High Court Intervenes And Saves the Home of a Terrorist Who Murdered an IDF Soldier


amogThe High Court of Justice on Tuesday, 19 Kislev, canceled the demolition order for the home of the terrorist who murdered IDF soldier Almog Shiloni HY”D in a stabbing attack near the Haganah train station in Tel Aviv in November 2014.

Justices Elyakim Rubinstein, Mani Mazuz and Tzvi Zilbertal ruled that making the decision to destroy the home 11 months following the attack is not within a reasonable time period. Justice Rubinstein was the minority opinion, voting in favor of razing the home of the terrorist.

Justice Mazuz wrote the state is compelled to act within an acceptable timeframe and this time frame, almost a year, has lapsed.

Justice Zilbertal argued that razing the home now will not serve as a deterrence for other terrorists due to the considerable delay and as such, exercising authority at this stage would be “unreasonable and inappropriate”.

  1. The houses of these judges should be razed for their stupidity. No one dumber than Israeli liberals who are closely followed by American Jewish liberals. The same eiriv rav that existed in the midbar are still around today.

  2. Well done to eierav rav well do ..can’t agree more with profp.this teachs them that they can get away with killing people and now there house wont be destroyed but on the contrary but a jewish family’s heart

  3. Actually, the Supreme Court has repeatedly and regularly upheld decisions to raze the houses of Terrorists; only rarely has it intervened against such demolitions.

    Justice Mazuz has long been an opponent of such demolitions and has written a few dissenting opinions on the matter since being appointed to the court. This time he prevailed. It will be interesting to see if the AG petitions the Chief Justice to conduct a rehearing of the case (diyun nosaf).
