The Jerusalem Magistrate’s court on Monday ruled the family of the Sbarro Pizzeria terrorist who murdered 15 people in the 2001 suicide bombing attack is not entitled to compensatory damage for their Jenin home which was destroyed.
Justice Yoel Tzur, the vice president of the court, ruled the sealing and razing of the terrorist’s home was a legal act of war and therefore, the Government of Israel is not compelled to make any compensatory payment to the family of Shuheil el-Masri.
Rejecting the claim, the court added the IDF acted responsibly in carrying out its mission, taking great care to ensure that the home was vacant, adding the family was given ample time to vacate before the demolition order was actualized. He further stated the IDF did everything possible to minimize collateral damage and any injuries to civilians in the surrounding area, totally rejecting the plaintiff’s motion.
