Yitzhar Resident Acquitted On Charges Of Incitement To Harm IDF Soldiers


Petach Tikvah Magistrate’s Court Judge Oded Moreno acquitted a resident of Yishuv Yitzhar in Shomron on charges of incitement to harm IDF soldiers and insulting a policeman on duty, after he allegedly called him a “dog”.

Justice Moreno heard the arguments of defense attorney Eli Benaya, who presented examples of selective enforcement by the police and the State Prosecutor’s Office, which is quick to blame residents of Yehuda and Shomron and does not act similarly towards others. Among other things, examples of harsh statements were presented by Ofer Cassif (Hadash-Ta’al), even before he became a MK – statements that have been examined by the State Prosecutor’s Office for years, while nothing has been done.

The judge presented the examples on the subject regarding Cassif, who among other things said that “Ayelet Shaked is a Neo Nazi scum” and “harming soldiers is not terror” and more.

In his decision, the judge wrote: “As I mentioned at the outset of this decision, I reached the conclusion that the defendant should be acquitted of the offenses attributed to him in the indictment, due to the lack of an operational legal existence and in view of the conclusion, that the elements of the offenses did not exist. To this I add that in my opinion, the defendant was event brought up in a case of a just defense, pointing out selective enforcement regarding the charges that could lead to the cancellation of the indictment… This leads to a legal result of acquittal”.
