yitayningwut & sam2 -You’re both saying the same thing -that a Minhag can take precedence over Din. What I’m saying -Who said it was ever a Minhag? The places that didn’t have the women fast was because they were Meikel with women, not because of some Alte Minhag. So if you can be Mevaer which women nowadays can have a Heter and which can’t, I see no reason to be Meikel, in spite of the fact you keep screaming Minhag!

I didn’t really draw any conclusion, but I don’t see anything close to determining her guilt. The Appeals Court did draw a conclusion. Do you have any reason to doubt their verdict besides your conspiracy theories?

After you start going out and start to feel comfortable with the girl, usually sometime after the first date, at this time you can start having deep Hashkafa convos and see if she is on the same page as you!

soliek -“she shouldnt…her husband should either get a job…or make arrangements”

Most Naarish a thing I ever heard. Let’s say the husband gets a job and they still can’t make ends meet? Of course the woman should work. If you said she should preferably work from in the house as opposed to working in the street, this I would agree. But you said she shouldn’t work at all. This is K’neged Chazal whom in many places say a woman is Mechuyav to work. Do you know the definition of Masay Yodeha? They even say she is Mechuyav to work, even if the family doesn’t need the money because of Batolla Mayve L’yehday Shemum! In this case she can do some minor work at home. Having to work in the street is not a Patur to not work at all, if she can’t do a Parnossa from the home.

yitayningwut -“Perhaps the “minhag” of these segments of Klal Yisroel came about because they hold that the women never accepted upon themselves to fast”

Sorry the Rema says Befairush and the MB explains -this is only Pregnant and nursing women who didn’t accept it upon themselves. On e/o else including other women the Biur Halacha says -“it became a Taanis Chova”. And like Sam2 says -this is “Poshut P’shat” in the S’A. So you can’t say there is a Minhag for certain segments not to fast except for pregnant and nursing, unless you find Achronim whom argue on the S’A and then you can be Someach on them. Right now all Poskim can do is say that the certain individual fits into one of the categories were they don’t have to fast; eg. -sick, pregnant or nursing. I just think the Brisker Rov & others held most women will fall into one of these categories. But nowadays we have medical tests to know if s/o is pregnant or anemic or something like this. So I can’t see anyone just giving a blanket Heter for any group not to fast!

YehudahTzvi -“CA passed a law that the MOST one can sue for in malpractice cases is 250,000. Most lawyers in CA don’t even bother because it’s not worth their time and expense. I have been turned down four times by four separate lawyers.”

You can sue the first guys in NY. Also, even in CA you can pay the lawyers to take your case, if they won’t do it on consignment. Most take between $200 -400 per hour. This would end up costing at the most $35,000 for a case like this. If this is a lot, I’m sure if you offer a lawyer $10,000 down and the rest of the third of the total win on consignment, which comes out he/she gets a total of $83,000, you would have plenty of sharks biting on your case! Don’t look for the best lawyer or the most famous one, just s/o who has some sort of experience in Malpractice cases.

Take the case yourself (Pro-se) if none of the options are viable. Even if you are 100% positive that you can’t present a case yourself, (I’ve done it and it’s not as hard as lawyers make it out to be), just by filing the case, you might get a settlement offer!

Sam2 -“Health: It might seem that way in the Sugya in Yevamos but the standard rule quoted throughout Shas is that we don’t say it.”

True, but Tosfos on the bottom of Nun -Ches:2 asks why don’t we learn out Esay Docheh Esay V’losasay from the Tzad Hashoveh from Metzora? He answers because of Sholom Bayis. This is very Shver because the Gemorah uses this to try to push off Shiluach Hakan, nothing to do with taking haircuts. That Metzora for Sholom Bayis we want to end it quicker -here we want to give him a haircut. It’s two different Asays. The haircut won’t make the Tzoras over quicker. So why can’t we learn to all over Esay Docheh Losasay V’esay? To say that since there is a Din of Sholom Bayis makes it so we can’t learn anything out of it – is a big Doechek. It’s not like Kohen where the whole Metzious is based that a Kohen is different than e/o else!

Also, this Asay of V’enesem -you can say you are Yotzay with other things, not just fasting, so it could only be a Lav here anyway.

So he has a good Kasha -why shouldn’t we eat a Seudah on

    Shabbos/Yom Kippur?

I have an answer, if you’re interested.

mms601 -“Why hasn’t Pollard applied for parole?”

This question keeps popping up here in the CR. Is this ignorance or is this hatred?

Here is what I posted in the Topic –

“Jonathan Pollard must apply for parole to get clemency”:

    “Health

    Member

    From J. Pollard. org:

“Why Pollard Doesn’t Apply for Parole?

    Parole is Impossible

Pollard’s “pro-bono attorneys have done and continue to do everything that can be done, within the legal field, to gain Jonathan’s freedom,” Rabbi Lerner wrote. “They are outstanding professionals, stymied only by a judicial system that is strongly biased against Jonathan… The [relevant] law enforcement and intelligence agency officials… have indicated that they would oppose parole… Parole is a virtual impossibility under those circumstances. Every legal expert the Pollard camp has spoken to, and there have been many, told them that the parole board would reject Jonathan’s request out of hand.”

Rabbosi -Right Now I feel there is a chance to help Pollard, maybe even more than petitions. Yahoo is taking questions by submissions which are going to be asked to the President. Here is what I posted:

“Why won’t you pardon J. Pollard? This has nothing to do with Democrats and Jews or Israeli/ US relations. His incarceration is a blemish on America’s conscience because he agreed to a plea bargain. He kept his end by pleading guilty, but the prosecution didn’t keep theirs’ by making sure he received a fair and light sentence. If there is a conscience right now in the Executive Branch of the US gov., he should be pardoned on humanitarian grounds!”

I give anybody permission to copy and paste into Yahoo.

You do realize that you have two cases of negligence on your hands. I don’t know if you want to sue the first guys who missed your original diagnosis but you can. But in the second case, you definitely should. You could probably make millions. I’m not a lawyer, but I can’t stand incompetece that makes the rest of us look bad. To all: I doubt you have to have specific Kavana, even acc. to the Shita of Mitzvos need Kavana, as long as you have Pirush Hamilos. Saying Mekadesh Hashabbos is enough to be Yotzay Shabbos Kiddush, without specifically thinking this is in place of standing there with a Kos.
