Israel: Court Rules in Favor on Orphan Terror Victims


Tel Aviv Labor Court Justice Ariela Kitzer-Katz last week ruled in favor of seven petitioners, all of whom lost both parents in terror attacks. They maintained that they are entitled to a double state-given marriage grant for terror victims who lose a parent since they lost both parents.

Bituach Leumi (National Insurance Institute) did not agree, and was unwilling to make the double payment, amounting to NIS tens of thousands. Bituach Leumi was wiling to pay the regular grant however.

The court ruled the devastation, pain and suffering were considerably more for the loss of both parents, ruling in favor of the petitioners.

Claims were filed by:

*Shlomit Horowitz, whose parents Eli and Dina were murdered in their Kiryat Arba home on March 7, 2003;
*Leah, Tzofia and Yeshurun Gavish, whose parents David and Rachel were murdered in an Elon Moreh terror attack on March 28, 2002. A brother, Avraham, and a father-in-law, Yitzchak Kanner, were also murdered;
*Tzvi and Tzofia Dikstein, whose parents Rabbi Yosef Yaakov and Chana were murdered in the Chevron Hills along with a 9-year-old son Shvu’el Tzion on July 26, 2002;
*Neta Halevy, whose parents Rafi and Helena, along with others, were murdered when a bomber disguised himself as a Jew and received a ride from them near the entrance of Karnei Shomron on March 30, 2006.
