NYC: Dealing With Unwanted Flyers And Circulars


IMG_6678.jpgAs many New Yorkers are aware, there are many fliers & circulars dumped in front of homes, businesses and apartment building lobbies. Finally, members of the NYC Council (members: Felder, Brewer, Comrie, Liu, Nelson, Weprin, Fidler and Oddo) have decided to pass a law curbing the distribution of unwanted circulars. The following is Intoroduction 427 from the NYC Council website:

Introduction 427

A Local Law to amend the administrative code of the city of New York, in relation to the distribution of unsolicited printed material to any building or premises and to repeal subdivision five of section 16‑118 of such code.

Be it enacted by the Council as follows:

Section 1.  Subdivision 5 of Section 16‑118 of administrative code of the city of New York is REPEALED and a new subdivision 5 is added to read as follows:

5. (a)  It shall be unlawful for any person to distribute or cause to be distributed any unsolicited printed material to any building or premises that has posted a sign stating that unsolicited printed material is not wanted.

(b) Any sign posted pursuant to paragraph (a) of subdivision 5 shall state the following in letters at least one-half inch in height: “This building does not want to receive any unsolicited printed material.” Said sign shall be securely placed on the building within three feet to the left or right of the building entrance and no less than four feet nor more than six feet from the ground.

§2.  This local law shall take effect immediately.

  1. FANTASTIC! These guys come in a truck about 2pm every Friday. They then have a line of men and women with shopping carts take thousands of these and scatter them everywhere. I would bet that 50% of the trash on the street is due to this “little”.

    Let’s say a building has 8 apartments in it, then they leave 8 “packs” of flyers on the front step, most, which get blown away. I have been complaining to the city about this intrusion, and now they did something.

    The streets on shabbat will be cleaner too.

  2. This may work for Commercial or Apartment buildings. But, as annoying as these circulars are, not many people would want to display such a sign on the front of their private homes? This bill has to be revised to make it easier for Private Homeowners to avoid this junk.

    What about them?
    There’s nothing wrong, and just cause you say that they’re unwanted, it doesn’t mean everyone else does.

  4. First of all was the law amended to reflect the this change?

    Secondly, once one does post such a sign stating that one no longer wants the unsolicited mail, if one does continue to receive such mail how does one take action? calling 311?

    correct the spelling for the word Introduction not intOroduction in the 1st paragraph.

  5. At least now we won’t get unwanted flyers from Chinese food stores,Evangelist groups, car washes,gyms,etc. They should also enforce the law against posting ad papers on stsreet lamps. There should be a law that forbids these flyers to be put in any home that is 3 or less apartments,Religious and public buildings,but permitting supermarket flyers . The same law should be enforced against flyers put on windshields of cars. Political flyers should be included,too. If someone wants to give out flyers,he should hand them out to people on the street to those who willingly accept them,and there should be a large garbage opail right next to the person. “a cleaner neighborhood is up yo YOU! Also,ALL flyers that have indecent pictures or illegal activities must be banned. Any fliyer found littering the street,that has an address and/or pnone# or e-mail address on it,the police should have the right to issue a summons to the party on the flyer.

  6. does it include campaign materials – near election day, everyday many flyers are left by the door. my guess is that they exempt themselves from this law.
