A petition was filed with the High Court of Justice by the family of Mohammed Abu-Khadir, the Beit Haninah neighborhood youth from the capital was who abducted, beaten and burned alive by Jews in 2014. The court this week discussed if the policy of razing homes, a policy used against families of Arab terrorists, would extended to ‘Jewish terrorists’. One of the murderers convicted of the attack was sentenced to life imprisonment and associates received lesser sentences.
Attorneys for the Abu-Khadir family explained to the court there must be one law for all and the state cannot maintain a double standard. Justice Neil Hendel responded “It doesn’t matter to me if it is a Jew or an Arab”, citing the policy of home destructions is used in the hope of preventing future attacks and loss of life. they argued that even if there are a few, a handful of Jews planning murderous attacks, the destruction of a home would serve as a deterrent to others as it does in the Arab sector.
While the others justices, Zilbertal and Rubinstein were inclined to agree, the state maintains the policy should not be used against Jews for it has not in the past and is not necessary today. The state added that if chas v’sholom there was a wave of Jewish acts of terror, then such a policy would have to be considered.

Tearing down homes of terrorists is a tactic the Israelis acquired from the British (who used in first in Ireland, then throughout their Empire). It has a proven record of being totally ineffective other than in making people more mad at you than before (note that Ireland is a totally independent republic, and the British Empire made it to the “dustbin” of history a long time ago).
They should allow the victims to sue, and win possession of the property of the terrorist (and a lien against future earnings, if any).
will the high court just make it up as they go along? yes, indeed! they don’t follow Torah, nor a constitution, nor answer to constituency. they follow their elitist noses to their fellow travellers in Europe, the enlightened high thinkers.
its bad enough when judges in the USA ignore the pshat of their founding documents. these Israelis get to write opinions with crayons.
Bad enough they beat the daylights out of an innocent Jew to confess to something he didn’t do to please Arabs and hush their riots, tearing down his home would be a serious injustice and crime against humanity.
