Chief Rabbinate Supreme Beis Din to Respond to High Court Over Bris Milah Case


brisIn a hearing addressing the ongoing controversy surrounding the bris milah of a one-year-old boy, the Supreme Court on Tuesday 25 Adar I 5774 instructed the Chief Rabbinate Supreme Beis Din to respond within seven days regarding the matter of the latter’s jurisdiction in the case.

The case involves a divorce dispute and a father’s plea to have a bris performed on his son and the mother’s refusal. The nation’s highest beis din ruled to have a bris performed and this was overturned by the secular Supreme Court, with the latter ruling the Supreme Beis Din lacks jurisdiction in the case. Making the case increasingly difficult for the father and the beis din is the fact that Attorney General Yehuda Weinstein sides with the mother against performing a bris. Weinstein submitted an opinion to the High Court, stating he feels the Supreme Beis din exceeded the scope of its authority with its ruling.

  1. @ Chuck Schwab: The fact that the Israeli Supreme Court is not ruling in accordance with halacha does not demonstrate that it is anti-semitic-Israel is not a relgious country and is not governed by halachah. The do have bais-din but the Supreme Court is goverened by secular law. Their ruling was entirely consistent with the secular law they rightfully applied to this case.
