I just checked on Davka’s site. It seems that they make Davkawriter7 in a Mac version, but not 6.

This is from their FAQ section:

How do I run DavkaWriter 6 on my Mac?

Posted on February 16, 2011 by Davka Tech Support

DavkaWriter is, essentially, a Windows program. There is no Mac version.

If you use Windows on your Mac, as many Mac users do, or if you use Windows emulation or virtualization, you can run DavkaWriter in that configuration.

    Some alternatives for this are:

Those all require the user to have a copy of Windows XP, Vista, or 7. These alternatives provide full DavkaWriter functionality.

    Sb,

What’s crossover? It sounds like an program that converts a pc based program to Mac based program, is that correct?

Davka, IIRC, allows two installations, one on a pc and one on a laptop, as long as they’re not used simultaneously. Assuming they don’t make a Mac version, I can’t see why it’s a problem, and it might be ok even if they do. You should contact them; I understand the owner is an ehrliche Yid and reasonable.

    42,

Interesting. What’s even more interesting to me is that if true, that would dispel a theory of mine, that if it’s not geneiva, there might be issues of lo s’chonem to purchase what is available b’chinom. It would seem that plain and simple fairness makes it a benefit for the purchaser to pay for what he uses.

    HaLeiVi,

Interesting theory. It would explain very nicely the distinction between a case of a lost sale and a case where there is no lost sale, because the poel only worked for those who would purchase the item.

    Nechomah,

My point was that their infertility wasn’t a known issue at the time the shidduchim were considered, so it has no bearing on our discussion.

And I agree that the OP has a legitimate concern, although I don’t know if the particulars of this case indicate that there’s a significantly higher chance of infertility issues than in the general population.

IIRC, the author of that article told me that when the psak was originally issues it was a big topic of discussion and it was well known what his intentions were. It’s actually hard to imagine that he was discussing only software created by those who are “bichlal amisecha”, which is a very small minority of software.

    From Wikipedia:

A factoid is a questionable or spurious (unverified, false, or fabricated) statement presented as a fact, but with no veracity. The word can also be used to describe a particularly insignificant or novel fact, in the absence of much relevant context.

The second definition makes it no better than “trivia”, and let’s hope that the first definition doesn’t apply to these posts. 🙂

Here is R’ Moshe’s teshuvah. He is referring to Torah tapes. I don’t see why music tapes should be better.

    http://www.hebrewbooks.org/pdfpager.aspx?req=920&st=&pgnum=70

    This is in O.C. 4, 40-19.

    The relevant, final sentence:

    ??? ????? ???? ??? ????? ??? ??? ????? ??? ????? ???

It is clearly gezel, not (just?) masig g’vul, according to R’ Moshe.

    J22, from a diffeent site:

Someone who repairs computers must at time erase the entire drive and reload the programs one by one. What happens when the customer did not legally purchase these programs. Is it permissible to restore what the customer had originally?

Rav Elyashiv: It is absolutely forbidden and even if he will lose his customers he must search for a new manner in which to make a living.

(Adapted from Ashrei HaIsh OC Vol. III Chapter 19)

I asked the author of that article if there was any distinction made by R’ Elyashiv as to the producer of the software, and he told me there definitely was not.

    J22,

IIRC, R’ Belsky holds that they don’t expect you to buy two copies.

Software copying was assered by R’ Elyashiv, no matter who the producer was. This seems to indicate that it’s not a hasagas g’vul issue.

    ICOT,

Wow, do you think he ran out of pre-registered names?

I don’t find your position to be inconsistent for three reasons:

    1) Most gedolei haposkim asser. Stating the majority opinion as halacha is more justifiable than stating a minority opinion as halacha. Especially since even the minority opinion, AFAIK, still doesn’t consider it ethical.

    2) We are dealing with a serious shailah of gezeila d’Oraisa. It is more prudent to take the more stringent position than the more lenient one. This is true for any issur, and especially so when dealing in monetary issues.

    3) (v’hamavin yovin)

how would one be mekayem ‘v’heishiv es hagezeila’?

Possibly by purchasing the song/album which was copied. Although, I don’t think one can actually be m’kayem the mitzvas aseh unless he returns the actual item.

If I stole a steak (from Seasons, for example) and then ate it (with salt and pepper, maybe), I don’t think I can actually be m’kayem the aseh, although I am obligated to pay for it.

Many references to avodas kochavim in the gemara and other seforim are not literal, and were actually changed from the term nochri (or similar) to avoid offending people. The term “min” was also often changed. Sometimes the sensor was an a”h; it’s humorous to find, in hilchos taaruvos, the phrase “akum b’akumo”.

Too harsh? That probably depends on the motivations of the poster you were referring to. If he intentionally ignored the psak of the gedolei haposkim, then he deserved to be rebuked. If he was unaware, then it was too harsh. I’m curious how you knew that some links were deleted. Was it posted and then removed, or do you have inside info? It seems hypocritical of that poster to want to debate the topic without links, yet provide links.

The second part of that post was also interesting.

    Y2,

Maybe I’m not using the term “intellectual property” correctly. The point is that the gedolei haposkim hold it’s considered theft, seemingly because the music, or program, in the case of software, belong to the producer.

You should not compromise on middos. In fact, you might not be able to; a girl with poor middos might not have tolerance for your stuttering.

You need to adjust your attitude that a girl who’s “no so smart not so pretty” isn’t a top girl.

    Ctrl Alt Del,

No, it’s a mitzvah like taking an esrog, which one must put in effort to do. Bitachon doesn’t exempt one from putting in the proper effort to do a mitzvah. I spend time and money looking for a nice esrog, I don’t rely on Hashem finding my basherte esrog.

I don’t necessarily think that there’s a strong indication that she can’t have children, but the issue is a legitimate one.

Your reaction is indeed overblown. Nobody is reducing this person’s value to her relatives’ fertility. Her prospects as a wife, not her value as a person, is being evaluated.
