New York “Exploring Its Options” After Judge Strike Down Healthcare Worker Vaccine Mandate


The New York State Department of Health is “exploring its options” after a state Supreme Court judge struck down a statewide mandate requiring health care workers to be vaccinated against COVID-19, the agency said Saturday.

Judge Gerard Neri wrote in a ruling released Friday that Democratic Gov. Kathy Hochul and the health department overstepped their authority by mandating a vaccine that’s not included in state public health law, the Syracuse Post-Standard reported.

The mandate is “null, void, and of no effect,” the judge said. He sided with Medical Professionals for Informed Consent, a group of medical workers impacted by the vaccination mandate.

The mandate protects people most at-risk for serious symptoms and the people who care for them, the health agency said in a statement to The Associated Press.

“The requirement is a critical public health tool,” the agency said. “The State Health Department strongly disagrees with the judge’s decision and is exploring its options.”

  1. So NYS as turned to “conspiring on scheming” how to double down mandatting what many RNs & MDs don’t want. Don’t worry, we have an excess of those to meet any health to meet any health care shortage and avert a bigger crisis.

  2. It is too late to mandate the vaccine in general as most people already have immunity.

    If they care about protecting patients, and not just politics, the right policy would be to have only personnel who had a vaccine or a sickness within last, say, 4 months to work with vulnerable patients. To protect “privacy”, it could be simply computer deciding who should be working with particular patients,

    Can anyone explain what they’re trying to say? If it is known by all and admitted by all that the vaccine DOES NOT PREVENT ONE FROM GETTING COVID, how does the mandate protect people most at risk (ie the vulnerable patients)? And how are you protecting the people that care for them if they’re not severely at risk even if they get covid, which they will get or not regardless of vaccination status?
