    1. Apparently the Hamas is not as fearful as the Iranians (who do not yet have missiles that can reach Israel from their country) and Syrians. Moreover, the fact that the IDF and Shabak have freedom of action in Judea-Samaria prevents many terror attacks.
    2. According to international law a country may annex land taken in a defensive war. In any case, J-S (as well as Jordan) was set aside by the San Remo agreement as part of the Jewish state. There are also precedents for expelling hostile populations (e.g. the Greek-Turkish population transfer of 1923 of the expulsion of the Volksdeutsche from several European countries after WW2)
    3. J-S is ours according to Hashem’s law.

    CS, if it was out of character maybe he did not exactly say that. Rabbanim very often make nuanced statements that different people hear according to what they want to hear. Once some people took a dispute to Rav Tzvi Yehuda Kook. As soon as they left they argued over what he said.

    CS, what is an “act of Pinchas”? A woman entering a shul during a chachnasat sefer Torah is not listed as one of the jobs of a kanai. Does that mean that if the guard had shoved him back she would have been justified? It may have been a maaseh Rav Ada bar Ahava (Berachot 20a) but then he might have to pay her a large sum of money as compensation (ibid).

    AJ, personally I think that in general the rules of the “Torah wing” are criminal coddling. I even heard from a relative of his that a certain “rav” is very happy there as he has a chevruta with another “rav” and so far they have learned 200 pages of Gemara.

    646, they have only themselves and their “leaders” to blame. In 5708 they could have gotten even more but they refused. Arafat ym”s could have gotten 99% but he refused. According to pols the vast majority support terror. Those individuals who are willing to live in peace live very well. I live on a settlement so I see their houses and cars. I see that some of the Arab workers in an area supermarket even have supervisory jobs. In fact, yesterday I saw an Arab woman walking alone in the middle of my settlement (no Jew could do that in any Arab village) . When I asked someone about her I was told that she is a doctor in the clinic.

    CS, I looked him up and he seems to be a reputable rav so I cannot believe that he said what you claim. In fact, Rav Chaim Pinchas Scheinberg said that if he had a nickel for every time he was misquoted he would be a rich man. When someone complained to Rav Moshe about the Chatam Sofer being misquoted he said “People misquote me and I’m still alive”. Even in the Gemara there are arguments between chachamim over what tehre rav said with each swearing that he was correct. In any case, Schlisel is clearly an extremely disturbed person. I would classify him as Chareidi except in the colloquial sense. The same goes for “Chareidi” fraudsters.

    1. Jordan was carved out of the British Mandate of Palestine in 1922 in violation of the San Remo agreement.

    CTL, the point is that a person without criminal law experience needs a period of time to learn the ropes.

    Iacisrmma, a Class B felony is much more serious than a misdemeanor. Moreover, as it was an attempt the crime attempted was a Class A-I felony.

    Yitzchokm, I did not find the exact formulae but I did find on NOLO that there are algorithms for bail. I also found on the websites of the Storobin Law Firm and Shalley and Murray that over $5K for misdemeanors is very rare. As Casey Stengel said, you can look it up.

    Unfortunately, “Chareidi” has become an quasi-ethnic group complete with identification politics (see the complaints about Judge Freier) as has “Chiloni”. Rav Kook decried this in Massa haMachanot and wrote that it prevents teshuva as the former think that they are without sin and the latter think that a religious concept does not apply to them. IMHO, this may have been Acher’s mistake.

    Iacisrmma, you obviously have no clue regarding the NYC court system. Except in the Bronx, where the two were merged on the criminal side because of a huge backlog, Criminal/Civil court is separate from Supreme Court Criminal/Civil division. The former handles arraignments and non-felonies (Criminal) or lesser monetary claims (Civil). The latter handles more serious cases. This is in line with Yitro’s advice to Moshe (the latter changed it because din peruta din meah).
    As for the 19 year old, you did not specify exactly what he did and why. Depending on the circumstances it could have even been a Class A-I felony, which is a potential life sentence. Afzal, on the other hand, was originally only charged with misdemeanors.

    1. You are correct that criminal law is covered by the bar exam but it is insufficient. This is why new ADAs get in-house training. Moreover, as the score is for the exam as a whole theoretically someone could fail the criminal law part and still pass the exam.
    3. Both Abarbanel and Rav Hirsch say that the people should at least choose the judges on the Great Sanhedrin but they disagree as to whether they also choose the lower court judges or the Great Sanhedrin appoints them. BTW, while Civil Court judges are elelcted Criminal Court judges are appointed by the Mayor.

    Philosopher, I already posted that prosecutors ask for more than they think is necessary and defense attorneys ask for less. This is SOP in negotiations.

    000646, not if they do not belong there. Besides, do you think that they will govern themselves should they be given a state c”v? Both the Abbas regime and Hmas are brutal kleptocracies that trample on basic civil rights. Moreover, Abbas is 83, in very poor health and has no successor. This means that when he goes the way of all flesh there will be a very nasty civil war. This is why those Arabs who hold Israeli citizenship are insistent that they remain Israeli citizens. As for those who don’t, the best thing for them is Jordanian citizenship. They can vote for the Jordanian parliament just as I can vote for Congress and POTUS. They can even be given exterritorial seats as in the French
    Assembly of French Citizens Abroad and National Assembly, which has eleven seats for expats.

    G, really she should not be in Criminal Court at all. She has no prior experience in criminal law and was elected to the Civil Court. However, in NYC a judge can be transferred between Civil and Criminal courts and even from one borough to another depending on personnel needs. However, being that she is now in Criminal Court there is no reason why she should not be the trial judge. However, now that it has been designated a hate crime it will probably be tried in the Supreme Court.

    Joseph, I already posted that. However, to save you the trouble of scrolling up I will repeat it. They should be offered a generous emigration package by an international fund. According to polls the vast majority would take it. Those who stay should be offered either full citizenship on condition that they sign a loyalty oath and do national service. The rest should receive permanent residency with full personal rights (e.g. labor laws would apply to them) but no political rights.

    DY, Mendelssohn also thought that denying are national aspect and would solve all our problems. The Dreyfuss case proved him wrong and the Holocaust settled it.

    1. What was the charge in the $1m bail case and what was his economic status?
    2. Why do you insiste on judging her unfavorably? Why don’t you complain about the prosecutors only charging him with misdemeanors? They could easily have charged him with second degree assault rather than third degree and ratched it up to a Class D felony (2-7 years), which would also have meant a much higher bail.

    It is standard to ask for much more than you really want and much less than you are willing to give. The prosecutors should have charged him with a hate crime in the beginning. That would have made it the charges felonies and bail would have been much higher.

    000646 (BTW, what is the meaning of that number?), FYI the ENTIRE Ottoman province of Palestine was given to the British ym”s by the League of Nations to establish a Jewish state. They partially reneged by creating Transjordan (now Jordan) in 1922 in order to reward Abdullah I for services rendered in WW1. They then further reneged by severely limiting Jewish immigration while allowing unlimited Arab immigration. Thus Jordan is Palestine. Judea and Samaria should be part of Israel. Read the Faisal-Weizmann agreement and the Levy report.

    BTW, the Jordan Times, which is mostly owned by the government Social Security fund, recently published a pro-Trump article by veteran former diplomat Walid M. Sadi . Look for a plan for Jordanian citizenship to be restored to the Arabs and some sort of joint administration.

    00046, very few will sign and even fewer will do national service, which is also a condition. As for countries willing to take them, Canada, especially under Justin Trudeau will probably be happy to do so. With the resettlement package several other countries will also be interested. Western European countries will have no choice as someone will have to support their aging populations.

Offering them a new life in a country like Canada (which needs 350,000 workers) or Germany (which needs 800,000) plus a generous stake would lead to a mass exodus.

    I am in favor of a two state solution. Israel and Jordan. Jordan is, in fact, Palestine. It was part of the Ottoman province of Palestine and is majority “Palestinian” (as opposed to Beduin.). The Arabs in Judea and Samaria should be paid to leave to countries that need immigrants with money by an international resettlement fund. Those that do not can be offered permanent residency or citizenship (if they agree to do national service and sign a loyalty oath).

    1. I find it hard to believe that Rav Eliashiv said “machnissei harachamim”.He was a Litvak and the Gra even opposed “barchunei l’shalom”. In any case, what does that have to do with the dead (BTW, the Gra opposed going to cemeteries in general as do the Briskers)?

    2. If you are referring to Rav Kook’s teshuva on leaving EY to go to kivrei tzaddikim,he odes not say that it is a chumra but ikar hadin. He also says that it is not clear that there is a mitzva at all.

    3. Rav Tuchachinsky casts doubts on the practice of making requests of the dead (Gesher haChaim 2:25). Certainly actually davening to them is a”z.

    Silicon Valley’s products are only that. Products. They are only tools. How they are used is up to the user. As the NRA has always pointed out, guns don’t kill people. People kill people (this is also the halacha – a person who shoots an arrow cannot escape liability by claiming that it is the arrow’s fault). Conservatives (and if you would be even a bit familiar with Edmund Burke and Russell Kirk you would not contend that conservatives have “no philosophic or moral framework for judging good from bad or right from wrong” should get moving and jump on the bandwagon. Unfortunately, so far only the Alt-Right crowd understands this and they are just as bad as the Left radicals.

    As fi libertarians, IMHO they are simply way before their time. In the messianic age when all will desire to do Hashem’s will (see Rambam at the end of Hilchot Melachim) there will be no need for government coercion (and BTW, libertarians are split between anarcho-capitalists, who think that insurance companies can take over all of government’s protective functions, and minarchists, who favor in the “night watchman state”). Even today, the extent to which government is needed depends on the extent to which a people is, in John Adams’ word, religious and moral. The Netziv also alludes to this in his commentary on the mitzva to appoint a king.

    3. The Gemara mentions Amoraim who lived in very different generations arguing with them.
    4. When do you consider the end of the period of the Achronim to have been?
    5. Many Achronim care. Just to give one every week and very important example, the Mechaber paskens like Rabbenu Tam regarding the beginning and end of Shabbat and the Rema does not disagree. The Gra reopened the matter and paskened like the Gaonimand most observant Jews follow him.
    5. Obviously the Maharshal, Shaagat Arieh, Schach and Gra disagree with the Or haChaim haKadosh. See Rema CM 25:61.

    Laskern, how did you study goyish Math? BTW, FYI I also am somewhat of a mathematician having worked in the actuarial field. In any case, if you look at Rambam’s commentary on the mishna in Eruvin (it’s in the back of most gemarot) you will see that he holds that a convenient estimate is sufficient for halachic matters. 1.4. Interestingly, he knew that pi is irrational although this was not proven until Johann Heinrich Lambert did so in 5521. The Gra points out that the word קו is spelled קוה in the pasuk. קוה divided by קו is extremely close to pi/3.

    1. In that case Rav Moshe cannot argue with Rav Yosef Etlinger. However, he can and an Acharon who is of sufficient stature can argue with a Rishon. For that matter, rishonim argue with Gaonim. The Mishna and Gemara are different because there was an acceptance that they are closed (although some Savoraim were added to the Gemara and see also Chochmat Shlomo on Sanhedrin 52b.

    2. Why would Tosafot not want to rely on it? Chochma b’goyim taamin. Moreover, Chazal rely on it in hte discussion of a round sukka. See also Tosafot on Eruvin 14a d”h v’haicha where they bring a difficulty from Greek geometry (see Rambam’s commentary on the mishna where he resolves it (there is also a way if one uses an inner an outer border for the yam).

    One must be a bar hachi. The Maharshal, the Schach and the Gra all disagreed with Rishonim. As for arguing with Acharonim, the major contemporary poskim are themselves Acharonim. Rav Asher Weiss has disagreed with the Chatam Sofer. The same goes for taking sides. Of course, a person can decide to rely on a certain posek against another, especially on a d’rabbanan (safek l’kula). This is not the same as arguing as he is not saying who he thinks is right.

    Akuperma, a negative income tax only applies to people who work but have low incomes. The best solution for disabled people is to enable them to work around their disabilities. For example, a person who is homebound could telework. This is, in fact, becoming generally accepted as it saves companies expensive office space and saves employees commuting time (and very often aggravation).

    Curiosity, for that matter, there was a gadol in Morocco who was famous for his concentration. Someone once bet that he could disturb him so he fired a shot into the air while the gadol was davening. It did not work. However, very few people are on that level. Gezel tefilla is a very serious matter. See, for example, Mishna Berura 98:3 regarding bringing small children to shul. As for Hashem having sent the annoying person, that does not excuse him. Hashem sends chova by way of a chayav (Taanit 29a)
