Apprently according to almost all Rishonim and Achronim, this only applies when a person ate something that he was halachically not allowed to eat at the time, not something that he was allowed to eat when he ate it.
There is a fundamental difference between eating some where there is a “dIchui” of an issur and something that is absolutely muttar l’halachah — even if not b’metzius — at the time.
