The whole point of the double-ring ceremony is to make the woman feel good about herself. He even says that you have to explain this because he points out some problems in the Kiddushin if they think that she needs to give a ring as well.

    R’ Moshe in Even Ha’ezer 3:18 writes that the Kiddushin is perfectly valid. Although he does hold that it’s assur to do it.

    Because we are issuing a psak which will lead to a person who is factually a chalal doing avodah on Shabbos.

    The Meginei Shlomo addresses that at the end.

    You could make a similar argument for eishes ish; if beis din would be mattir her, there would be no actual issur, yet we do, when issuing the psak, take into account that there’s an issur s’kilah.

    That’s not the argument that Tosafos is addressing. The argument is based on whether there will actually be eidus against the woman. In the eishes ish case, if eidim in fact come, there will vadai have been a violation of eishes ish which is an issur misa. There is no way for Beis Din to be mattir anything. In the shevuya case, if eidim in fact come, there will not vadai have been a violation of an issur misa. There will have been a violation of an issur lav (zonah), and if the kid does the avodah on Shabbos there will be an issur misa. However, as the Meginei Shlomo points out, a Beis Hamikdash would be a necessary prerequisite and that being the case, ???? ??? ????? ?? ???? ????? ???? ????? ???? ??? ?????? ??? ????? ?????? ????? (Kiddushin 71a). So certainly there would be no problem for the future generations, and there wouldn’t be a problem for the original kid either, because if the eidim come now (i.e. before Moshiach) then we will pasul the kid from doing the avoda and no harm will have been done. And if eidim come after Moshiach comes, it won’t matter because Eliyahu will have already resolved it.

    That’s why I was mechadesh that Rabbeinu Tam is concerned that the Beis Hamikdash will be rebuilt without Eliyahu.

    Even in the first approach, there’s no reason to say your chiddush – Rabeinu Tam could simply have disagreed with the M”S’s assertion that we’re not concerned about the eventuality of a chalal who will not be revealed as such doing avodah.

    I think you’ll find you need seven people. Or just take secretagentyid instead of me, though I’ll volunteer to start a N’shei.

    When I wrote that post I was wondering if I should preempt this misunderstanding but I decided not to. I wasn’t suggesting that we should have a minyan of women. I was assuming that the women involved will have have husbands. Which in retrospect may have been a bad assumption because there might be single girls who want to join the shul. So maybe we should do a partership minyan after all.

    And yeah, probably both are quite accurate.

    Is this referring to my question about the road, or something else?

    Why would it make a difference what day Moshiach comes?

    Rather, he holds like the lunatics today who want to rebuild the beis hamikdosh before moshiach.

    Anyway, I can understand that there were hashkafa issues with the “Response to Ben Levi” thread. Was that also the issue with the “Avraham Avinu” thread? Because I still have no recollection of what it was about.

    Originally, I thought something along the lines of your alternative teirutz, namely that R”T is assuming that R’ Chanina wasn’t issuing a ruling that was specific to the circumstances, especially when he never mentioned that it wasn’t an across the board rule. And therefore my question was silly. But once I saw that the Meginei Shlomo brought up this very point, I decided that it was a good question and I wanted to give a “real” answer.

    Thanks for the clarification. I wasn’t counting those because I assumed that Randomex’s question was if I had had a thread that had been approved and then subsequently deleted, whereas these five were never approved in the first place.

    But once you brought them up:

    “Coffee Room Rules” “Vanishing Thread” and “Moderator’s Conspiracy” were about why a certain post was getting blocked so I can understand why those threads were not approved (we can’t have people questioning the Moderator’s authority). “Avraham Avinu”, I have no idea what that was about. Can I get a hint, perhaps?

    But “Response To Ben Levi” I am disappointed about, because we were having a geshmak debate and then the thread got closed with him having gotten the last word, and I had such a good response to post. Maybe since it’s almost a year later, (and presumably the tensions have died down) you can approve it? Especially considering that most people probably won’t even know what it’s a response to, so no harm will befall them. If you don’t want the debate to restart, you can approve my post and then immediately close the thread.

    So now that oyyoyyoy has joined the bandwagon (or perhaps in this case, the bannedwagon) it seems that we already have four people just in this thread who “don’t fit in any box”. Six more and we can start a shul. And we might not even need a Rabbi considering that one of our members might be halfway on* the road to Maharat-hood.

I would say that you agree with me full way – you just pointed out the other perspective. I actually originally pointed out the very point that you are making, but then I took it out of my post, though I’m not sure why. Maybe because I didn’t want to detract from the perspective which I was elucidating. Either way,

    (The above was solely because I am a “hugely argumentative person”.)

    On a more serious note, you raise some good points, especially about choosing a shul/school. I don’t know if there is any simple answer.* Unless you can find enough like-minded individuals. But I don’t know how likely that is – I don’t think I’ve ever met someone like-minded to me in real life. I understand the social aspect as well, but finding enough like-minded individuals to have friends shouldn’t be quite as hard as finding an entire school full of like-minded individuals.

    *I would say to just look at all the schools and pick the one which seems the best overall, regardless of affiliation, but that might have some interesting results considering that your kids will probably getting mixed messages, and all the more so if you choose a shul in the same manner and end up with a modern school and yeshivish shul or vice versa. Oh well. There’s always home school. And home shul.

    From a certain perspective it is advantageous to not belong to any group because you will feel more comfortable with other groups than had you belonged to a different group. E.g. if A is yeshivish, B is modern, and C is neither, C will feel more comfortable than B will among yeshivish people, and C will feel more comfortable than A will among modern people. But actually, that wouldn’t really be a function of being groupless inasmuch as it would be a function of being in between two other groups. So the best bet would probably be to create a group for the groupless. Or to quote David (as in David and Goliath?) “Friends of the friendless seize the day”.

    I’ve seen the study before as well as a couple of reviews of the study. Let’s just say the study doesn’t demonstrate anything. For a very simple reason. If you are computing the average number of seeds then by definition that means that different pomegranates have different amounts of seeds. Therefore the average will be based on how many pomegranates you use, and the size of the pomegranates you use. In other words, the one conducting the study controls the results. If I took two sets of a hundred pomegranates and figured out the average for each group, they would not be the same. So the average number of seeds in any group of pomegranates is essentially meaningless.

    Now if it is assur to say lashon hara about yourself, then including yourself in the g’nus wouldn’t make it better; it would make it worse because now you are saying lashon hara about two people.

    However, one might respond that this is not a raya because perhaps the Chofetz Chaim is not bringing this up in terms of the etzem badness of the issur, but because you might think that if you include yourself in the g’nus then you are demonstrating that you don’t really view it as something so bad. (Though it would be odd that the Chofetz Chaim didn’t mention that now you made the issur worse.)

    And anyway, the source for this halacha is the Yalkut Shimoni in Isaiah Remez 406 which says:

    All these sources are from the past couple of hundred years. I have yet to find any earlier source. Which is interesting because none of these sources are quoting each other (except for perhaps the last one) so it seems as if there was some sort of earlier source or tradition.

    Regarding the Chofetz Chaim, there is a version of the story in the biography written by his son. I will hopefully post the quote later.

    If yes, your schedule doesn’t justify it.

    It wasn’t a complaint; it was an observation. Based on the observation I assumed that the post that I was then going to post would take very long to be approved, and I wanted the person to whom I was responding to be able to see it that day (especially considering that I think he is several hours ahead).     So I’m actually reading the court transcripts. I’ve read several hundred pages of it so far which included the testimony of the sergeant, the testimony of the detective investigating Wilson, the testimony of an FBI agent investigating civil rights abuses, Wilson’s testimony, and I’m currently in the middle of the Medical Examiner’s testimony. I’d just like to comment on a few of the comments here.

    After the altercation in the police car (in which Brown allegedly tried to reach for the poiceman’s gun), Brown ran away.

    Brown did not allegedly try to reach for the gun. In his testimony, Wilson said that he told the Sergeant that Brown “went for is gun” and one of the jurors pointed out that the term “went for his gun” is not at all what happened. What happened was that Wilson drew his gun and then Brown put his hand on the gun and redirected it towards Wilson. Wilson himself agrees to this.

    I just find it hard to believe that a Police Officer wearing Mace a Taser and with the ability to call for backup as soon as things started getting contentious REALLY had to shoot the kid in the head multiple times in order to save himself.

    He didn’t have a taser. He had already called for backup. If Wilson was telling the truth that Brown was charging at him, and knowing from the altercation in the car that Brown completely out matched him, it would make sense why he had to shoot him.

    There were also autopsy reports that said straight out that he was shot in the head as he lunged for the gun.

    I’m still in the middle of the Medical Examiner’s testimony so I won’t yet comment on what the autopsy said. However, I know it definitely did not say this. An autopsy can perhaps say that he was lunging, but it has no way of knowing what he was lunging at. Wilson was already shooting at Brown while he was a distance away. He said that the final shot was from about eight feet away.

    “000646: The police officer said he DID NOT have a taser in his car.”

    Well that would be incompetence or irresponsible.

    The point is that it is really hard for me to believe that a Police officer acting in a correct and thought out manner would really be in a position where an unarmed person would kill him if the officer didn’t use lethal force. Why did he get out of the car himself? Couldn’t he have waited for backup? Did he mace the kid, hit him with a club when he charged? Why couldn’t he shoot the kid in the legs, or somewhere besides the head?

    He said that the reason he did not have a taser is that they have a limited number of tasers and they’re large and uncomfortable. Wilson explained that he got out of the car because Brown was a threat to other people including other officers who would show up. He said that he was just trying to stall him for a little bit since he expected the backup to arrive in about 30 seconds. And he shot him several times not in the head which didn’t accomplish anything. Then he shot him in the head.

    Syag: I got the part about him being shot while Wilson was in pursuit from Wilson’s own testimony. You’re right, though, that he wasn’t hit in the back. I believe the bullet grazed his fingers, although I’m not sure. Wilson testified that he saw Brown’s body “jerk” before he turned around.

    Wilson did not testify anything of the sort. He testified that he did not shoot while in pursuit. Once Brown turned around and charged at him, he began shooting.

    I’d venture to say that Wilson should have waited for the backup that he’d already called in at the start of the incident. (They ended up arriving moments after the fatal shots.) Even in circumstances where a suspect is ARMED but not an immediate danger, protocol is to wait for backup. By choosing to pursue and continue using lethal force against an unarmed person, Wilson was following the protocol for believing another citizen’s life was at risk, a conclusion that is difficult for me to understand given that Brown was heading away from the scene at the time and no longer threatening anyone.

    I already explained why he pursued. And pursing is not lethal force. The lethal force was after Brown turned around and charged at him.

    As to the stolen merchandise: Wilson testified to his sergeant that he had not been aware of the robbery when he stopped Wilson; this was indeed publicly available information long before the grand jury’s decision. This testimony was completely changed during McCulloch’s press conference with no explanation.

    This was one of the main discrepancies in the testimonies. The sergeant testified that Wilson said that he had head the call about the robbery, but didn’t make any connection between that and Brown. Wilson testified that he told the sergeant that he did make the connection.

    You are correct that Rashi left out the word ?????. I will have to assume that Rashi means that an act of hatred against the Jews is an act of hatred against Hashem or perhaps he means that in general hatred of Jews is indicative of hatred of Hashem. But he can’t mean that if someone hates Jews then he by definition hates Hashem. Here’s the proof: What if Hashem tells someone to hate Jews. He obviously doesn’t hate Hashem – he loves Hashem and that is why he is listening to Hashem to hate the Jews. Now you might know that Hashem would never tell someone to hate Jews. But you can’t presuppose that someone else knows that. Which brings us back to my original point which is that while we can decry Neturei Karta and their practices, I don’t think we can assume that they hate Hashem.
