Lapid Petitions Israel’s High Court Against Cabinet’s Request For An Extension In Legislating A New Draft Law


Yesh Atid party chairman MK Yair Lapid, petitioned the High Court of Justice on Monday, 4 Menachem Av, against the cabinet’s petition to the court seeking an extension in legislating a new draft law.

Prime Minister Binyamin Netanyahu decided to comply with the demands of the Agudas Yisrael faction of Yahadut Hatorah and request an extension of seven months in legislating a new law to avoid Agudah breaking from the coalition.

Lapid, whose party voted for the law despite being in the opposition, is unwilling to tolerate additional delays in arranging a new law to provide a legal designation for chareidim regarding military service.

Lapid said: “After Netanyahu asked the IDF and the Defense Ministry to write the draft law, he again gave in to the chareidim. What should be put off? What is not clear? The IDF wrote this law, and the chief of staff signed it. Yesh Atid petitioned the High Court of Justice, stating it feels there is no justification for postponing the law, and doing so is another shameful surrender to the chareidim, and they have had enough time.”

In response to the State’s request to extend the date of the petition, Yesh Atid calls on the High Court of Justice to reject PM Netanyahu’s request, stating that “Yesh Atid sees great importance in finding a solution without delay that will lead to the recruitment of yeshiva students. A real last resort, as the state explains, since there is nothing to prevent the continuation of the legislative process during the Knesset’s recess, especially in view of the importance of the issue.”

The respondents contend that “it is necessary to allow the government and the Knesset to complete the legislative process. The government ignores the fact that the respondents refrained from taking advantage of the long period of time that was allowed to settle the issue and therefore, leaves sufficient time for all the relevant parties to act in order to realize it in practice. In view of the fact that two months have passed since the completion of legislation passed on first reading, there is no justification for the request for granting extension”.

  1. Who had long period of time? Not the chareidim as they were not part of the committee and only got the draft very recently. Had the chareidim been part of the draft committee a solution may have been worked out before presenting it to the Knesset.
