innocence. Furthermore, the appeal process brought to light substantial evidence for the defence of Yoel Zev who is scheduled to receive his verdict on 29th August. 2) Yakov Yosef was saved having to go to a forced labour prison camp during the appeal phase. The forced labour sentence allows virtually no free time for davening or learning. Yakov Yosef spent this time in the detention centre learning with great hasmodah. 3) The District Court failed to examine some of the strong evidence material, including the polygraph results. It was hoped that at the appeal trial these elements would overturn the verdict. Current Status: Efforts are being made to retain Yakov Yosef’s status at the Chiba detention centre until his transfer to Israel. We would want to avoid the forced labour at all costs. According to Israeli protocol, one third of the full sentence can be deducted, and the remaining time can also be commuted as per their discretion. According to this, Yakov Yosef could be out of prison within 10 months from now. Askonim are working towards this goal. Firsthand Report From Japan Courtroom: Closing Arguments For Yoel Zev

Firsthand Report from R’ Aron Nezri: At the Chiba district court, the closing arguments, being the final hearing for the third boy, Yoel Zev, began at 10am local time. Yoel Zev was brought in at 9:55 accompanied by two guards and was seated on a bench in front of the defence teams table. In order that Yoel Zev should understand the proceedings, an earpiece that is connected to the court appointed interpreter microphone, was placed on Yoel Zev. The judges walked into the court room and bowed down, as is in Japanese custom. The presiding judge first announced that the court rejects the recent evidence being the expert opinion by a graphologist – a handwriting expert, that determines that Miss Suzuki’s recent evidence has been forged. One change in the room was, having a new minor judge and a new prosecutor.  The new minor judge who has never worked as judge before and is very young has now replaced the last minor judge of the three previous judges, led by presiding judge Furuta, a hardliner that has never acquitted someone  before. Yoel Zev quoted after the trial, that last year chol hamoed succos, he attended one of his pre-trials and was given the arba minim after the hearing and with the permission of the judge, he made a brocho loud and was shaking it in fron of the old panel of judges. He now says “Ich hob geshokeled in geshokeled and they have all disappeared”. The proceedings began at 10:05 with the prosecutor starting to read out his closing arguments. It was 10:32 when the prosecutor concluded that due to Yoel being older in age and wasn’t a minor when he entered Japan, he deserves a longer punishment and a heavy fine – a 15 year prison sentence and a 5 million yen fine ($62,000). Upon hearing this, yoel stayed calm and the chief defence lawyer Mr Miyake stood up and started his part of the defences closing argument, followed by Mr Nakamura and Mr Takano. At 12:55 Mr Takano concluded and Mr Miyake stood in front of the judges and gave his final words to the judge in relation to Yoel Goldsteins suffering and innocence. When the procedure was concluded, the judge asked Yoel to stand up and asked him if he wants to say something to the court, being his last opportunity. He replied yes, and asked the judge allowed him to sit down rather then stand as all defendants do. Yoel started by saying; “Honourable judge, I have been observing the biblical orders from my Almighty since I was born. I have prayed at least three times a day since my childhood. I have always been an honest, studious, hard-working and good person. I spent most of my spare time in hospitals, to assist, and bring joy to sick and elderly patients. I have never hurt anyone in my life. I would never do something that could cause a person pain, illness or death. It was my duty, great honor and pleasure to study the Jewish law in Israel and I continued to study the same even in the small cell of Chiba Detention Center in Japan. Closing Arguments For Yoel Zev Tonight In Japan

Closing arguments will be held in the trial of Yoel Zev ben Mirel Risa Chava 12:30 tonight (EST) which is tomorrow, Thursday, May 12th, 1:30 PM Tokyo time. At the closing arguments, the three defense lawyers, Mr. Miyake, Mr. Nakamura, and Mr. Takano will argue the main points in favor of the defendant verbally before the judges. Each of the three attorneys is responsible to address a different aspect of the defense effort and will present the proofs supporting his position to the court. Mr. Miyake is handling the aspect of the boys’ sheltered upbringing which resulted in their not even knowing of the existence of narcotics to the extent that they were not aware that the word “Sam” in Hebrew connotes anything other than poison, as Rabbi Niederman and the principal of the boys’ Yeshiva testified in previous hearings. Mr. Nakamura will go through Yoel Zev’s personal testimony of the events as they occurred step by step, and Mr. Takano will address both the polygraph issue and the “blind mule” issue as per former DEA Michael Levine’s testimony.  Some of the points that will be included in the closing arguments are:  The absolute trust that the boys had in the individual who sent them, a well known and respected personality within their circle, to the point that it was actually considered an honor to do a service for him. The fact that the only languages the boys are familiar with are Yiddish and Lashon Hakodesh, but not Modern Hebrew.  Thus, even when confronted with the shocking discovery that there were white pills rather than antiques in their suitcases, they boys were disbelieving when told that they were “sam”, which to their mind simply meant poison.  The actions of the three boys in Narita International Airport clearly indicated that they were blind mules (unwitting carriers) vs. witting mules (knowing carriers).  The fact that they were willing to do the job for only $1,000.00 clearly proves that they did not know they would be carrying drugs.  Further, they used their true names and passports, went on the same line at customs, and wholeheartedly agreed to undergo polygraph testing.  Yoel Zev even tried to open the false bottom to show the inspector that he had antiques concealed within! All three boys passed the polygraph test with the definite result of “no knowledge”.  The expert testimonies of Dr. Yamamura, Japanes polygraph expert, Dr. Beaber, American polygraph expert, and Professor Ben-Shachar, world – renowned Israeli polygraph scientifically confirmed that they had absolutely no knowledge of what was in their luggage. World Famous Badchan R’ Yankel Miller Visits Jailed Boys In Japan

Rabbi Yankel Miller (a.k.a. Yarme Rov) Shlita, the famous badchan of Monsey,  made a surprise visit this week to Japan to visit the jailed bochurim, in an attempt to give them a boost of chizuk before Pesach, which they will be spending on their own. Rabbi Miller had planned to go during the winter but due to the many visits the boys often receive, he decided to go when they really have nobody to visit them, that being when everyone is preoccupied with hectic Pesach preparations. Rabbi Miller departed New York on Tuesday morning May 12th and arrived Wednesday morning May 13th. The devoted askonim had pre-arranged a schedule of visits for Rabbi Miller together with the various lawyers during his full two day stay, which enabled him to spend many hours with both bochurim at the detention centre. Rabbi Miller reports that he was stunned to find both Yoel and Yakov Yosef in such a good state. “I thought I will see two broken sad boys, but in fact they were so alert and bright and full of emuna,” “They actually gave me chizuk. I can’t see how any of us would survive such conditions for 3 years! and yet they are always with a smile and so thankful to the askonim”. Rabbi Miller reports “I spent time with both boys discussing divrei Torah and divrei chizuk, and obviously I did my share in doing my part as a badchan, and you can imagine what happens when I was telling them my stories! They really enjoyed the light humour and I feel they came away invigorated. Rabbi Miller met with various lawyers during his visits at the detention centre and confirms of the major work the askonim are doing. “Its unimaginable, the askonim just don’t sleep at night they are basically in Japan all the time”. “Both boys are Boruch H-shem very fine. They were dressed very well and have lots of seforim with which they keep themselves busy. The askonim keep on sending them seforim, story books, magazines, and they receive newspapers too. Rabbi Miller was amazed to hear from the boys that they receive so many letters from all over the world. Yakov Yosef told Rabbi Miller “to be honest, I get so many letters I just don’t have time to reply to them.” Yoel Zev received in the past two weeks alone almost 100 letters! Rabbi Miller departed Japan for NY on Thursday evening where he arrived home for Shabbos Hagodol. The closing arguments for Yoel Zev is scheduled for May 12th and the final verdict for Yakov Yosef is scheduled for May 16th.
