Feiglin Demands Permit For Jews to Daven on Har HaBayis


Moshe Feiglin, who heads the Manhigut Yehudit (Jewish Leadership) faction in Likud, is calling for a rally to demand an end to religious discrimination against Jews on Har HaBayis.

“Recently, Israel Police have prohibited 18 mispallalim, among them Temple Institute founder Rabbi Yisrael Ariel from ascending to Har HaBayis. Prime Minister Binyamin Netanyahu has already made a written commitment to allow Jewish prayer on the Temple Mount. We demand an end to this discrimination! Allow Jews to worship on the Temple Mount!” the advert for the event reads.

The event will be held on Wednesday, 28 Tammuz 5772 in front of the Prime Minister’s Residents in Rechavia at 17:15. Rabbi Ariel will be among the rabbonim addressing the event, which will end at 19:00 to permit participants to take part in the monthly erev rosh chodesh walk around the Old City walls (Sivuv Shearim).

It must be noted that according to the Poskei Hador one is absolutely forbidden to visit the Temple Mount, and there is an Issur Kares for one that goes there.

Three years ago on Sukkos, Israeli President Shimon Peres paid a visit to the Sukkah of Maran Hagon Rav Elyashiv Shlita, where Rav Elyashiv called on the President to prevent Jews from visiting Har HaBayis, stating it is an act that that is viewed as extremely provocative by the goyim. Maran stated everything possible must be done to avoid a religious war, and the provocateurs are playing with fire.

Maran is quoted as explaining to the president that Halacha forbids going onto Har HaBayis but today, it is more than this, it is an act that may lead to a religious war and bloodshed.

  1. There are definitely parts of the Har HaBayis that are all would agree are theoretically not assur for a Tamei Meis to go on – so long as all other forms of Tumah are removed. There is a major Machlokes as to whether one should go onto the Har HaBayis at all in today’s day and age, given that we don’t know precisely where those parts that are Assur are.

    Those who Asser going onto the Har HaBayis say that we can not take the risk that one might accidently go into one of the Issur areas, or the risk that those who don’t know what they’re doing might go onto any part of the Har HaBayis while Tamey with one of the forms of Tumah that make going into any area on the Har assur. Those who are Matir say that while we don’t know exactly where the areas that are Assur are, there are areas that we know were definitely NOT part of the Assur areas, and one who has prepared can go there. With respect to the concern of the ignorant going up while being Tammey with other forms of Tumah, the Matirim say that (a) this should be addressed through education and, in an optimal situation, with Jewish guards that would enforce their not going onto the Har, and (b) because of the risk of the loss of control of the Har HaBayis to the Arabs, it is important to go up in any case.

    The breakdown of views is largely (though not entirely) between Chareidi and Dati Leumi Rabbanim, with great Talmidei Chachamim on both sides. Each individual should follow the view of his Posek – but it is to the credit of YWN that they mention when Rabbonim on both sides issue their views on this issue.
