NYC: Occupy Protester Files Civil Rights Lawsuit


An Occupy Wall Street demonstrator videotaped in a police altercation has sued the city and a police official.

The lawsuit by Felix Rivera-Pitre was filed Thursday in federal court in Manhattan. In it, he seeks unspecified damages against the city and Deputy Inspector Johnny Cardona.

The lawsuit says the police official deprived Rivera-Pitre of his Constitutional rights of free speech and expression during an Oct. 14, 2011 march near Zuccotti Park in lower Manhattan.

Rivera-Pitre alleges the officer punched him in the head. Police have said Rivera-Pitre tried to elbow the officer in the face. Rivera-Pitre says he did not.

A city law office spokeswoman says the lawsuit will be reviewed once it is received.
