A federal judge on Monday said U.S. Sen. Lindsey Graham must testify before a special grand jury in Atlanta that is investigating whether former President Donald Trump and his allies broke any laws while trying to overturn his narrow 2020 general election loss in the state.
Attorneys for Graham, a Republican from South Carolina, had argued that his position as a U.S. senator provided him immunity from having to appear before the investigative panel and asked the judge to quash his subpoena. But U.S. District Judge Leigh Martin May wrote in an order Monday that immunities related to his role as a senator do not protect him in this case.
Fulton County District Attorney Fani Willis opened the investigation last year, and a special grand jury with subpoena power was seated in May at her request. Last month she filed petitions seeking to compel testimony from seven Trump advisers and associates.
Prosecutors have indicated they want to ask Graham about phone calls they say he made to Georgia Secretary of State Brad Raffensperger and his staff in the weeks following the election.

In a just world the Congress would impeached and remove her from office for this outrageous attack on its privileges. But in this world our senile tyrannical president is likely to give her a medal.
The use of the criminal justice system for political purposes is typical of a so-called banana republic.

So now the new normal is that you are excused from complying with a court order issued by a Judge nominated by a President who you disagreed with, characterized as “illegitimate” or otherwise has issued adverse decisions to your chavrusah. This seems to be a reasonable interpretation of what the founding fathers intended and consistent with originalist constitutional jurisprudence.

Then why not ask Georgia Secretary of State Brad Raffensperger himself? For that matter, why don’t they get the phone recording (as is known, Trump’s call was recorded and released)?
Why shouldn’t Lindsey Graham testify? If he’s done something wrong he has the protection of the 5th Amendment against self incrimination. I myself have testified before grand juries several times with no repercussions.

Here’s the key quote from her so-called ruling, as per Politico: “[T]he Court finds that the District Attorney has shown extraordinary circumstances and a special need for Senator Graham’s testimony on issues relating to alleged attempts to influence or disrupt the lawful administration of Georgia’s 2022 elections,” U.S. District Court Judge Leigh Martin May wrote in a 22-page opinion rejecting Graham’s effort and sending the matter back to state courts for further proceedings.
Do you see that? “Extraordinary circumstances and a special need”. As if that is enough to override THE UNITED STATES CONSTITUTION! It doesn’t matter how extraordinary the circumstances are, or how great the need for his testimony, you are NOT ENTITLED TO IT. Even if not getting it will have terrible consequences, it simply doesn’t matter. The constitution says congressman have absolute immunity for anything they say in connection with their congressional roles. Absolute means absolute, not conditional on your special needs.
Filthy corrupt judge. Maybe SHE should be prosecuted for this, and when she claims absolute judicial immunity (which isn’t even in the constitution, it’s just something the courts invented for themselves) we should tell her that the circumstances are extraordinary and the need is great, so she should shut up and go to prison where she belongs, together with Garland, Holder, and both Clintons.
GHD, the court order is illegal, and the reason not to testify is to protect the principle of congressional privilege.
