Rishon L’Tzion Releases A Unique Psak Halacha For Those Unable To Get To A Minyan


1Rishon L’Tzion Rabbi Yitzchak Yosef Shlita has released a psak halacha that permits soldiers, hospitalized patients and other who are ‘Anusim’ and cannot get to a shul and daven with a minyan to daven at home or in their base via live internet broadcast with a minyan and respond “Amen” and recite Kedusha and this is regarded as if one participated in a minyan. Rav Yosef stressed this is just for a b’dieved and for ‘anusim’ (בדיעבד ורק לאנוסים).

“בשעה שהם מתפללים – יתפלל אתם יחד מילה במילה, אומרים את העמידה – יעשה אתם את העמידה בלחש, זה נקרא תפילה בציבור”.

Rav Yosef explains “When they are davening, he should daven with them, word by word, recite silent shemoneh esrei and this is regarded davening with a tzibur”.

The rav stresses the limited applicability of this, and that it is b’dieved, as one is required to get to a shul and one who is capable of this may not rely on this psak.

However, one who must may listen to a live broadcast from a shul and participate in the minyan.

  1. Does his Pesak include reciting י:ג מידות during Selichos? How about Megillath Esther? Is this a Pesak transmitted from his saintly Father? His Pesak shows his tremendous Ahavath Israel for feelings of those housebound.

    Question — suppose that another posek that did not have tremendous ahavas yisroel came up with the same psak because he thought that m’ikar hadin this was perfectly ok. Or suppose another posek with equally tremendous ahavas yisroel thought that this psak could not be justified l’halacha, and paskened otherwise.

    If these two situations are both imaginable, then how could you conclude from this psak that this posek is a tremendous ohev yisroel? I’m sure he is, but isn’t this psak just about the halachose involved (shome’ah k’oneh, tzirruf, etc)?

  3. Is there a link to the actual text of the psak? Internet streams are significantly delayed-possibly several seconds for a live broadcast (not direct Skype type), and even phone calls have a quite audible delay of about half a second. Is there any halachic difference?

    What about watching or hearing a shiur where they recite kaddish and/or brochos – does one answer?

  4. this is davenning בשעה השציבור מתפללים and the אמן is like they answered אמן by raising the flags because the big ציבור couldn’t hear the ש”ץ
