Unusual Chometz Alert For Lakewood Residents


granola.jpgResidents living in Lakewood should be aware of the following unusual Chometz alert. Apparently, the local Shop-Rite supermarket, has chosen to send out a promotion to all of their loyal Lakewood customers: Granola Bars, which are Chometz.

The promotion arrived in the mail to many residents on Erev Yom Tov, and many others received it on Yom Tov.

Should you see it in your mailbox, please contact your Rov as what should be done with it before picking it up.

  1. Many sale contracts include “chometz items in transit” so this item in the mail would be part of the mechiras chometz. The item in the mail does not belong to you just because it is in your mailbox or home.A goy who brings his chometz lunch to your home does not cause you to own it.If you did not pay for it,it isn’t yours.

  2. Many chometz sale contracts include “chometz items in transit”. A goy who brings a chometz lunch with him when he comes to your home,may eat it or keep it in your house. An item unsolicited by you and not paid for does not automatically become yours if it is in your mailbox or property.Give the item to a goyish neighbor or throw it in the garbage (outside).

  3. This type of “marketing promotion” seems to take place every Pesach, and is not unique to Lakewood.

    I have been “blessed” several times with little boxes of Cheerios and other similar “promotional products” which appear on my front lawn on Pesach.

    To include Chometz in Transit it first has to be yours and the Chometz in transit that someone else is sending you isn’t yours since you didn’t make a ‘KINYAN’.
    2nd Point: The Halacha Is that Money isn’t a ‘KINYAN’ as far a ‘METALTALIN’ as opposed to real property that can become ‘HALACHACLY’ yours thru money, But on the Contrary one of the Kinyanim that ‘METALTALIN’ can become yours is thru ‘CHATZER’ were the mail box certainly fits the criteria, the only thing is that you don’t want to be Zoche in this Object but then it might depend if ‘CHOTZER IS KONEY MIDIN YAD OR SHLIAH AND IF THE DIN OF EIN CHOVIN LEADAM SHLO BEFANAV’ ask your rabbi
